RESOLUTION NO. 1054 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT FOR AUTO POLISHING AND CLEANING OF AUTO INTERIORS AT 420 NORTH SANTA ANITA AVENUE. WHEREAS, on April 26, 1978, an application was filed by George Fasching for the addition of an auto polishing and auto interior cleaning business to an existing service station, Planning Department Case No. C.U.P. 78-9, on the property commonly known as 420 North Santa Anita Avenue, more particularly described as follows: Lots 32-34, Block 82, Santa Anita Tract, in the City of Arcadia, County of Los Angeles, as recorded in Map Book 15, page 89, in the office of the Recorder of said County. . WHEREAS, a public hearing was held on June 13, 1978 at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Planning Department in the attached report is true and correct. SECTION 2. This Commission finds that: 1. The granting of conditional use permit as hereinafter provided will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2. The use applied for at the location indicated is . properly one for which a conditional use permit is authorized. 3. The site for the proposed use is adequate in size and shape to accommodate said use including all yards, parking, -1- 1054 . . . loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the General Plan. 6. The use applied for will not have a substantial adverse impact on the environment. 7. The proposed use complied with all requirements set forth for the issuance of a conditional use permit. 8. The proposed use will not substantially increase vehicular traffic on any street in a residentially zoned district. 9. The proposed use will not lessen the suitability of any nearby commercially zoned property for commercial use by interfering with pedestrian traffic. 10. The proposed use will not create increased traffic hazards to pedestrians when located near a school, church, auditor- ium, theater or other place of assembly. SECTION 3. That for the foregoing reasons, subject to approval of the City Council, this Commission grants a conditional use permit for the addition of an auto polishing and auto interior cleaning business to an existing service station upon the following conditions: 1. The property shall be improved and maintained in accordance with the plans on file in the subject Case No. C.U.P. 78-9 and applicable regulations of the Arcadia Municipal Code. 2. This conditional use permit is only for the polishing -2- 1054 4It of autos and cleaning auto interiors and will expire two (2) years after the City Council ratifies the Planning Commission's action. 3. The applicant shall relocate the soft drink dispenser to comply with Code. 4. A trash enclosure which complies with Code shall be provided. 5. Restroom entrances shall be screened to comply with Code. 6. All signs shall comply with Code. 7. All conditions of approval must be complied with within ninety (90) days after the City Council ratifies the Planning' Commission's action. SECTION 4. The Secretary shall certify to the adoption 4It of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. WITTE ASSOCIATE PLANNER GENERAL INFORMATION APPLICANT: LOCATION: REQUEST: FRONTAGE: LAND USE AND ZONING: SURROUNDING LAND USE AND ZONING: George Fasching 420 North Santa Anita Avenue Addition of an auto polishing and cleaning business to the commercial activities now carried on at subject site Approximately 151.6 feet on Colorado Blvd. Approximately 147.65 feet on Santa Anita Avenue The subject site is zoned C-2 and is developed with a service station. The properties to the north, south and west are zoned C-2 and are developed with commercial uses. The property to the east is zoned R-3 and developed with residential uses. GENERAL PLAN: Commercial BACKGROUND The existing service station was constructed in 1954 prior to the requirement for a conditional use permit and the present development standards for service stations. Conditional Use Permit 67-4 was filed in 1967 requesting a minor structural addition for the existing service station. The applicant did not want to update the service station to meet the 1967 City . C,U,P, 78-9 2 Code standards and the Planning Commission denied C.U.P. 67-4. ANALYSIS The applicant is not proposing any structural changes for the existing service station site. A conditional use permit is required as the City Attorney has ruled that polishing and cleaning the interiors of autos would be an expansion of the existing service station use. Mr. Fasching in a telephone conversation with City staff indicated that he planned to construct a building across Santa Anita Avenue to the west on the existing car wash property to use for polishing and cleaning auto interiors within two years. Due to the temporary nature of the proposed use at 420 North Santa Anita, staff does not feel that it would warrant the expenditures necessary to bring the present service station site up to Code standards at this time. The subject site does not conform to Code in the following areas: . 9275.4.17. 9275.4.11. 9275.4.12. 9275.4.18. 9275.4.13. Trash area. Landscaping. Overhead utilities in lieu of underground utilities. Outside soft drink dispenser. Screening of restroom entrances. The Planning Department feels that consideration should be given to granting this conditional use permit application for a period not to exceed two years without imposing the present development standards for service stations with the exception of the soft drink dispenser which should be relocated to conform to Code. If, however, at the end of the two-year period, the applicant wishes to continue the auto polishing and cleaning interiors of autos on this site, a new conditional use permit would have to be filed and all of the development standards in effect in June of 1980 would be applied to this business. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. ~ Before the Planning Commission takes action on this project, the Commission should "move to approve and file the Negative . C.U.P. 78-9 3 Declaration and find that the project will not have a significant effect on the environment." RECOMMENDATI ON The Planning Department recommends approval of C.U.P. 78-9 subject to the following conditions: 1. Conditions outlined in the attached memo from the Department of Public Works shall be complied with to the satisfaction of the Director of Public Works. 2. This conditional use permit is only for the polishing of autos and cleaning auto interiors and will expire two (2) years after the City Council ratifies the Planning Commission's action. 3.
