RESOLUTION NO. 1050
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ARCADIA GRANTING A CONDITIONAL
USE PERMIT FOR AN EXISTING NURSERY AT 145-
159 EAST LIVE OAK.
WHEREAS, on April 13, 1978, an application was filed by
Hardings Gardenland, for an existing nursery and proposed offices,
Planning Department Case No. C.U.P. 78-8, on the property commonly
known as 145-159 East Live Oak Avenue, more particularly described
as follows:
Portion of Lot 5, Tract 13670 in the City of Arcadia,
County of Los Angeles in Map Book 245, page 47 and 48,
in the office the Recorder of said County.
WHEREAS, a public hearing was held on May 9, 1978 at
which time all interested persons were given full opportunity to
be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY
OF ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Plan-
ning Department in the attached report is true and correct.
1. The granting of conditional use permit as hereinafter
provided will not be detrimental to the public health or welfare or
injurious to the property or improvements in such zone or vicinity.
2. The use applied for at the location indicated is
properly one for Which a conditional use permit is authorized.
3. The site for the proposed use is adequate in size
and shape to accommodate said use including all yards, parking,
loading, landscaping and other features required to adjust said
use with the land and uses in the neighborhood.

4. The site abuts streets andhighways adequate in width
and pavement type to carry the kind of traffic generated by the
proposed use.
5. The granting of such conditional use permit will not
adversely affect the General Plan.
6. The use applied for will not have a substantial
adverse impact on the environment.
SECTION 3. That for the foregoing reasons, subject to
approval of the City Council this Commission grants a conditional
use permit for an existing nursery and proposed offices upon the
following conditions:
1. The property shall be improved and maintained in
accordance with the plans on file in the subject Case No. C.U.P. 78-8
~ and applicable regulations of the Arcadia Municipal Code.

2. That landscape buffers shall comply with code.
3. That the 5 foot wide landscape buffers along the north-
erly property line of 145 and 159 East Live Oak shall be maintained
and kept free of debris and miscellaneous material.
4. That all material other than plants shall be screened
from public view (i.e., cans, wood items, flats, etc.).
5. All mechanical equipment on the building shall be
screened from view.
6. A grading and drainage plan shall be submitted for
the approval of the Director of Public Works.
7. All parking shall comply with code, except that a
modification shall be granted for 24 parking spaces in lieu of
25 spaces required.

SECTION 4. The Secretary shall certify to the adoption
of this resolution.
I HEREBY CERTIFY that the foregoing resolution was
adopted at a regular meeting of the Planning Commission of the City
of Arcadia on the 9th day of May, 1978, by the following vote:

The subject site contains two lots with
separate ownerships that are developed with a
plant nursery. The property is zoned C-2.
The two lots contain a combined area of 32,910
square feet.
145 East Live Oak contains 19,434 square,feet
(including the property north of the alley).
159 East Live Oak contains approximately
13,476 square feet (excluding the property north
of the alley).
183.88 feet on Live Oak Avenue (100 feet at
145 East Live Oak and 83.88 feet at 159 East
Live Oak).

The applicant's plot plan does not include the property at
159 East Live Oak. This property is under separate ownership
and is rented by the applicant. This property is utilized as
an outdoor nursery display.
BUILDING SIZE:

Existing Nursery: contains approximately 2,850 square feet and
was constructed in 1960.
Proposed Offices: 2,364 square feet.
The proposed offices will be located on the lot at 145 East
Live Oak which contains the existing nursery building.
The offices will be one-story slump stone with Spanish tile
roof. The roof will connect the proposed buildings with the
existing building.
The existing building sets back approximately 30 feet from the
front property line. The easterly proposed building will be set
back 2 feet to 7 feet from the front property line and the
westerly building will be set back 2 feet to 8~ feet from the
front property line. This setback area will be landscaped.
SIGNING:

There are two existing signs; one 90 square foot sign on the
front of the building and a 202 square foot free-standing sign
located in front of the building.
The wall sign will be permanently removed. According to the
applicant, he is proposing to remove or relocate the free-standing
sign.

Code allows a maximum signing area of 200 square feet based on
the frontage of both lots (145 and 159 East Live Oak).
PARKING AND LANDSCAPING:
Existing Parkin, and Landscapin~: Parking presently exists north
of the alley. here are no mar ed parking stalls. There is a
5-foot wide landscape bufTer and 6-foot high block wall
located between this parking area and the residential property
to the north. Wood wheel stops are located along this parking
area; Code requires concrete wheel stops.'

offices. Twenty- four parking spaces are, proposed, 19 of these
spaces are located' along the alley and do not comply with Code.
Five spaces and one loading space are located inside the nursery
area south of the alley.
There are 11 parking spaces located north of the alley and 8
spaces proposed on the south side of the alley. The proposed
90-degree parking spaces require a 24-foot 9-inch back-up area;
the alley is being used as the hack-up orca and is only 20 feet
wide. In order to comply with the required back-up area, the
existing 5-foot chain link fence located at the rear of the
nursery would have to be relocated 5 feet to the south.
There is an area north of the alley behind 159 E. Live Oak (not
shown on plan) which could accommodate approximately 9 parking
spaces.
The only access to the parking area is from the existing alley.
The landscape buffer behind 159 and 145 E. Live Oak should be
cleaned of all weeds and debris. Presently wood flats, concrete
and miscellaneous material is being stored in this planting
buffer.
MISCELLANEOUS INFORMATION
.
The proposed offices will be used for Hardings Nursery as well
as rental office space. Approximately 4,234 square feet of
outdoor nursery area will be eliminated by the construction of
the offices and the new parking area.
The northeast portion of the nursery contains empty cans,
rolled chain link fencing, a tractor and other miscellaneous
items adjacent to the alley. '
A trash enclosure is proposed along the northerly property line
in front of parking stall No.1.

ANALYSIS
The nursery isa permitted use with an approved conditional
use permit in a C-2 zone. Offices are also permitted in a C-2
zone. The nursery is presently a nonconforming use. It was
constructed prior to the requirement for a conditional use permit.
The property at 159 E. Live Oak, although under separate owner-
ship, should be included as part of this conditional use permit
in order to make it a conforming use.
Staff would recommend that all conditions of approval apply to ,
both 145 and 159 E. Live Oak.
All parking should comply with Code. Compliance can be obtained
by relocating the chain link fence 5 feet to the south or by
utilizing the property at 159 E. Live Oak.

Pursuant to the provisions of the California Environmental
Quality Act, the Planning Department has prepaied an initial
study for the proposed project. Said initial study did not
disclose any substantial or potentially substantial adverse
change in any of the physical cOllcli !ions \d thi II the area
affected by the project including land, air, water, minerals,
flora, fauna, ambient noise, and objects of historical or
aesthetic significance. Therefore, a Negative Declaration has
been prepared for this project.
Before the Planning Commission takes action on this project, the'
Commission should "move to approve and file the Negative
Declaration and find that the project will not have a significant
effect on the environment."
RECOMNENDA T ION
The Planning Department recommends approval of C.U.P. 78-8
subject to the following conditions:
1. Conditions outlined in the attached report from the'
Department of Public Works shall be complied with to the
satisfaction of , the Director of Public Works.

2. That all parking and lands cape buffers shall comply wi th Code.
3. That the 5-foot wide landscape buffer along the northerly
property line (of 145 and 159 E. Live Oak) shall be main-
tained and k~pt free of debris and miscellaneous material.
4. That all materials other than plants shall be screened
from public view (Le., cans, wood items, flats, etc.)
