RESOLUTION NO. 1053
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ARCADIA GRANTING A CONDITIONAL
USE:PERMIT TO OPERATE AN ENTERTAINMENT
FACILITY NX 1020 SOUTH BALDWIN AVENUE.
WHEREAS, on May 1, 1978, an application was filed by
Rick Brandley, John Pierson and Joseph Ramsey to operate an
entertainment facility, Planning Department Case No. C.U.P. 78-10,
on the property commonly known as 1020 South Baldwin Avenue,
more particularly described as follows:
Lots 36 and 37 of Tract 3430, in the City of Arcadia,
County of Los Angeles, as shown on map recorded in
Book 42, page 32, in the office of the Recorder of
said County.
WHEREAS, a public hearing was held on June 13, 1978, at
~ which time all interested persons were given full opportunity to
be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Plan-
ning Department in the attached report is true and correct.
SECTION 2. This Commission finds that:

1. The granting of conditional use permit as hereinafter
provided will not be detrimental to the public health or welfare or
injurious to the property or improvements in such zone or vicinity.
2. The use applied for at the location indicated is
properly one for which a conditional use permit is authorized.
3. The site for the proposed use is adequate in size
and shape to accommodate said use including all yards, parking,

loading, landscaping and other features required to adjust said
use with the land and uses in the neighborhood.
4. The site abuts streets and highways adequate in width
and pavement type to carry the kind of traffic generated by the
proposed use.
5. The granting of such conditional use permit will not
adversely affect the General Plan.
6. The use applied for will not have a substantial adverse
impact on the environment.
SECTION 3. That for the foregoing reasons, subject to
approval of the City Council, this Commission grants a conditional
use permit for an entertainment facility upon the following conditions:
1. The property shall be improved and maintained in
accordance with the plans which are on file in the subject Case
No. C.U.P. 78-10 and applicable regulations of the Arcadia Municipal
Code.
2. A modification shall be granted to allow 130 parking
spaces in lieu of 216 spaces required by Code, provided that written
permission from the owners and lessees for at least 60 parking spaces
be obtained and that this conditional use permit shall be deemed
null and void should said written permission for additional parking
be terminated without provisions being made prior to the effective
date of such termination for an equivalent amount of off-street park-
ing equally as convenient being approved by the Planning Commission.
3. That the bowling alley parking area and easterly wall
be repaired subject to the approval of the Planning Director.
4. That the hours of operation be limited to Wednesday,
Thursday and Sunday from 8:00 p.m. to 12:00 a.m. and Friday and

... Saturday from 6:00 p.m. to 2:00 a.m.
5. That the bowling alley and coffee shop agree to remain
open during the business hours of the proposed night club.
6. That this conditional use permit shall become null
and void if any transfer is made of the rights of this conditional
use permit, by outright transfer, operation of law, forfeiture or
any other means whatsoever, unless the applicants herein first apply
for~ are granted permission to make such transfer by the Planning
Commission. Should such permission be requested, the Planning
Commission may impose additional conditions of approval as it deems
necessary which shall be adhered to by the transferee, or may deny
such transfer.
7. That all areas affected by patrons of the night club
. be controlled to the satisfaction of the Chief of Police.
8. That this conditional use permit may be reviewed upon
the initiative of the City Council, Planning Commission or City
staff when it appears that the use directly or indirectly is
adversely affecting the public health, safety, welfare or is re-
sulting in a public nuisance.
The Planning Commission or City Council may call for
additional public hearings and may impose such additional conditions
as are deemed necessary to mitigate any adverse effects, or may
revoke the conditional use permit if mitigation measures are deemed
unsuccessful.

9. That said night club be a "membership" only club limited
to Arcadia school students or City residents and any changes
regarding membership shall be sUbject to the review and approval
of the Planning Commission and City Council.

10. That the applicants shall be the operators of the
proposed night club.
11. That the applicants shall obtain a dance permit within
six (6) months of the date of approval or this conditional use
permit shall be deemed null and void.
12. That this conditional use permit shall be deemed
null and void should a dance permit be obtained and subsequently
revoked.
13. That security patrol be provided during all night
club business hours.
14. Separation, width and construction of exits shall be
approved by the Building Division and Fire Department in accordance
with the applicable Uniform Building Code Requirements.
SECTION 4. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia.
I HEREBY CERTIFY that the foregoing resolution was
adopted at a regular meeting of the Planning commission of the
City of Arcadia held on the 27th day of June, 1978, by the'

SPECI~L INFORMATION
Approximately 42.795 square feet including the
bowling alley, a medical office (2.480 square feet)
and the basement area (2,968 square feet).
Proposed Facility:

The applicants propose to convert an existing vacant banquet
room at 1020 South Baldwin Avenue into a "membership" night club.
In the application submitted to the Planning Department. the
applicants give the following explanation of membership:
"Radio City will be run on a strict membership basis.
Memberships will be offered first to Arcadia residents
on a first come first serve basis at a fee of $2.00.
There will be two types of memberships: 1) under
sixteen years of age 2) sixteen years of age and over.
Radio City will keep a log of each members name and
address. This log will be numbered to correspond
to a number on the membership card. Each member
will be allowed one guest per evening.
liAs it is impossible to predict the number of members
in attendance on a given evening. we are unable to
determine the exact number of memberships to be
issued at this time .'1
The main entrance to the facility would be from the southwest cor-
ner of the building with an exit/entrance leading to the coffee
shop located inside the bowling alley.
The proposed night club would have an elevated 435-square foot
stage and a dance floor containing approximately 840 square feet.
Chairs and tables would accommodate approximately 75 patrons.
The night club would also include a dressing room. Patrons of
the proposed night club would use the existing bowling alley
restrooms.

Parkinll:
In 1961 a reciprocal parking agreement was filed with the City
which essentially allows patrons of the bowling alley to park on
the adjacent property (1010 Baldwin Avenue) to the north and
would conversely allow patrons of the offices at 1010 Baldwin
Avenue to park on the bowling alley properties at 1020 South
Baldwin Avenue and 652 Fairview ~venue. The property at 652 Fair-
view Avenue is zoned R-3 but is allowed to be used as a parking
lot by a variance approved on December 29. 1960.

The parking agreement, in effect, forms a parking lot with 130
parking spaces. Code requires all of the existing businesses at
1010 and 1020 Baldwin Avenue to provide a total of 201 parking
spaces, thus creating an overall existing deficiency of 71
parking spaces. The proposed night club is required by Code to
provide 15 additional parking spaces; therefore, 216 spaces
would be the total number of spaces required resulting in a
total deficiency of 86 parking spaces.
Noise:
Noise level readings were taken at the surrounding property
lines and inside and adjacent to the bowling alley (see Sound
Level Readings Map) while the applicants played stereo music
at decible levels well above any anticipated listening volumes
(120 db's).
The music was audible in the coffee shop but elsewhere in the
bowling alley, the music was not noticeable due to the noises
associated with bowling activities.

MISCELLANEOUS INFORMATION
Proposed Operating Hours:
Wednesday, Thursday and Sunday -- 8:00 p.m. to 12:00 a.m.
Friday and Saturday -- 6:00 p.m. to 2:00 a.m.
Maximum Occupancy: 197 Persons including employees
Employees:
The three applicants intend to be the operators of
the night club.
PARKING SURVEY
.
A seven-day parking survey was conducted by Planning staff in
order to ascertain the number of cars using the parking areas
within the vicinity of the subject site between the hours of
4:00 p.m. and 12:00 a.m. Eleven parking areas were selected on
the basis of their proximity to the subject site (including
on-site parking) as outlined on the "Parking Area Map."
During the entire parking survey not one of the aforementioned
areas was fully utilized. The parking areas that would be used
most by patrons of the proposed facility are Areas 2, 3, 4,
5 and 10. These parking areas are most frequently used every
night between the hours of 7:00 p.m. and 9:00 p.m.
It was noted during the survey that individuals would congre-
gate and loiter in various parking lots within the survey area.

IMPACTS ON SURROUNDING PROPERTIES
The subject site is bordered on the north, south and west by
various commercial uses and to the east is a 44-unit apartment
complex. The surrounding businesses are open during the day when
the proposed facility would be closed. Since the business
hours for the proposal and the surrounding businesses do not
overlap, there would be no direct impact on the surrounding
businesses. Occupants of the apartment complex are currently
exposed to the noise and congestion from the bowling alley.
The proposal would create an increased demand for parking that
could be mitigated by surrounding parking areas which are not
used during the hours of operation of the proposed facility.
Increased noise both on-street and off-street is anticipated
due to additional vehicular and pedestrian traffic which would
be generated by the proposal.
PROPOSED PARKING DISTRICT
.
The City Council is presently considering the feasibility of
forming a parking district on Fairview Avenue adjacent to and
westerly of 645 Fairview Avenue. The bowling alley is not
included in the proposed parking district boundary and would not
pay into the special assessment district since there would be
no significant benefit for the bowling alley due to its distance
from the proposed parking area.
ANALYSIS
At the present time there is no faci!i~~ ~ithin the City that can
be considered similar to the proPQ~~e~~~~i1ity. Some parallels
can be ~rawn between the pr?pos~q~~~g?t~~!ub and th~ Marquee
West WhlCh was located on Flrst Avenu~~The followlng are some
potential areas of concern which should be considered:
1. Debris (off-street and on-street)
2. Irresponsible behavior
3. Noise
4. Pedestrian and automobile congestion
5. Illegal activities (vandalism, minors consuming alcoholic
beve rages, etc.)
.
The major problems seem to have occurred outside the entertain-
ment facility and an effort should be directed to eliminate
these outside disturbances. The fact that the proposal is a
"membership" night club would tend to mitigate some of the
problems associated with a diversity of patrons. The applicants'
description of "membership" is somewhat open-ended and should be
revised to limit membership to Arcadia residents or students

enrolled in Arcadia schools. Each member could be allowed to
bring one guest per evening.
The size and occupancy of the proposed facility would limit
the number of patrons in attendance on any given night but may
not reduce the number of bystanders or persons attempting to
patronize the facility. Serious consideration should be given
to the overflow of persons attempting to attend the proposed
night club. These persons would probably congregate within the
bowling alley, parking areas and on public streets.
All activities inside and outside the proposed night club should
be controlled to the satisfaction of the Chief of Police. This
may require the applicants to hire security officers or off-duty
police officers in order to ensure security control.

The parking survey indicates that the peak demand for parking
surrounding the bowling alley essentially occurs every night
between the hours of 7:00 p.m. and 9:00 p.m. A slight decrease
in the total number of parked cars occurs on Friday, Saturday
and Sunday nights.
The parking survey revealed that even though a parking deficiency
presently exists, the bowling alley parking lot never reached
maximum capacity.
The proposed night club could have a maximum of 197 persons in
attendance at anyone time which would generate about 100 cars
using a conservative estimate of two persons per car. (Code
requires 15 spaces.) Since the bowling alley parking area
presently reaches a maximum of 80% utilization, it would leave
approximately 40 parking spaces for patrons of the proposed
night club creating a deficiency of 60 parking spaces.
The applicants should provide written permission from adjacent
business properties for 60 parking spaces. These spaces should
be obtained from businesses in Areas 3, 7 or 8 as indicated on
the Parking Area Map.

Pursuant to the provisions of the California Environmental
Quality Act, the Planning Department has prepared an initial
study for the proposed project. Said initial study did not
disclose any substantial or potentially substantial adverse
change in any of the physical conditions within the area
affected by the project including land, air, water, minerals,
flora, fauna, ambient noise, and objects of historical or
aesthetic significance. Therefore, a Negative Declaration has
been prepared for this project.

Before the Planning Commission takes action on this project,
the Commission should "move to approve and file the Negative
Declaration and find that the project will not have a significant
effect on the environment."
RECOMMENDATION
.
The proposed facility would fill a void in the types of
activities available to residents within the community and with
careful supervision could exist without creating undue hardship
on the surrounding business and residential environments.
However, the attached memo from the Chief of Police sets forth
several concerns which warrant the Commission's careful
consideration. The social and community benefits provided by
the proposed use must be weighed against the potential for
adverse neighborhood impacts similar to those resultant from
the Marquee West.
If the Planning Commission determines that this use should be
approved, the Planning Department recommends the following
conditions of approval. Hopefully, these conditions will mitigate
the problems which may be resultant from the proposed use and
provide the City with sufficient controls to cause the use to
be terminated should the aforementioned controls be found to be
inadequate.

Applicant: Radio City, formerly
known as Marquee West
~ne Police Department has reviewed the C. U. P. application and
physically inspected the site to be utilized for discotheque
dancing and entertainment.
In my view, the permit should be denied for the following
reasons:
(a) The basement facility is too small to'accommodate the
anticipated patronage, approximately 200 persons
.
(b) There are only two entrances;
(1) through the Coffee Shop, which currently closes
at 11 p.m. and (2) via a stairwell off Baldwin
Avenue at the southeast corner of the building
(c) Due to the remoteness o~ the dancing facility, police
supervision of the activity would be difficult.
(d)
In the event of a medical emergency, fire or a major
disturbance, effective handling by Police, Fire and
paramedical personnel would be severely hampered.
(e)
Past experience indicates that such an enterprise would
likely draw an attendance of 350-400 patrons on weekends.
The allowable capacity of the proposed facility would be
approximately 200 people. The overflow of up to 200
would predictably loiter on the sidewalks, the parking
lot and in the bowling lanes, posing an additional policing
problem.

(f) The availability and accessibility to discotheque p~trons
of alcoholic beverages on the premises.
(g) The lack of sufficient off-street parking accommodations
for patrons of the bowling lanes and discotheque combined.
In conclusion, I feel that in view of the above enumerated
considerations, the site is not appropriate for its intended use.
I recommend denial of a Conditional Use Permit.

General Information
Radio City will be a youth oriented discotheque open five nights a week
offering disco dancing with occasional live band entertainment,
Radio Cityw1ll be a membership only club open Wednesday through Sunday
evening with the following types of events intendedl

Memberships

Reasons for the membership format are as follows I

2) Through its memberShip Radio City will set up rules, giving us more

The nUlllber of memberships sold by Radlo City will be 1500, This will
allow us 700 from Arcadia H~ School, 200 from each of the three Junior
High schools, and 200 from private schools.
Should the demand be too great for tickets on any given night we will
have a system of all presale or reservations for seating through our
mailing l1st,
The regular admission price to members of Radio City lf111 be $2,00 or $J.OO,
We will discour~e the participati(:ln of non members by charging a large
admission fee of $5.00, An application form for membership will be
given out at this time to be returned by mail with the regular application
fee,
Enclosed in package is a membership application and membership card,
Security
Radio City plans to hire Contemporary Security Agency to control all
problems outside our facility,

Enclosed in package is a letter from Jim Lyons of the Agency fully
explaining security procedures.
Noise
On lIednesday May 17, deoibel readings were taken by Jeff ii1tte of the
planning department. For the check, the noise of a loud rock band lfaB
simulated by playing a tape through a 1200 watt sound reinforcement
system, The complete results with all figures can be obtained from the
planning department. The noise level in the areas we were most interested
in was as follows I
.
1) In tile _in disco rGOIII the sound level with the music louder than
will be normal for Radio City was only 95 decibels. This is sub-
stantially less than the 116 decibels that was aver~e for a band
at the Marquee West.
2) Directly upstairs in the coffee shop area the volume could be compared
to a normal transistor radio, it was audible but not loud. We were
told this sound would not be a hinderance to the coffee shop as
they had been playing a juke box. This would be far louder than
the spillover noise from downstairs,
J) Outside on Baldw11l Ave. readings were taken directly in front of
the entrance with the door ~ as it will be during our business
hours. The decibel meter was registering but Jeff admitted that
most of the noise was from the w'ind and passing traffic rather
than from the music.

RestroolllS
At the present time the downstairs banquet room does not have suitable
restroom facilities. We are in agreement with owner Walter King
that downstairs restrooms w111 be necessary for our business to run
properly, llIe w111 begin construction of the downstairs restrooms as
soon as our application is approved.
Parking
The bowling alley property does include 130 on site parking spaces. This
parking area is directly beh1Dd the bu11ding and includes the entire
strip between Arcadia Ave. and Fa1rvlew Ave.
llIe have met with Susan Poulsen in regard to the J4 spaces located
behind the Formal N18ht Tuxedo shop. Mrs. Poulsen has given us verbal
permission to use these spaces but cannot give us written permission
as she is only one of several trustees who own the property.
llIe have met w1th R.M. Moore, ma.nager of United California Bank located
directly across the street :from the bowling alley. Enclosed is a
letter from Mr. Moore allowing us the use of the bank's 36 parking
spaces.

We have also met with John Parker, ma.nager of the West Arcadia Medical
Clinic. Mr. Parker said there would be no problem in our using their
80 parking spaces but he would first have to check with the doctors
before giving us written permission. We w111 be checking with him on
MOnday June 12, hopefully we will have this permission by the time

Subject: Radio City Security Procedures
On June 7th I meet with John Pierson and Rick Brandley
at the Bowling Square to discuss security and crowd control for
the proposed Radio City club. I followed up that meeting by
making a second visit to the proposed site of the Radio City
club and the surrounding area. I made this second visit during
the busy evening hours of the Bowling Square. The following
recommendations are based an my evaluation of the security and
crowd control needed for the proposed operation of the Radio '
City club.
Parking
Based on my evaluation of the parking area behind the
Bowling Square, I feel it will be necessary to have 2 security
persons on a regular basis to patrol the lot. The functions
of these 2 security people will be to watch the cars and to keep
minors from loitering in the parking lot.
Opening weekend
Because of the expected large turnout on the nights
of the opening weekend, four security persons will be necessary
to patrol the rear parking lot, and 2 security people will be
needed in front of the club to organize any lines and to turn
away non-members.

Special occations
On special occations, such as the scheduling of a live
dance band, additional security will be needed to handle an
anticipated large turnout. The amount of security necessary will
be similar to the amount needed on the nights of the opening week-
end. The reservation system proposed by the management of the
Radio City club should eliminate any problems of too many people
showing up.

6a. DIRECT EFFECT.
During operating hours, amplified noise will substantially
increase throughout the interior of the building. The
building walls will reduce the sound 'emanating from the
building. The sound level must meet the noise requirements
as set forth in Code Section 4610.3 of the Arcadia Municipal
Code.
INDIRECT EFFECT.
Vehicular traffic and irresponsible behavior of individuals
attracted by the proposal may result in an increase in
existing neighborhood noise levels. The probability of
increased neighborhood noise levels may be mitigated by
the fact that the facility will be available only to a
limited number of members.
6b. Patrons of the entertainment facility will be exposed to
significant noise levels, but not in excess of noise levels
produced by similar facilities within Los Angeles County.
l3a. During operating hours a substantial increase in vehicular
movement could be expected. The Department of Public Works
did not indicate that any street improvements would be
necessary due to an increase in vehicular movement.
l3b. The maximum legal capacity for the proposed night club is
approximately ZOO persons. On-site parking (105 spaces)
may not be sufficient to accommodate the automobiles antici-
pated to be generated by the proposed use and the existing
bowling alley. The applicant could possibly utilize
additional parking areas located adjacent to the subject site
(approximately 60 spaces).
l4a. Routine Fire Department inspections may be required to
enforce occupant loads.
l4b. Additional police patrol and surveillance may be required
for the proposed project.
