RESOLUTION NO. 1045

A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ARCADIA RECOMMENDING APPROVAL
OF A TEXT AMENDMENT REGULATING THE PARKING
OF COMMERCIAL VEHICLES IN RESIDENTIAL AREAS.
WHEREAS, public hearings were held on March 14 and 28, 1978
before the Planning Commission to consider adding a section to the
Arcadia Municipal Code regulating the parking of commercial vehicles
in residential areas; and
WHEREAS, all interested persons were given full opportunity
to be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA RECOMMENDS TO THE CITY COUNCIL:
SECTION 1. That Section 9281.3 be added to the Arcadia
~ Municipal Code to read as follows:
"9281.3. No commercial vehicle as defined by the California
Vehicle Code which exceeds three (3) tons in unladen gross weight
shall be parked or left standing between the hours of 12:00 a.m.
midnight and 4:00 a.m. of any day on any part of any property zoned
or used for residential purposes."
SECTION 2. The Planning Commission finds that the proposed
text amendment will discourage large commercial vehicles from
parking in residential areas, and that the public necessity, con-
venience, general welfare and good zoning practice justify the
above recommendation.
SECTION 3. The Secretary shall certify to the adoption

of this resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia.

The Planning Commission at its March 14, 1978 meeting continued
~ Text Amendment 78-3 for further study.
Questions that were introduced at the meeting are answered in
the cover letter and the wording of T.A. 78-3 has been clarified
in order to eliminate any possible ambiguities.
According to the Department of Motor Vehicles, a tractor truck
can only be issued commercial license plates due to the
weight of the vehicle. DMV has informed staff that they will
not commercially license a recreational vehicle since all
recreational vehicles are considered "house cars" and are only
issued passenger license plates. Therefore, recreational
vehicles are exempt from the recommended text amendment.
The attached text amendment should achieve the desired objective
without creating any undue hardship on the owners 'of recreational
vehicles. The-Planning Department recommends approval of
T.A. 78-3.

GENERAL INFORMATION
APPLICANT:

Text amendment adding a section to the Arcadia
~lunicipal Code regulating the parking of
commercial vehicles on any "R" zoned property
PROPOSAL:
BACKGROUND
The City Council directed staff to investigate and propose
legislation which would restrict the parking of large commer-
ciaf vehicles in residential areas.
The following report sets forth a proposed addition to the
Arcadia Municipal Code which would achieve the aforementioned
objective.
ANALYSIS
Presently the Uniform Traffic Ordinance has no specific sections
which address the parking of large commercial vehicles in
residential areas.
Article XIII of the Uniform Traffic Ordinance prohibits the
operator of any vehicle exceeding a maximum gross weight limit
of three tons from using streets not designated by resolution
as truck routes for any purpose other than making pickups or
deliveries of goods, war$ and merchandise.

There are no restrictions in the Uniform Traffic Ordinance which
would regulate commercial vehicles exceeding the three-ton
weight limit from parking on private property in residential
areas.
The continued parking of a large commercial vehicle on any "R"
zoned property may have the following negative effects:
1. Encourage commercial businesses within residential zones.
2. Result in the reduction of property values due to negative
aesthetic effects.
3. Create noise problems which are associated with the use and
maintenance of such vehicles.
The proposed text amendment would not prohibit recreational
vehicles or pick-up trucks with campers from parking in residential
areas.
Pursuant to the prOV1S1ons of the California Environmental
Quality Act, the Planning Department has prepared an initial
study for the proposed project. Said initial study did not
disclose any substantial or potentially substantial adverse
change in any of the physical conditions within the area affected
by the project including land, air, water, minerals, flora,
fauna, ambient noise, and objects of historical or aesthetic
significance. Therefore, a Negative Declaration has been pre-
pared for this project.
Before the Planning Commission and City Council take action on
this project, the Commission and Council should "move to approve
and file the Negative Declaration and find that the project
will not have a significant effect on the environment."
RECOMMENDATION
The Planning Department recommends that the following section be
added to Article IX, Chapter 2, Part 8, Division 1 of the
Arcadia Municipal Code:
"9281.3. No commercial vehicle a5 defined by the California
Vehicle Code which exceeds three (31 tons in unladen gross
weight shall be parked or left standing between the hours of
12:00 a.m. midnight .nd 4:00 a.m. of any day on any part of any
property zoned or used for residential purposes.
