RESOLUTION NO. 1036 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT TO OPERATE AN EATING ESTABLISH- MENT AT 1002 NORTH SANTA ANITA AVENUE. WHEREAS, on January 19, 1978, an application was filed by Cesareo Osnaya to operate ap eating establishment, Planning Department Case No. C.U.P. 78-3, on the property commonly known as 1002 North Santa Anita Avenue, more particularly described as follows: A portion of Lots 7 and 8 in C.B. Clapp's Subdivision recorded in Map Book 31, page 30, in the office of the Los Angeles County Recorder. WHEREAS, a public hearing was held on February 14, 1978, . at which time all interested persons were given full opportunity to be heard and to present evidence, NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Planning Department in the attached report is true and correct. SECTION 2. This Commission finds that: 1. The granting of conditional use permit as hereinafter provided will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2. The use applied for at the location indicated is properly one for which a conditional use permit is authorized. 3. The site for the proposed use is adequate in size ~ and shape to accommodate said use including all yards, parking, -1- 1036 . . . loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the General Plan. 6. The use applied for will not have a substantial adverse impact on the environment. SECTION 3. That for the foregoing reasons, subject to approval of the City Council, this Commission grants a conditional use permit to operate an eating establishment upon the following conditions: 1. That a modification be granted for 48 existing parking spaces in lieu of the 58 parking spaces required by Code (9269.5). 2. That the existing freestanding sign be remodeled to provide 15 feet clearance over the vehicular way. 3. That a modification be granted for the existing free- standing sign to project 2 feet over the public right-of-way in lieu of the I-foot maximum overhang allowed by Code (9262.4.6). 4. That a modification be granted for the existing freestanding sign to be located 90 feet from residentially zoned property in lieu of the 100-foot minimum distance required by Code (9262.4.6). SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. -2- 1036 .\ . . EMPLOYEES: SEATING: RESTROOMS : One in addition to the proprietor 9 tables with seating for 25 persons There are 4 existing restrooms in the Hi Oaks Liquor store. The Building and Safety Division has indicated that the restrooms are adequate to meet the Uniform Plumbing Code requirements. PARKING: The site is developed with 48 parking stalls to serve 8,760 square feet of commercial floor space. (See site plan.) This exceeds by 4 spaces the number of parking spaces required if all the floor area were utilized by general retail uses. However, the designation of 951 square feet of floor area as an eating establishment would result in a 10 parking space deficiency. The Code requires 58 parking spaces for the existing building with the proposed use. SIGNS: . The applicant proposes to change the lower sign face of the existing freestanding sign to read Cesar's Taco - Mexican Food. (See photo of existing sign.) The lower sign can is in poor condition due to a collision with the top of a truck. There is approximately 12' of clearance over the vehicular way in lieu of the 15' minimum clearance required by Code (9262.4.6). The sign also projects approximately 2' over the public right-of-way in lieu of l' allowed and it is approximately 90' from a residential zone in lieu of the 100' minimum distance required. BACKGROUND The subject area was previously utilized by Papa Joe's Italian Cuisine. This was a take out business which did not have any tables and did not require a conditional use per~it. Papa Joe's moved out in August of 1977. On October 16, 1977, Cesa~'s Taco was issued a business license as a food to go ~erv1ce only. ?n December 27, 1977, Planning Department staff 1nspected the s1te and found that the business was being operated as an eating establishment with tables. Staff notified the applicant that he would have to remove the tables and apply for a conditional use permit if he wished to operate in that manner. The applicant complied and the tables were removed. ANALYSIS . An eating establishment is a permitted use in the C-2 zone with an approved conditional use permit. Staff's investigation of the site indicated that the existing parking facilities significantly exceed the parking need generated by the present uses. Occasionally the beauty salon generates enough trade on Saturdays to fill approximately half of the rear parking lot. . . . C.U.P. 78-3 3 Pursuant to the prOV1S10ns of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not dis- close any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic signifi- cance. Therefore, a Negative Declaration has been prepared for this project. , Before the Planning Commission takes action on this project, the Commission should "move to approve and file the Negative Declara- tion and find that the project will not have a significant . effect on the environment;" RECOMMENDATION The Planning Department recommends approval of C.U.P. 78-3, subject to the following conditions: 1.
