RESOLUTION NO. 1027 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT FOR TWO SINGLE-FAMILY DWELLINGS IN AN M-l ZONE AT 34 AND 40 EAST NEWMAN AVENUE. WHEREAS, on October 31, 1977, Orla J. Pedersen filed an application to construct two single-family dwellings on two lots zoned M-l, Planning Department Case No. C.U.P. 77-30, on the properties commonly known as 34 and 40 East Newman Avenue, more particularly described as follows: Lots 41 and 42 of the Haven Tract, City of Arcadia, County of Los Angeles, as per map recorded in Book 13, pages 22 and 23 of maps in the office of the Recorder of said County. Whereas, a public hearing was held on November 22, 1977, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Planning Department in the attached report is true and correct. SECTION 2. This Commission finds that: 1. The granting of conditional use permit as hereinafter provided will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2. The use applied for at the location indicated is properly one for which a conditional use permit is authorized. -1- 1027 . . 3. The site for the proposed use is adequate in size and shape to accommodate saio use including all yards, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the General Plan. 6. The use. applied for will not have a substantial adverse impact on the environment. SECTION 3. That for the foregoing reasons, subject to approval of the City Council, this Commission grants a conditional use permit to construct two single-family dwellings on two lots zoned M-l upon the following condtions: 1. The property shall be improved and maintained in accordance with the plans which are on file in the subject Case No. C.U.P. 77-30 and applicable regulations of the Arcadia Municipal Code. 2. Driveway aprons shall be reconstructed to conform with City Standards. Damaged sections of sidewalk shall be repaired as determined by the Director of Public Works. NOTE: This work may be done concurrent with construction of proposed houses. SECTION 4. That Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City . Council of the City of Arcadia. -2- 1027 . Each lot contains 6,750 square feet. Each lot has 50 feet of frontage on Newman Ave. North: Single-family dwellings; zoned M-l South: Mixed residential uses; zoned M-l East: Single-family dwellings; zoned M-l West: Single-family dwellings; zoned M-l GENERAL PLAN: Single Family Residential 0-6 dwelling units per acre FRONTAGE: SURROUNDING LAND USE AND ZONING: HISTORY These lots are existing legal lots (created prlor to June 1949). . . . C.U.P. 77-30 2 In 1964, the M-l zoning was adopted for the area. On November 1, 1977, the City Council adopted Resolution 4658 approving a General Plan change for the site from lndustrial to Single Family Residential 0-6 dwelling units per acre. The Planning Commission at its November 8, 1977 meeting approved zone change Z-77-9 which recommended that the subject site be rezoned to R-l 7,500. The earliest date this zone change could be effective would be February 17, 1978. SPECIAL INFORMATION Building Sizes: Each dwelling will contain approximately 2,000 square feet. They meet all R-l Code requirements. ANALYSIS The proposed homes are consistent with the General Plan and will be consistent with the zoning when it is effective. The applicant is requesting a conditional use permit in order to hasten construction of the dwellings, rather than waiting until February when the zone change will be effective. It is staff's opinion that approval of this conditional use permit would not be detrimental to thc surrounding arca but would expedite development of the sites. RECOMMENDA T ION The Planning Department recommends approval of C.U.P. 77-30, subject to the following conditions: 1. Conditions as outlined in the attached report from the Director of Public Works shall be complied with to the satisfaction of the Director of Public Works. 2.
