A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT TO CONSTRUCT A RESTAURANT AT 5851 BALDWIN AVENUE. WHEREAS, on October 31, 1977, an application was filed by Pizza Hut to construct a restaurant, Planning Department Case No. C.U.P. 77-31, on the property commonly known at 5851 Baldwin Avenue, more particularly described as follows: Portion of Lot 1, Block "W", Santa Anita Land Company's Tract, in the City of Arcadia, County of Los Angeles as recorded in Book 6, page 137 of Maps, in the office of the Recorder of said County. WHEREAS, a public hearing was held on December 13, 1977, at which time all interested persons were given full opportunity to . be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Plan- ning Department in the attached report is true and correct. SECTION 2. This Commission finds that: 1. The granting of conditional use permit as hereinafter provided will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2. The use applied for at the location indicated is properly one for which a conditional use permit is authorized. 3. The site for the proposed use is adequate in size and shape to accommodate said use including all yards, parking, tit loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. -1- 1029 . . . 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not' adversely affect the General Plan. 6. The use applied for will not have a substantial adverse impact on the environment. SECTION 3. That for the foregoing reasons, subject to approval of the City Council, this Commission grants a conditional use permit to construct a restaurant upon the following conditions: 1. The property shall be improved and maintained in accordance with the plans which are on file in the subject Case No. C.U.P. 77-31 and applicable regulations of the Arcadia Municipal Code. 2. Existing driveway apron not be used shall be closed. Damaged section of driveway apron on Las Tunas Drive shall be removed and replaced. Two parkway trees shall be planted on Las Tunas Drive in accordance with plans to be approved by the Director of Public Works. 3. Grading and drainage plan shall be submitted for approval of the Director of Public Works. 4. That plans showing elevations, exterior building materials and colors be submitted to the Planning Department for its review and approval. 5. That all existing and proposed parking areas comply with Code requirements. 6. FRONTAGE: Approximately 159.83 feet on Baldwin Avenue and 251.11 feet on Las Tunas Drive (entire shopping center) SURROUNDING LAND USE . AND ZONING: North: South: church and gas station -- C-2 multiple-family and single-family residences -- R-3 commercial (Pic & Save discount store) and gas station -- C-2 & D vacant land and a commercial use (Temple City) East: West: . C.U.P. 77-31 2 MISCELLANEOUS INFORMATION BUILDING SITE: Approximately 4,620 square feet BUILDING: Approximately 2,310 square feet of floor area PARKING: According to the Arcadia Municipal Code, the proposed facility should have 24 parking spaces. There are presently 152 parking spaces situated on the entire subject site. The applicant's site plan indicates .136 parking spaces for the entire subject . site, 44 of which are proposed to be granted to Pizza Hut under a reciprocal parking agreement. Code requires that the entire subject site have 120 parking spaces for both the proposed Pizza Hut and Jack r s Market. The plans submitted do not indicate landscaping and the length of the parking stalls appears substandard. Staff redesigned the entire parking area to comply with Code requirements and determined that 116 parking stalls could be situated on the sub- ject site. . ANALYSIS The proposed facility is a permitted use in a C-2 zone with an approved conditional use permit. Plans indicate that the pro- posed Pizza Hut building will be located on the east side of the subject site fronting on Baldwin Avenue. The applicant has indicated that the restaurant would have a seating capacity of approximately 75 persons. The possibility of parking congestion is mitigated by the fact that the peak hours of operation for the two facilities do not occur at the same time. It is staff's opinion that the proposed facility and the market would not generate sufficient traffic to create a parking problem at the subject site. . Pursuant to the provision of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project; Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, ai r, water, minerals, flora,. fauna, amb ien t noise and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. ~ Before the Planning Commission takes action on this project, the Commission should "move to approve and file the Negative . . . C.U.P. 77-31 3 Declaration and find that the project will not have a signifi- cant effect on the environment." RECOMMENDATION The Planning Department recommends approval of C.U.P. 77-31 subject to the following conditions: 1. The conditions as outlined in the attached report from the Department of Public Works shall be complied with to the satisfaction of the Director of Public Works. 2. That a modification be granted to allow 116 parking spaces in lieu of 120 required by Code. 3. That plans showing elevations, exterior building materials and colors be submitted to the Planning Department for its review and approval. 4. That all existing and proposed parking areas comply with Code requirements. S.
