RESOLUTION NO. 1032 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA RECOMMENDING APPROVAL OF A TEXT AMENDMENT ADDING THE LOT AREA DESIGNATIONS FOR THE R-O & R-l ZONES TO THE "DIVISION" TITLES AND TO THE DIVISION ON "CREATION OF ZONES". WHEREAS, a public hearing was held on January 11, 1978 before the Planning Commission to consider amending Section 9231.1 and Section 9231.2 of the Arcadia Municipal Code and to amend the Division Titles for the R-O and R-l zone to include the lot area designations; and WHEREAS, all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA RECOMMENDS TO THE CITY COUNCIL: SECTION 1. That the following be added to Sections 9231.1 and 9231.2: " 9231.1. R-O FIRST ONE-FAMILY ZONE. 9231.1.1. R-O 30,000 9231.1. 2. R-O 22,000 9231.1. 3. R-O 15,000 9231.1. 4. R-O 12,500. " "9231.2. R-l SECOND ONE-FAMILY ZONE. 9231.2.1. R-l 12,500 9231.2.2. R-l 10,000 9231.2.3. R-l 7,500. " -1- 1032 . . . ., SECTION 2. That the title of Division 1, Article IX, Chapter 2, Part 5, be amended to read: "DIVISION 1. R-O 30,000, 22,000, 15,000, 12,500 FIRST ONE-FAMILY ZONE." SECTION 3. That the title of Division 2, Article IX, Chapter 2, Part 5, be amended to read: "DIVISION 2. R-l 12,500, 10,000, 7,500 SECOND ONE-FAMILY ZONE." SECTION 4. The Planning Commission finds that the proposed text amendment will create a more comprehensive zoning ordinance and allow for consistency between the subdivision and zoning ordinance, and that the public necessity, convenience, general welfare and good zoning practice justify the above recommendations. SECTION 5. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. -2- 1032 . . . APPLICANT: PROPOSAL: City of Arcadia Text amendment adding the lot area designations for the R-O and R.l zones to the "Division" titles, and adding the lot area designations to the Division on "Creation of Zones." GENERAL INFORMATION At the present time, the zoning ordinance in Division 1, Part 3, Chapter 2 of Article IX on "Creation of Zones" does not include in the R-O and R-l category, the minimum lot sizes. There are no specific references to lot sizes in the zoning ordinance. It is staff's opinion that in order to make the zoning ordinance more comprehensive, the various lot sizes should be incorporated in the zoning ordinance as follows: Division 1, Part 3, Chapter 2, of Article IX "Creation of Zones" should read: "9231.1. R-O. FIRST ONE-FAMILY ZONE. 9231.1.1. R-O 30,000. 9231.1.2. R-O 22,000. 9231.1.3. R-O 15,000. . 9231.1. 4. R-O 12,500. " . . T .A. 78-1 2 "9231.2. R-1. SECOND ONE-FAMILY ZONE. 9231.2.1. R-l lZt500, 9231.2.2. R-l 10,000. 9231.2.3. R-17,500." Division 1 of Article IX, Chapter 2, Part 5 should be amended to read: "DIVISION 1. R-O 30,000, 22,000, 15,000 AND 12,500 FIRST ONE-FAMILY ZONE." Also Division 2 of Article IX, Chapter 2, Part 5 should be amended to read: "DIVISION 2. R-l 12,500, 10,000, 7,500 SECOND ONE-FAMILY ZONE." Including these lot sizes in the "Division" titles establishes these zones as classifications in the zoning ordinance. These zones could then be applied to any property within the City through zone change procedures and not through text amendments to the subdivision ordinance as is presently the case. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not dis- close any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic signifi- cance. Therefore, a Negative Declaration has been prepared for this project. Before the City Council takes action on this project, the Council should "move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment." RECOMMENDATION The Planning Department recommends approval of T.A. 78-1 as noted above. . DLB/at
