RESOLUTION NO. 1051
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ARCADIA RECOMMENDING
APPROVAL OF AN AMENDMENT TO CHAPTER 17,
SECTION 1704 OF THE UNIFORM BUILDING
CODE, 1973 EDITION, PERTAINING TO ROOF
COVERINGS IN FIRE ZONE 4, ZONE R-M AND
ALL PROPERTY NORTH OF ELKINS AVENUE.
WHEREAS, a public hearing was held on June 13, 1978
before the Planning Commission to consider amending the Uniform
Building Code 1973 Edition Roofing Materials in Fire Zone 4, Zone
R-M and all property north of Elkins Avenue; and
WHEREAS, all interested persons were given full opportunity
to be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA RECOMMENDS TO THE CITY COUNCIL:
SECTION 1. That Section 8130.38 be added to the
Arcadia Municipal Code to read as follows:
"8130.38. AMENDMENT. Section 1704 of Chapter 17 of
the Uniform Building Code, 1973 Edition is hereby amended by adding
a section to read as follows:
EXCEPTION: In Fire Zone 4, Zone R-M and all property
north of Elkins Avenue, new or replacement roofs on every building
or structure shall be noncombustible roof covering as specified
in Section 3203(e) of the Uniform Building Code, 1973 Edition,
excluding item No. 11 (treated and untreated wood shakes or
shingles) ."
SECTION 2. The Planning Commission finds that the proposed
amendment is necessary as there exists problems between the

interface of a fire hazardous environment and urban development
in the northern portions of Arcadia which have a varied topographical
relief and a semi-arid local fire hazard conditions requiring a
noncombustible roof covering in the hillside areas and necessitating
an amendment to Section 1704, Chapter 17 of the Uniform Building
Code by Arcadia Municipal Code Section 8130.38; and that the public
necessity convenience, and general welfare justify said text
amendment.
SECTION 3. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia.

NONCOMBUSTIBLE BUILDING MATERIALS IN THE
HILLSIDE AREA
PROPOSAL
An amendment to Article VIII, Chapter I, Part 3 of the Arcadia
Municipal Code amending Section 1704, Chapter 17 of the Uniform
Building Code, 1973 Edition, pertaining to building materials.

The attached report, Planning Commission resolution, City Council
resolution and proposed ordinance will be reviewed at tonight's
meeting and recommendations from both the ad hoc Hillside Building
Materials Study Committee and staff will be examined. The
purpose of this text amendment is NOT to change or in any way
alter any established fire zones.
BACKGROUND
The Planning Commission's ad hoc Hillside Building Materials
Study Committee was formed to identify areas of the City where
there exists a greater potential of fire hazard and where more
stringent controls on building materials should be placed.
This study resulted in the proposed amendment to the Uniform
Building Code which would regulate the type of roof materials
allowed in the hillside area.
RECOMMENDATIONS FROM THE AD HOC BUILDING MATERIALS STUDY COMMITTEE
The Committee makes the fOllowing recommendations:
1. That the subject area be defined as the northeast portions
of Arcadia which are either in the R-M zoned or in Fire
Zone 4 and all properties north of Elkins Avenue and south
of Carolwood Drive. See Map No.1.

2. That new or replacement roofs for structures located with-
in the aforementioned area be noncombustible as specified
in Section 3203(e) of the Uniform Building Code, excluding
items No.5 (asphalt shingles), No.8 (metal roofs), and
No. 11 (treated or untreated wood shakes or shingles).

RECOMMENDATIONS FROM PLANNING DEPARTMENT STAFF
Staff feels that the last part of the aforementioned recommendation
which excludes certain types of noncombustible materials such
as metal roofs, and asphalt shingles may be best controlled
by the existing homeowners' association rather than specifying
this in the ordinance.
In portions of the R-M zone where no homeowners' association
exists, the Planning Commission could specify requirements for
roof materials when an R-M Development Permit is issued.
Reasons for staff1s recommendations are that as new noncombustible
roof materials become available to the public, the Arcadia
Municipal Code would have to be continuously updated to allow
or exclude new types of roof material. This process would be
complicated, time-consuming and would not be as flexible as
allowing the homeowners' association review powers in this area.
RECOMMENDATION
If the Commission wishes to implement the recommendation of the
ad hoc Committee, Section 8130.38 (amending Uniform Building
Code, Chapter 17, Section 1704) should be added to the Arcadia
Municipal Code to read as follows:

If the Planning Commission approves the aforementioned change
a resolution will be sent to City Council setting forth the
Commission's reasons for the change. Attached to the Planning
Commission's resolution are the resolution and ordinance needed
to implement the Planning Commission's decision. Should the
Planning Commission elect to let the decisions regarding metal
and asphalt roofs rest with the homeowners' association, the
Planning Commission should direct staff to change the Commission's
resolution, Council resolution and ordinance to permit the
homeowners' association to review these materials.

Pursuant to the provisions of the California Environmental
Quality Act, the Planning Department has prepared an initial
study for the proposed project. Said initial study did not
disclose any substantial or potentially substantial adverse
change in any of the physical conditions within the area

affected by the project including land, air, water, minerals,
flora, fauna, ambient noise, and objects of historical or
aesthetic significance. Therefore, a Negative Declaration has
been prepared for this project.
Before the Planning Commission takes action on this project,
the commission should "move to approve and file the Negative
Declaration and find that the project will not have a significant
effect on the environment."
