HomeMy WebLinkAbout1047 - r "i . . . --., RESOLUTION NO. 1047 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT FOR A RESTAURANT AT 249-249~ EAST FOOTHILL BOULEVARD. WHEREAS, on March 15, 1978, an application was filed by Kenichi Noda, for expansion of an existing restaurant, Planning Department Case No. C.U.P. 78-6, on the property commonly known as 249-249~ East Foothill Boulevard, more particularly described as follows: Lot 5 of Tract 12834, in the City of Arcadia, County of Los Angeles, as per map recorded in Book 262, page 24, in the office of the Recorder of said County. WHEREAS, a public hearing was held on April 11, 1978, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Planning Department in the attached report is true and correct. SECTION 2. This Commission finds that: 1. The granting of conditional use permit as hereinafter provided will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2. The use applied for at the location indicated is properly one for which a conditional use permit is authorized. 3. The site for the proposed use is adequate in size and shape to accommodate said use including all yards, parking, -1- 1047 loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the General Plan. 6. The use applied for will not have a substantial adverse impact on the environment. SECTION 3. That for the foregoing reasons, subject to approval of the City Council, this Commission grants a conditional use permit to expand an existing restaurant upon the following conditions: ~ 1. The property shall be improved and maintained in accordance with the plans which are on file in the subject Case No. C.U.P. 78-6 and applicable regulations of the Arcadia Municipal Code. . , 2. That a trash enclosure be provided to the satisfaction of the Planning Department. 3. That a modification be granted for 17 parking spaces in lieu of 38 required. 4. That the parking area be cleaned of all weeds and debris. SECTION 4. REQUESTED: SPECIAL INFORMATION Building: Building Area: 5,100 square feet Floor Area for proposed restaurant: 2,400 square feet The applicant is proposing to expand the restaurant into the existing eating establishment (Pit BBQ) , thus eliminating the eating establishment which was approved on April 19, 1977 (C.U.P. 77-6). The seating capacity will be for approximately 80 persons. Parking, Landscaping and Buffers: Thirty-eight parking spaces are required for all of the uses; 24 for the restaurant and 12 for the other uses. (Fifty-one parking spaces are required for the existing uses.) Seventeen ~ parking spaces exist. There is no landscaping in the interior of the parking lot. There is a 4-foot high chain link fence separating the parking area from the residential use to the north. Miscellaneous Information: The mechanical equipment on the roof can be seen from the rear of the adjoining properties. Driving east or west on Foothill Blvd., the equipment is slightly noticeable. There are four trash bins on the site. The existing trash enclosure can accommodate only one trash bin. There are some weeds and debris in the parking area. The proposed hours of operation are 11:30 a.m. to 10:00 p.m. ANALYSIS A restaurant is a permitted use in a C-2 zone with an approved conditional use permit. . It is staff's opinion that the expansion of the restaurant would not create a significant increase in traffic. The possible problem of additional traffic generated by this use would be mitigated by the proposed hours of operation (6 p.m. to 10 p.m.). ~ C.U.P. 78-6 3 Code requires a 6-foot high block wall and as-foot 3-inch landscape buffer between the commercial uses and the residentially zoned portion of the property. There is landscaping along the 4-foot high chain link fence which acts as a partial buffer between the parking area and the dwellings. Therefore, it is staff's opinion that the 6-foot wall should not be required. Code also requires that 3% of the interior parking area be landscaped. There is no space in the parking lot to provide for this landscaping. Staff would recommend that the trash enclosure be expanded to accommodate all of the trash bins. . Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not dis- close any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic signifi- cance. Therefore, a Negative Declaration has been prepared for this project. Before the Planning Commission takes action on this project, the Commission should "move to approve and file the Negative Declara- tion and find that the project will not have a significant effect on the environment." RECOMMENDATION The Planning Department recommends approval of C.U.P. 78-6 subject to the following conditions: 1. That a trash enclosure be provided to the satisfaction of the Planning Department. 2. That a modification be granted for 17 parking spaces in lieu of 38 required. 3. That the parking area be cleaned of all weeds and debris.
