CONDITIONAL USE PERMIT TO OPERATE AN ENTERTAINMENT FACILITY AT 30 SOUTH FIRST AVENUE. WHEREAS, on October 10.,' 1977, Paul Fry filed an application for an entertainment center, Planning Department Case No. C.U.P. 77-26, on the property commonly known as 30 South First Avenue, more particularly described as follows: Lots 1, 2, 3, & 4, part of Santa Anita Tract in the City of Arcadia, County of Los Angeles, as per Map Book 15, page 89 & 90, in the office of the Recorder of said County. WHEREAS, a public hearing was held on November 8, 1977, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF All.CADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Planning Department in the attached report is true and correct. SECTION 2. This commission finds that: 1. The granting of conditional use permit as hereinafter provided will not'be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2. The use applied for at the location indicated is properly one for which a conditional use permit is authorized. 3. The site for the proposed use is adequate in size and shape to accommodate said use including all yards; parking, -1- 1019 . . . , loading, landscaping and' other features required to adjust said use with the land and uses in the neighborhood. 4. The site abut.s streets and highways adequate in width, and pavement type. to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the General Plan. 6. The use applied' for will not have a substantial adverse impact on the environment. SECTION 3. That for the foregoing reasons, subject to approval of the City Council, this commission grants a conditional use permit for an entertainment center upon the following conditions: 1. The property shall be improved and maintained in accordance with the plans which are on file in the subject Case No. C.U.P. 77-26 and applicable regulations of the Arcadia Municipal Code. 2. A t.rash enclosure shall be provided according to Code requirements. 3. A modifieation shall be granted to allow 33 on-site parking spaces in lieu of 85 required by Code. 4. That written permission for at least 52 parking spaces ,be obtained and that this conditional use permit shall be deemed null and void should the written permission for the additional parking be termin- ated .without provisions being made for an equivalent amount of off-street parking equally as convenient being approved by the Planning Commission. -2- 1019 I, , , . 5. That all landscaping, exterior lighting and parking standards shall meet Code requirements. 6. That hours of operation shall be limited to 7:00 p.m. - 12:00 a.m. Tuesday through Thursday, 7:00 p.m,. - 12:00 a.m. Friday and Saturday, and to 7:00 p.m. - 10:00 p.m. on Sunday. 7. That. this conditional use permit shall become null and void if any transfer is made of the rights of this conditional use permit, by outright transfer, operation of law, forfeiture or any other means whatsoever, unless the applicant herein first applies for and is granted permission to make such transfer by the Planning Commission. Should such permission be requested, the Planning Commission may impose additional conditions of approval as it deems necessary which shall .'. be adhered to by the transferee, or may deny such transfer. 8. That all parking areas to be used by the entertainment facility patrons be patrolled to the satisfaction of the Chief of Police. 9. That parking and landscaping plans be submitted to the Planning Department for review and approval prior to issuance of any building permits. 10. That this conditional use permit shall be reviewed annually by the Planning Commission at which time conditions maybe added or modifiec as deemed necessary. . 11. That restroom facilities meet all Uniform Plumbing Code and handicapped requirements. SECTION 4. . PROPOSED FACILITY: The applicant is praposing to. canvert the existing building at 30 Sauth First Avenue into. an entertainment facility. The entrance to the facility will be framthe north side of the building. The proposed facility ~ill have an elevated 425 square foat stage and a dance floor containing approximately 1,l29 square feet. A band viewing area will provide chairs and tables for approximately 100 patrons. Additional patrons could con- gregate around the dance floor. The building will also include dressing raoms for the perfarmers, restrooms, a game room and a snack bar. RESTROOMS: .,I.' The existing restroom facilities do not meet handicapped stan- dards. The appli,cant has indicated that additional restrooms that meet handi~~pped requirements will be constructed on the ground floor. ,// PARKING: ." i:, Eighty-five rarking spaces would be required for the entertain- ment facility based on the requirements for "Other Permitted Uses" in a /;;'ommercial' zone of 5 spaces per 1,001 square feet of gross floof.' area. A site p~~n submitted by the applicant indicated 33 on-site park~ ing spas~s. The applicant has stated that additional parking could b~obtained fram other parking lots in the general vicinity. MISCEL'.ANEOUS INFORMATION .' /1 The ~ours of operation far ~he proposed entertainment facility will,be from 7:00 p.m. - 12:00 a.m. Tuesday through Thursday, 7:0~',p'.m.- 1:00 a.m. Friday and Saturday, and 7:00 p.m. - lO:'t!O' p.m. on Sunday. C.U.P. 77-26 3 The applicant anticipates that 9 employees excluding performers will be necessary to operate the proposed facility. The applicant intends to apply for a dance permit: The Building and Safety Division has indicated that an additional stairway to the second story loft would be required. ANALYSIS . An entertainment facility is a permitted use in a C-l zone with an approved conditional use permit. The use is also consistent with the General Plan designation of Commercial. No sale of alcoholic beverages is proposed and it is staff's opinion that there should be no age limit imposed. The Planning Department recommends approval of a modification to allow 33 parking spaces in lieu of 85 required by Code. However, the applicant should obtain written permission which wbuld guarantee that at lea~t 52 additional parking spaces located within 400 feet be available to patrons during the hours of operation, The combined use of the on-site parking and the additional parking would tend to mitigate some of the anticipated parking problems. . The trash enclosure as shown on the site plan should be relocated to allow for adequate automobile circulation. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not dis- close any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic signifi- cance. Therefore, a Negative Declaration has been prepared for this project. Before the Planning Commission takes action on this project, the Commission should "move to approve and file the Negative Declara- tion and find that the project will not have a significant effect on the environment." RECOMMENDAT ION . The Planning Department recommends approval of C.U.P. 77-26 subject to the following conditions: 1.
