RESOLUTION NO. 1060
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ARCADIA RECOMMENDING TO
THE ARCADIA CITY COUNCIL A ZONE CHANGE
FROM R-l, R-2 AND PR-l TO C-O & D FOR
THE PROPERTY AT 671 NAOMI TO THE NORTH-
WEST CORNER OF LOVELL AND NAOMI AVENUES,
INCLUDING 1307 AND 1315 LOVELL.
WHEREAS, the Planning Commission of the City of Arcadia
held a public hearing on July 25, 1978, for the purpose of considering
changing the zone from R-l, R-2, PR-l to c-o & D (Professional
Office with a Design Overlay) on the north side of Naomi, 671 to
the northwest corner of Lovell and Naomi Avenue, more particularly
described as follows:

Lots 5 through 14, inclusive, and Lot 16 of Tract No. 4611
as per map recorded in Book 51, page 82 of Maps, records
of Los Angeles County excepting therefrom the southerly
12 feet of Lots 11 through 14, inclusive.
WHEREAS, all interested persons were given full opportunity
to be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY DETERMINES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Plan-
ing Department in the attached staff report is true and correct.
SECTION 2. The Planning Commission recommends to the
City Council that the zoning on the subject area be rezoned to
C-O & D.
SECTION 3. That the restrictions made applicable to the
said properties under Zone D (Architectural Overlay) shall be as
. follows:
a. The height of all buildings constructed on the
subject properties shall be limited to two (2) stories, not to

exceed 30 feet in height.
b. There shall be a minimum setback of 55 feet from the
center line of Naomi Avenue.
c. No vehicle parking shall be located within the
required front yard setback.
d. Seventy-five percent (75%) of the required front yard,
not used for driveway purpose, shall be landscaped.
e. Vehicular access to the properties shall be from one-
way ingress drives off of Naomi Avenue.
f. A plot plan and elevations showing the proposed
development of the subject properties shall be submitted to and
approved by the Planning Commission prior to the issuance of any
building permits.
g. The Planning Commission or the City Council may
modify any of the foregoing conditions if such modification will
not adversely affect property or improvements in the vicinity
and if such modification will equally accomplish substantially
the same results as will adherence to the foregoing conditions.
SECTION 4. That the Planning Commission finds that
the proposed zone change would be consistent with the general planl
would allow for a more harmonious anddesirable development of the
'areal and that the public convenience, necessity, general welfare
and good zoning practice justify the proposed zone change.
SECTION 5. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia.

The City Council at its July 5, 1978 meeting referred this zone
change back to the Planning Commission for consideration of
including a Design Overlay to the proposed CoO zone change for
the north side of Naomi, 671 to the northwest corner of Lovell
and Naomi, including 1315 and 1307 Lovell (see attached staff
report).

A CoO & D zoning designation would have the least impact of all
commercial zones on the residential properties to the south and
east. , The C"O & D zone change would provide for consistency
with the General Plan and would allow for a more harmonious and
desirable development of the area which would be more compatible
with properties to the south and east.
Staff recommends that the following design restrictions be placed
on the property:
',. The height of all buildings constructed on the subject
properties shall be limited to two (2) stories, not to
exceed 30 feet in height."

ANALYSIS: The C-O code allows a building height of three
stories, 40 feet in height. This proposed recommendation
of two stories, 30 feet is consistent with the height limit
allowed in the R-3 zone and is less than that permitted in
the R-l zone (35 feet).
"2. There shall be a minimum setback of 55 feet from the center
line of Naomi Avenue."

ANALYSIS: This setback would allow a 25-foot setback from
the existing property line. If a 10-foot dedication
is required, this would reduce the front setback to 15 feet
from the front property line. The C-O zone requires a
10-foot front yard setback. There is a special setback
along the north side of Naomi Avenue of 70 feet from the
center line of the street. In order to have a lesser
setback than this, a modification would be required.
Vehicle parking shall not be located within the required
front yard setback."
ANALYSIS: Prohibiting vehicle parking in the front yard
will allow for a more aesthetic development of the property
and create a more pleasing visual impact on the properties
to the south.

Seventy-five percent of the required front yard not used for
driveway purposes shall be landscaped."
ANALYSIS: This recommendation would require that the front
yard be landscaped, thus preventing the front yard from
being paved.
"5. Vehicular acces s to the properties shall be from one-way
ingress drives off of Naomi Avenue."
ANALYSIS: Traffic volume on Naomi Avenue east of Baldwin
Avenue has increased significantly in the past five years.

These figures indicate a 44.6% increase in traffic on
Naomi Avenue since 1973. Restricting egress to Naomi from
any new developments may aid in reducing some of the
anticipated increase in traffic on Naomi Avenue.

of the subject properties shall be submitted to and approved
by the Planning Commission prior to the issuance of any

ANALYSIS: Allowing the Planning Commission to approve
proposed plans for this area will enable the Commission
to review the plans for compatibility with the adjoining
properties and neighborhood.
"7. The Planning Commission or the City Council may modify any
of the foregoing conditions if such modification will not
adversely affect property or improvements in the vicinity
and if such modification will equally accomplish substan-
tially the same results as will adherence to the foregoing
conditions."
ANALYSIS: This recommendation allows the Planning Commission
or City Council the flexibility of modifying any of these
conditions as long as the modification will allow for
proper development of the site.

It is staff's op1n1on that the addition of a Design Overlay on
this proposed c-o zone designation may mitigate potential
impacts which might occur as a result of future development of
this area.
Pursuant to the provisions of the California Environmental
Quality Act, the Planning Department has prepared an initial
study for the proposed project. Said initial study did not
disclose any substantial or potentially substantial adverse
change in any of the physical conditions within the area affected
by the project including land, air, water, minerals, flora,
fauna, ambient noise, and objects of historical or aesthetic
significance. Therefore, a Negative Declaration has been prepared
for this project.
Before the Planning Commission and City Council take action on
this project, the Commission and Council should "move to approve
and file the Negative Declaration and find that the project will
not have a significant effect on the environment."

HISTORY
A brief history of the subject site indicates that the property
has undergone several changes from R-l and R-2 to commercial
designations and back to residential.
On July 5, 1977, an application was filed by George Shen for a
zone change (Z-77-8) from R-l to R-3. This zone change was
denied by the Planning Commission. The Planning Commission
believed R-3 zoning was inappropriate for this site and a
commercial designation would provide consistency with properties
to the north.
The City Council at its public hearing on Z-77-8 held on
November 1, 1977, directed staff to initiate a study of this
area.
On January 24, 1978, the Planning Department presented G.P. 78-1
to the Planning Commission recommending a mixed Residential and
Commercial designation. On February 14, 1978, the Planning
Commission voted 5 to 0 to adopt Resolution 1033 recommending a
General Plan change from Multiple Family Residential to a
Commercial designation.

After public hearings before the City Council, the Council voted
5 to 0 to adopt Resolution 4732 amending the General Plan map
land use designations at 1307 and 1315 Lovell Avenue and 625-671
Naomi Avenue from Residential to Commercial.
On April 12, 1978, zone change application Z-77-8 was withdrawn
by the applicant.
ANALYSIS
The proposed zone change to C-O (Professional Office) would pro-
vide for consistency with the General Plan.
C-O is the City's least intensive commercial zone and would allow
financial institutions, business and professional offices and
parking.
It is staff's opinion that a C-O zoning designation would have
the least impact on the residential properties to the south and
east.
Should this zone change be approved, staff recommends that
Naomi Avenue be widened to accommodate additional traffic which
may result from the more intensive development of the subject
area.

If the appeal is to include a verbatim transcript, the appellant
shall so specify in his written appeal and in addition to the fee
shall deposit with the City Treasurer the estimated cost of
preparing two (2) copies of a verbatim transcript. One copy there-
of shall be delivered to appellant upon payment of the balance due,
if any, upon the cost of its preparation and the' other copy delivered
to the City Clerk for use by the City on such appeal; any excess
of the deposit over the cost shall be refunded. At the first
regular Council meeting following such final action, the City
Council, by the vote of a majority of its members, may appeal the
decision of the Planning Commission. If by such action the Council
requests a verbatim transcript for use at the hearing on such appeal,
a copy thereof shall be made available for inspection by any
interested party. No fees shall be required in the case of an
appeal by the Council.
929l.2.2. FEE. Before accepting for filing any
application for a variance or an extension of a previously approved
variance, the City shall charge and collect a fee which shall be
paid and which shall be in an amount established by resolution of
the City Council.
9291.2.8. APPEAL. Within five (5) working days after
such decision by the Planning Commission, the applicant or any
other person aggrieved by such decision may appeal therefrom in
writing to the City Council by filing such with the City Clerk. A
fee in accordance with the applicable fee schedule adopted by
resolution of the City Council shall be paid to the Treasurer prior
to the filing of any appeal concerning a variance.
