RESOLUTION NO. 1039
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ARCADIA RECOMMENDING APPROVAL
OF T.A. 78-2 AMENDING THE C-O, C-l, C-2 AND
C-M SECTIONS OF THE ARCADIA MUNICIPAL CODE
RELATING TO BUILDING HEIGHTS, REAR YARD
SETBACKS AND SIDE YARD SETBACKS.
WHEREAS, a public hearing was held on February 14, 1978
before the Planning Commission to consider amending the C-O, C-l,
C-2 and C-M sections of the Arcadia Municipal Code relating to
building heights, rear yard setbacks and side yard setbacks; and
WHEREAS, all interested persons were given full
opportunity to be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
. ARCADIA RECOMMENDS TO THE CITY COUNCIL:
SECTION 1. That Sections 9261.2.1, 9262.2.1, 9263.2.1
and 9265.2.1 be amended to read as follows:
"BUILDING HEIGHT. No building hereafter erected, con-
structed or established shall exceed three (3) stories or forty (40)
feet (12.19 meters) in height, except as provided in Division 6 of
Part 7 or in Division 2 of Part 8 of this Chapter."
SECTION 2. That Section 9261.2.3 shall be amended to
read as follows:
"SIDE YARD. There shall be a side yard on each side of
every building of a width not less than three (3) feet (.92 meters);
provided, however, that when such side yard abuts a residential

zone, a minimum side yard of ten (10) feet (3.05 meters) shall be
maintained, except that no portion of any structure shall encroach

. through a plane projected from an angle of fifty-five (55) degrees
as measured from the ground level of the side property line
adjacent to the residential zone."
SECTION 3. That Sections 9262.2.3 and 9263.2.3 be amended
to read as follows:
"SIDE YARD. No side yard shall be required; provided,
however, that when such side yard abuts a residential zone, a
minimum side yard of ten (10) feet (3.05 meters) shall be maintained,
except that no portion of any structure shall encroach through a
plane projected from an angle of fifty-five (55) degrees as
measured from the ground level of the side property line adjacent
to the residential zone."
SECTION 4. That Sections 9261.2.4, 9262.2.4 and 9263.2.4

be amended to read as follows:
"REAR YARD. There shall be on every lot or parcel of
land, a rear yard having a minimum depth of twenty (20) feet
(6.10 meters); provided, however, that no portion of any structure
shall encroach through a plane projected from an angle of fifty-
five (55) degrees as measured from the ground level of the rear
property line. For the purpose of this Section, the rear line of
the lot abuts a dedicated alley, the rear yard shall have a minimum
depth of twenty (20) feet (6.10 meters), and such rear yard and
fifty-five (55) degree angle may be measured from the center of
said alley."

SECTION 5. That Section 9261.2.5 of the Arcadia
Municipal Code shall be deleted.
SECTION 6. The Planning Commission finds that the

proposed text amendment will allow more flexibility in building
design; will provide greater control of commercial construction
adjacent to residential properties; and that the public necessity,
convenience, general welfare and good zoning practice justify
said text amendment.
SECTION 7. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
City ~ouncil of the City of Arcadia.
I HEREBY CERTIFY that the foregoing resolution was
adopted at a regular meeting of the Planning Commission of the City
of Arcadia held on the 28th day of February, 1978, by the following

To amend the CoO, C-l, C-2 and CoM sections of
the Arcadia Municipal Code relating to building
heights, rear yard setbacks and side yard
setbacks.
REQUEST:
GENERAL INFORMATION
At the present time, the CoO, C-l, C-2 and CoM codes allow a
three-story, maximum 35-foot high building. Towers, chimneys,
spires, gables, mechanical equipment and other roof structures
may protrude 10 feet above the roof of any building. This
would, in effect, allow a 45-foot structure in these zones.
The CoO zone requires a 30-foot rear yard setback and a 10-foot
side yard setback when it abuts a residential zone. The C-l,
C-2 and CoM zones require a 20-foot rear yard setback and
zero side yard setback.
The Planning Department is proposing to allow a maximum building
height of 40 feet. A 40-foot height maximum would allow for
larger mechanical space between floors. Many buildings are
constructed for lease purposes and, at the time of construction,
a builder is not always aware of the needs of prospective lessees.
A three-story, 35-foot high building must be designed with only
a minimal mechanical space between floors, which often prohibits
redesign to the specifications of a lessee. The Arcadia Municipal
Code does not permit modifications for height of commercial
structures. The maximum number of stories permitted will remain
the same (three stories).

The Planning Department is also recommending that the side and
rear yard setbacks be changed as shown on the following table:

The aforementioned setbacks are minimum requirements.
and building heights will vary based upon an angle of

Presently a 35-foot high building with 10 additional feet of
accessory structural items may be constructed 30 feet from the
rear property line. The new formula would allow a 43-foot high
structure, including mechanical equipment, to be constructed 30
feet from the rear property line.

It is staff's opinion that approval of this text amendment would
provide a developer more flexibility in building design and, at
the same time, provide control of commercial construction
adjacent to residential properties.

Pursuant to the provisions of the California Environmental
Quality Act. the Planning Department has prepared an initial
study for the proposed project. Said initial study did not disclose
any substantial or potentially substantial adverse change in any
of the physical conditions within the area affected by the project
including land, air, water, minerals, flora, fauna, ambient noise
and objects of historical or aesthetic significance. Therefore,
a Negative Declaration has been prepared for this project.
Before the City Council takes action on this project, the Council
should "move to approve and file the Negative Declaration and

find that the project will not have a significant effect on the
environment."
RECOMMENDATION
The Planning Department recommends that the CoO, C-l, C-2 and
CoM zones be amended as follows:

however, that any portion of any structure shall not violate an
angle of 55 degrees as measured from the ground level of the
rear property line. For the purpose of this Section, the
rear yard shall be measured from the rear lot line. Where the
rear line of the lot abuts a dedicated alley, the rear yard
shall have a minimum depth of 20 feet, and such rear yard and
55 degree angle may be measured from the center of said alley.
Section 9261.2.5 shall be deleted.
C-l Zone
