HomeMy WebLinkAbout1031 . RESOLUTION NO. 1031 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT TO CONSTRUCT A RESTAURANT AT 14 EAST HUNTINGTON DRIVE. WHEREAS, on December 6, 1977, an application was filed by Thomas Turiace to construct a restaurant, Planning Department Case No. C.U.P. 78-1, on the property commonly known as 14 East Huntington Drive, more particularly described as follows: Lot 31, Block 73, Arcadia Santa Anita Tract, in the City of Arcadia, County of Los Angeles, as recorded in Map Book 15, pages 89 and 90 in the office of the Recorder of said County. WHEREAS, a public hearing was held on January 10, 1978, at which time all interested persons were given full opportunity to ~ be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Plan- ning Department in the attached report is true and correct. SECTION 2. This Commission finds that: 1. The granting of conditional use permit as hereinafter provided will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2. The use applied for at the location indicated is properly one for which a conditional use permit is authorized. 3. The site for the proposed use is adequate in size . and shape to accommodate said use including all yards, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. -1- 1031 . . . 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the General Plan. 6. The use applied for will not have a substantial adverse impact on the environment. SECTION 3. That for the foregoing reasons, subject to approval by the City Council, this Commission grants a conditional use permit to construct a restaurant upon the following conditions: 1. The property shall be improved and maintained in accordance with the plans which are on file in the subject Case No. C.D.P. 78-1 and applicable regulations of the Arcadia Municipal Code. 2. That parking meet the requirements of the Arcadia Municipal Code. 3. Existing driveway apron not be used shall be closed. One, 15 gallon parkway tree shall be planted at said location subject to the approval of the Director of Public Works. 4. Grading and drainage plan shall be submitted for approval of the Director of Public Works. 5. That the applicant file a covenant insuring that the owner of the subject property will participate in a parking district, should one be formed. 6. That this application be submitted to and approved by the Redevelopment Agency. 7. That final architectural plans be submitted to and approved by the Planning Department. -2- 1031 . . . SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. PROPOSED IMPROVEMENTS Two-story building containing 2,065 square feet (gross floor area) with 13 parking spaces (21 parking spaces are required). . C.U.P. 78-1 2 ANALYSIS A restaurant is a permitted use 1n the C-l zone with an approved conditional use permit. The applicant has indicated that the proposed facility would have seating for approximately 40 persons. The maximum occupancy according to the Uniform Building Code is 138 persons. The applicant has indicated (telephone conversation) that the building would be constructed of materials that meet the require- ments of the Uniform Building Code. The Redevelopment Agency staff has considered the feasibility of a parking district for the properties on the south side of Huntington Drive between Santa Anita and First Avenues. If the Planning Commission approves this application, a condition should be included that would require the property owner to participate in a parking district. . Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not dis- close any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic signifi- cance. Therefore, a Negative Declaration has been prepared for this project. Before the Planning Commission takes action on this project, the Commission should "move to approve and file the Negative Declara- tion and find that the project will not have a significant effect on the environment." RECOMMENDATION The Planning Department cannot recommend approval of this applica- tion due to the parking deficiency, although the development would enhance the area and could stimulate building improvements along Huntington Drive. However, should the Planning Commission wish to approve the aforesaid conditional use permit, staff recommends the following conditions: . 1. Conditions as outlined in the attached report from the Department of Public Works shall be complied with to the satisfaction of the Director of Public Works. C.U.P. 78-1 3 . 2. That the applicant file a covenant insuring that the owner of the subject property will participate in a parking district, should one be formed. 3.
