HomeMy WebLinkAbout1040 . . , -. ~ RESOLUTION NO. 1040 A RESOLUTION OF THE PLANNING COMMISSION OF THE C~TY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT TO EXPAND AN EXISTING REALTY OFFICE ON PROPERTY WHICH ALSO CONTAINS TWO NONCONFORMING SINGLE-FAMILY RESIDENCES AT 205-221 EAST DUARTE ROAD. WHEREAS, on January 31, 1978, Joe E. Earll, Jr. filed an application requesting a conditional use permit to expand an existing realty office on property which also contains two nonconforming single-family residences, Planning Department Case No. C.U.P. 78-2, on the property commonly known as 205-221 East Duarte Road, more particularly described as follows: The southerly 45 feet of Lots 12, 13 and 14, includ- ing the southerly alley, of Block 61~, Arcadia Santa Anita Tract, in the City of Arcadia, County of Los Angeles, as recorded in Book 16, page 58, of Maps, in the office of the Recorder of said County. WHEREAS, a public hearing was held on February 28, 1978, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Plan- ning Department in the attached report is true and correct. SECTION 2. This Commission finds that: 1. The granting of a conditional use permit as hereinafter provided will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2. The use applied for at the location indicated is properly one for which a conditional use permit is authorized. -~ 1040 ". , 3. The site for the proposed use is adequate in size ~ and shape to accommodate said use including all yards, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. The site abuts street and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the General Plan. 6. The use applied for will not have a substantial adverse impact on the environment. SECTION 3. That for the foregoing reasons, subject to approval of the City Council, this Commission grants a conditional ~ use permit to expand an existing realty office on property which also contains two nonconforming single-family residences upon the following conditions: 1. The property shall be improved and maintained in accordance with the plans which are on file in the subject Case No. C.U.P. 78-2 and applicable regulations of the Arcadia Municipal Code. 2. All conditions ofapproval of Lot Split 77-8 shall be complied with. 3. A grading and drainage plan shall be submitted to the Director of Public Works for approval. 4. The Final Parcel Map shall be approved and recorded, ~ or a covenant approved by the City Attorney as to form and content shall be recorded in the office of the County Recorder guaranteeing -2- 1040 ~ ~ ~ ~ . , that the lots located at 205-221 East Duarte Road and 810 South Second Avenue shall be maintained as one. 5. The existing legal nonconforming uses shall be terminated or otherwise be brought into compliance within seven (7) years (February 28, 1985). 6. Revised plans shall be submitted to and approved by the Director of Planning. SECTION 4. The Secretary shall certify to the adoption of this resolution. LORTZ ASSISTANT PLANNER GENERAL INFORMATION The property is developed with two single-family dwellings, a realty office, a parking lot, a residential garage and a storage building. Earll, Jr. 205-221 East Duarte Road Conditional use permit to allow two existing single-family residences in a C-l zone. The applicant proposes to expand the existing real ty office. C-l and R-2 P C.U.P. 78-2 2 ~ PROPOSAL The applicant has indicated (telephone conversation) that the aforementioned office expansion is the first phase of a two- phase proj ect. The second phase would take place within seven years, and wpuld consist of the removal of the single-family residences, construction of a two-story addition to the office building and completion of the parking area. PLAN REVIEW The submitted plans have the following deficiencies: 1. Parking spaces 1, 8 and 18 are only deficient if a 35-inch high wall is proposed between said parking spaces and the landscaped buffer adjacent to Second Avenue. (AMC 9269.13A and 9269.7A) 2. Code requires wheel stops for parking spaces 20-24 and 8-13. (AMC 9269.9A) ~ 3. Parking spaces 1-7 and 14-18 are required to have a 5-foot 3-inch landscaped buffer and wheel stops or an 8-foot 6-inch landscaped buffer which would allow for automobile overhang. (AMC 9269.13A) 4. Any mechanical equipment located on top of the roof must be screened from public view. (AMC 9263.6.6) 5. A trash enclosure is required. (AMC 9262.6.8) 6. "Hairpin" type striping is required for all parking spaces. (AMC 9269. 8A) 7. One tree is required for every 10 parking spaces. (AMC 9269.13A) 8. Parking space 24 does not have the required 25-foot backup distance and parking space 19 is not permitted. (AMC 9269.7A) 9. Code requires 24 parking spaces for the existing and proposed offices. (AMC 9269.5) 10. The rental and residence are required to have two covered parking spaces each. (AMC 9251.2.12 and 9253.2.9) . A discrepency exists between the submitted plans and the Tentative Parcel Map. The plans indicate 68.80 feet (surveyor's measurement) while the Tentative Parcel Map indicates 70.25 . C.U.P. 78-2 3 feet (City records) in width for the property fronting on Second Avenue. A parking layout with 90 degree parking and the required 5-foot 3-inch landscaped buffer would necessitate a total width of 70 feet in order to meet Code. The applicant has stated that the aforementioned deficiencies will be reconciled to meet the requirements of the Arcadia Municipal Code, with the exception of the following modifications: 1. AMC 9269.7A and 9269.13A -- Request to allow automobiles to encroach 1 foot 2 inches into a required 5-foot 3-inch landscaped buffer. 2. AMC 9253.2.9 -- Request to allow one covered parking space in lieu of four covered parking spaces required. ANALYSIS Residences are allowed in a commercial zone with an approved conditional use permit. . In staff's opinion, the proposal would be an appropriate improvement of the subject property and would eventually eliminate the existing legal nonconforming residences. The development would enhance the area and could stimulate improve- ments on other properties along Duarte Road and Second Avenue. Pursuant to the provisions of the California Environmental Quali ty Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not dis- close any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic signifi- cance. Therefore, a Negative Declaration has been prepared for this project. Before the Planning Commission takes action on this project, the Commission should "move to approve and file the Negative Declara- tion and find that the project will not have a significant effect on the environment." RECOMMENDATION . The Planning Department recommends approval of C.U.P. 78-2 subject to the following conditions: 1. Conditions as outlined in the attached report from the Department of Public Works shall be complied with to the satisfaction of the Director of Public Works. . C.U.P. 78-2 4 2. That the Final Parcel Map be approved and recorded or, a covenant approved by the City Attorney as to form and content shall be recorded in the office of the County Recorder guaranteeing that the lots located at 205-221 East Duarte Road and 810 South Second Avenue shall be maintained as one. 3. That the existing legal nonconforming uses be terminated or otherwise be brought into compliance within seven (7) years (February 28, 1985). 4. DUARTE ROAD LOT CONSOLIDATION INCLUDING ALLEY The existing alley right of way is presently used by residents and others having business within the proposed lot consolidation. It has no through access to Third ~venue; the easterly portion of the alley was vacated by Ordinance No. 152 in 1925. The undersigned has no objection to vacating the alley. The following. is a brief outlined requirements for the vacation of the alley: I. Adoption of Resolution of Intention to vacate. Set date Dr public hearing. 2. Publish or post Notice of Intention to vacate. 3. Hold public hearing. 4. Vacate subject to reservation of easements. Adopt resolution ordering the vacation. The following conditions of approval are recommended: 1. Obtain the approval of the City Council for the abandonment of said alley and comply with all conditions imposed by the Council. 2. The preparation and recordation of a parcel map in accordance with the requirements of the State Subdivision Map Act. The map shall be submitted to the County Engineer for checking, and after checking the County Engineer's letter recommending approval and map shall be submitted to the City Engineer for map certification. Concurrent with the map being submitted to the County Engineer for checking, the applicant should submit a copy of the City's conditional requirements to enable the County Engineer to check for applicable conditions. 3. Dedicate a two foot strip for street purposes at the southerly side of Parcel 2 to provide for. a 42 ft. right of way north of the center line of Duarte Road. Dedicate a two foot strip for street purposes at the westerly side of Parcels 1 and 2 to provide for a 42 ft. right of way east of the center line of Second Avenue. 4. Construct approximately 27 lin. ft. of 18 inch P.C.C. gutter, where missing, adjacent to Parcel No. 1 on Second Avenue. ~ Lot Split 77-8 May 3l, 1977 page 2 S. Pay map fee of $IO.OO.
