HomeMy WebLinkAbout1066 .' . . .> RESOLUTION NO. 1066 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT FOR A DRlVE-THRU EATING ESTABLISH- MENT AT 5 WEST DUARTE ROAD AND 921 SOUTH SANTA ANITA. WHEREAS, on August 1, 1978, an application was filed by Peter F. Stanger, agent for Volunteer Quality Foods, Inc., to construct and operate a drive-thru eating establishment, Planning Department Case No. C.U.P. 78-14, on the property commonly known as 5 West Duarte Road and 921 Santa Anita Avenue, more particularly described as follows: Portions of Lot 3, Tract No. 950, in the City of Arcadia, County of Los Angeles, State of California, as per map recorded in Book 17, page 25 of maps, in the office of the Recorder of said County. WHEREAS, a public hearing was held on August 22, 1978, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Plan- ning Department _n the attached report is true and correct. SECTION 2. This Commission finds that: 1. The granting of conditional use permit as hereinafter provided will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2. The use applied for at the location indicated is properly one for which a conditional use permit is authorized. 3. The site for the proposed use is adequate in size and shape to accommodate said use including all yards, parkiug, -1- 1066 . loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the p~oposed use. 5. The granting of such conditional use permit will not adversely affect the General Plan. 6. The use applied for will not have significant effect on the environment. SECTION 3. That for the foregoing reasons, subject to approval of the City Council, this Commission grants a conditional use permit to construct and operate a drive-thru eating establish- ment upon the following conditions: . . l. The property shall be improved and maintained in accordance with the plans which are on file in the subject Case No. C.U.P. 78-14 and applicable regulations of the Arcadia Municipal Code. 2. That a lot consolidation be approved and filed with the County Recorder's office prior to issuance of the occupancy permit. 3. That all signing shall comply with Code. 4. That the size and location of all directional signs shall be approved by the Public Works and Planning Departments. 5. That all parking and landscaping shall comply with Code. . 6. That at least one parking space shall be set aside for bicycle parking. -2- 1066 . . . 7. That additional landscaping be provided in an amount and location acceptable to the Planning Department and the appli- cant. 8. That the hours of operation be restricted to: Sunday through Thursday, lO:30 a.m. to lO:30 p.m. and Friday and Saturday, 10:30 a.m. to 11:30 p.m. 9. That a covenant be filed in a form and content approved by the City Attorney prior to issuance of any building permit. 10. That the northerly driveway on Santa Anita be restricted to ingress only and posted accordingly and the southerly driveway on Santa Anita be restricted to exiting only and posted accordingly. 11. That all exits from the southerly parking area be posted with "right turn only" signs. l2. A right-of-way shall be dedicated to provide for 42 feet from center line of Duarte Road; and a IS-foot radius corner cut-off shall be dedicated at the northwest corner of Duarte Road and Santa Anita Avenue. 13. Full parkway width P.C.C. sidewalk shall be constructed on Duarte Road, and approximately 80 square feet of A.C. sidewalk on Santa Anita Avenue shall be replaced with P.C.C. sidewalk. Parkway tree wells and trees shall be required in accordance with plans to be approved by the Director of Public Works. l4. Grading and drainage plan shall be submitted for the approval of the Director of Public Works. -3- 1066 . ~ SECTION 3. Approximate~y 35,000 square feet 101.25 feet on Duarte Road 239,97 feet on Santa Anita Avenue North: South: East: West: Office bUilding: zoned C-2 City Library; unzoned Service station and egg ranch; zoned C-2 Commercial uses and high school; zoned C-2 and R-l, respectively . GENERAL PLAN: The area is designated as Mixed Commercial/Public Fac i1 it ies . C.U .P, 78-14 2 . SPECIAL INFORMATION Building: Size: 2,336 square feet with seating for 68. Exterior Design: Brown brick with rough sawn wood trim. The building will be located on the northerly lot fronting on Santa Anita and will be set back 10 feet from the Santa Anita property line, There is a special setback of 60 feet from the center line of Santa Anita (10 feet from the property line), Parking and Landscaping: The applicant proposes 48 parking spaces; 47 spaces are required by Code. . The drive-thru lane will stack a maximum of six cars without interferring with the parking along the northerly property line. Ingress to the parking lots will be from a two-way drive off of Santa Anita north of the building and a two-way drive off of Duarte Road. Egress from the parking lots will be from the two-way drive on Santa Anita, an "exit only" drive south of the building on Santa Anita (serving the drive-thru lane), and the two-way drive on Duarte Road. Landscape planters ranging from 2 feet in width to 3 feet in width are proposed along the inside perimeter of the property. A 6-foot wide to 10-foot wide landscape berm is proposed along the Santa Anita property line between the parking area and the street. The applicant is proposing a l6! foot wide landscape berm along Duarte Road. The Public Works Department is requiring a 42-foot setback from the center line of Duarte Road which will result in a 12-foot dedication along Duarte Road. This dedication will reduce this planting strip to 4x feet in width, Code requires a minimum 5'3" wide landscape buffer between the parking area and the street. The applicant can provide this required landscaping without eliminating any parking spaces, . Signing: The applicant is proposing a 203 square foot freestanding sign to be located at the corner of Duarte Road and Santa Anita Avenue,' Based on the frontage of this property, which is on Duarte Road, the applicant is allowed 150 square feet of freestanding sign, C.U.P. 78-14 3 . The frontage on Santa Anita would allow a 200 square foot sign. A 63 square foot wall sign is proposed on the front of the building. Based on bUilding frontage, a 60 square foot sign is allowed. The proposed freestanding menu sign will contain approximately 13.6 square feet. MISCELLANEOUS INFORMATION The applicant has noted that the hours of operation will be Sunday through Thursday from 10:30 a,m, to 10:30 p.m, and Friday and Saturday from 10:30 a.m, to 11:30 p.m. The applicant has indicated that there will be approximately 15 employees during the peak shift. There is a 6-foot high block wall which extends along the northerly portion of the westerly proper~y line. ANALYSIS . A drive-thru eating establishment is a permitted use in a C-2 zone with an approved conditional use permit. The configuration of the lot has restricted the design alternatives for this site, It is staff's opinion that the circulation pattern should provide for adequate traffic flow and not create any significant traffic problems in the area. Staff would recommend that traffic enter- ing on Duarte Road be restricted from entering the parking lot fronting on Santa Anita and that signs be posted accordingly. The construction of this eating establishment at this particular location (adjacent to the high school) will generate a numerous amount of pedestrian and bicycle traffic~ Because of the anticipated bicycle traffic, at least one parking space should be set aside for bicycle parking. Although the landscaping exceeds the mlnlmum 3 percent required by Code, there is a significant amount of paving resulting from the design of the project, Staff recommends that additional land- scaping be provided in the interior of the parking area, It is staff's opinion that the requested modifications for the signs are not excessive and are appropriate for the site, . Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial stUdy for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance. There- fore, a Negative Declaration has been prepared for this project, . . . C.U.P. 78-14 4 Before the Planning Commission takes action on this project, the Commission should "move to approve and file the Negative Declara- tion and find that the project will not have a significant effect on the environment." RECOMMENDATION The Planning Department recommends approval of C.U.P. 78-14, subject to the following conditions: 1, Conditions as outlined in the attached report from the Depart- ment of Public Works shall be complied with to the satisfaction of the Director of Public Works. 2. That a lot consolidation be approved and filed with the County Recorder's office prior to issuance of the occupancy permit , 3, That a modification be granted for a 203 square foot free- standing sign in lieu of a 150 square foot sign allowed, 4, That a modification be granted for a 63 square foot wall sign in lieu of 60 square feet allowed, 5, That the size and location of all directional signs shall be approved by the Public Works and Planning Departments, 6. That all parking and landscaping shall comply with Code, 7. That at least one parking space shall be set aside for bicycle parking. 8. That additional landscaping be provided in an amount and location acceptable to the Planning Department and the appli- cant. 9. That the hours of operation be restricted to: Sunday through Thursday, 10:30 a.m. to 10:30 p.m. and Friday and Saturday, 10:30 a.m. to 11:30 p.m, 10. This proposal may result in a displacement of soil because presently the site is vacant and developed with a swim school. Any major development of this property would involve some displacement or compaction;however, staff does not consider this to be a significant effect on a relatively flat piece of property. 2. a and b. The proposed use would create an increase in air emissions because there would be a definite increase in the traffic generated by this project. Because of the increased traffic there could possibly be an increase in objectionable odors also. Although there will be an increase in emissions staff does not believe that it will be a substantial in~ease that will cause a deterioration of air quality. 3.b. There could be an increase in the rates of absorption, a change in the drainage pattern or the rate and amount of surface runoff. This increase would result with any develop- ment which would take place on the subject site. However, staff believes that with the controls established by the Public Works Department, that any change in these patterns will not create a significant effect on the environment. S.a. The proposed drive-thru restaurant will create an increase in the noise levels. There will be an outdoor speaker for ordering food and the increased traffic will generate more noise. The surrounding properties are zoned C-2, however, there is an apartment building northwest of the subject site. However, with adequate landscaping and buffers, this noise factor can be reduced. 7. The proposal will prOduce new light and glare, however, with existing code requirements there are adequate controls to mitigate any potential impact from this new light. 8. The proposed drive thru will result in an alteration of the existing land use which is a vacant lot and a swim school. However, the property is zoned for a drive thru and this development would be consistent with the City's general plan. 9.a. There could be an increase in the rate of use of natural re- sources. However, with the State's new energy regulations there should not be a significant increase in the use of any natural resources. l3.a. The proposed eating establishment will create an increase in the amount of traffic generated on the site. However, the applicant's circulation pattern allows for adequate flow of traffic to and from the site. 13.b. The applicant exceeds code requirement for an eating establish- ment and should not have an effect on existing parking in the area. . . . C.V.P. 78.14 l3.d. There will be some alteration to the present circulation patterns on the subject site; however, the proposal will not result in any alterations to public streets. 13.f. There could be an increase in traffic hazards to motor vehicles, bicyclists or pedestrians, however, this would be a result of a more intensive use of the site rather than any circulation patterns. Any use resulting in the develop- ment of this property could result in an increase in traffic hazards. With proper signing the possibility of increased hazards may be reduced. 2l.b. There could be a short term impact on the area due to the construction of the facility. The construction will create substantial noise and possibly dust.
