RESOLUTION NO. 1043
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ARCADIA REVOKING CONDITIONAL
USE PERMIT FOR AN ENTERTAINMENT FACILITY AT
30 SOUTH FIRST AVENUE.
WHEREAS, on October 10, 1977, an application was filed
by Paul Fry to operate an entertainment facility, planning Depart-
ment Case No. 77-26, on property commonly known as 30 South First
Avenue, more particularly described as follows:
Lots 1, 2, 3 and 4, part of Santa Anita Tract
in the City of Arcadia, County of Los Anaeles,
as per Map Book 15, page 89 & 90, in the office
of the Recorder of said County.
WHEREAS, on March 28, 1978, a public hearing was held
on said matter at which time all interested persons were given
~ full opportunity to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the
Planning Department in the attached staff report is true and
correct.
SECTION 2. The Planning Commission finds that the use
is too intensive for the site; that the number of patrons attracted
by the facility and their activities constitute an annoynace and a
public nuisance to the surrounding neighborhood; and that the
use is detrimental to the public health and welfare and injurious
to the property or improvements in such vicinity.

SECTION 3. Conditional Use Permit 77-26 is hereby
revoked.
SECTION 4. The Secretary shall certify to the adoption
of this resolution.
I HEREBY CERTIFY that the foregoing resolution was
adopted ata regular meeting of the Planning Commission of the
City of Arcadia on the 28th day of March, 1978, by the following

On January 17, 1978, the Arcadia City Council directed the Planning
Commission to hold a public hearing for reconsideration of the condi-
tional use permit to operate an entertainment facility at 30 South
First Avenue.
Public hearing notices for this meeting have been sent to property
owners within 300 feet and to other property owners within the area
outlined in Map Number 1. Notice was also published in the March 26,
1978 edition of the Arcadia Tribune.
The applicant (Mr. Paul Fry) and the operators of the entertainment
facility have been requested to be in attendance at this meeting.
On November 22, 1977, the Planning Commission adopted Resolution 1019
9ranting the conditional use permit, subject to eleven conditions of
approva 1.
The Marquee West presently (March 28, 1978) complies with all conditions
imposed by Resolution 1019 with the following exceptions: ---
1. Complete taping the seams of new drywall.
2. Reinstall the third lavatory in the men's restroom.
Forty-two of the required additional 52 parking spaces were obtained from
Home Savings and Loan Association and are located adjacent to the Marquee
West parking area. The remaining 10 spaces were obtained from the
Huntington Health Club. Staff has encouraged the Marquee West personnel
to attempt to secure 10 parking spaces which would be more convenient
than those at the Huntington Health Club.

The Planning Department has requested reports (attached) from Police,
Fire, Public Works and Building and Safety regarding the condition of
the facility and its impact on the area.
All the violations outlined in the attached report from the Fire Depart-
ment have been corrected.
Regretably some of the external problems which have resulted (i .e.,
increased traffic and irresponsible behavior) have proven to be more
substantial than anticipated, causing a greater impac on the adjoining
area.
RECOMMENDATION
If the Planning Commission determines that there is cause to revoke
C.U.P. 77-26, the Commission should adopt Resolution 1043.

This Department hae no additional requirements for C.U.P. 77-26.
The streets adjacent to subject property have been fully improved to
their Master Plan width, snd no further street widening is anticipated.
Street maintenance operations have not increased due to present use of
this facility.

At 1600 hra. on March'3, 1978, a fire inspection was conducted
of the building at 30 S. First Avenue. A number of fire code
violations were noted.
.
(1) The occupant load of this building is limited by the number
and width of exits provided. An additional exit door was
required prior to the opening of Marquee West. This exit
door has been removed and a non-conforming metal sliding
door is being used in its place;
(2) Two hose lines have been allowed to get wet and the hoses
have mildewed and need to be replaced.
(3) The upata1rs area is to be used only as a women ',s' restroom,
with all other areas closed off to the public. A metal grate
haa been removed and one of' the rooms' is now accessible to
the pub lic.
(4) In the resr area of the building, there is a drop down ladder.

Two aeparate inspections were conducted on the night of March
3, 1978, and on 'both occaaions 1 hod to inform the people at
tho door, Chat the exit with' the metal sllding door must remain
open. In addition, the ladder type stairway was found down
on both occaaione. '
The occupant load was less than 300 people, at that time, and
I felt that the buUding could safely handle that number.

I hove had a difficult time contacting the person responsible,
since Paul Fry is no longer affiliated with the Marquee West.
I have hod a ,phone conversation with Joe Ramsey and have
contacted Rick Ilrand ley and I have been assured that all items
will be corrected and that their biggest problem was lack of
funds.
It is my recommendation that prior to extending the conditional
use permit', that all .items are permanently and properly corrected
to fully comply with the fire code.

Recommendation for revocation of C. U. P. - Marquee West
The Police Department has been monitoring the activities of this business
since its opening Friday, December 16, 1977. The problems of excessive
noise, drinking, fighting, traffic congestion and other unattractive
and unsocial activities along with serious incidents of mayhem and
bodily injury have continued to fluctuate in degree and intensity
with the varying attendance.

The consistent problem of neighborhood unrest has not diminished.
After reviewing the situation, the Police Department requests the
'C. U. P. for this business at this particular location be revoked.
Attached is an activity item log of police service calls at this
location from its opening December, 1977 through March 18, 1978.
