HomeMy WebLinkAbout1025 . . . . ,----- RESOLUTION NO. 1025 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT FOR A RESTAURANT AT 135 COLORADO PLACE. WHEREAS, on September 13, 1977, an application was filed by B.H. Miller Investment Company, Ancient Mariner - Rusty Pelican, Incorporated to construct and operate a restaurant, Planning De- partment Case No. C.U.P. 77-22, on property commonly known as 135 Colorado Place, more particularly described as follows: Portion of lot 1, Tract 949, in the City of Arcadia, County of Los Angeles, as per map Book 17, pages 13 and 14. WHEREAS, on November 22, 1977, a public hearing was held on said matter at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Planning Department in the attached staff report is true and correct. SECTION 2. This Commission finds that: l. The granting of this conditional use permit as here- inafter provided will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2. The use applied for at the location indicated is properly one for which a conditional use permit lS authorized. 3. The site for the proposed use in adequate in size and shape to accommodate said use, including all yards, parking, -1- 1025 . . "'. ~ /" . ,------ loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the General Plan. 6. The use applied for will not have a substantial adverse impact on the environment. SECTION 3. That for the foregoing reasons, subject to approval of the City Council, this Commission grants a conditional use permit to construct and operate a restaurant upon the following conditions: 1. That the property shall be improved and maintained in accordance with plans on file inC.U.P. 77-22. 2. That the building be designed with materials that comply with the Building and Fire regulations or a variance to the Building Code be granted by the City Council. 3. That a "right turn only" sign be posted at the easterly driveway. 4. That a landscape and irrigation plan be submitted to the Planning Department for its review and approval. 5. That the hours of operation be limited to 10:00 a.m. to 1:30 a.m. daily. 6. All deliveries shall be between the hours of 7:00 a.m. and 10:00 p.m. 7. That a 6-foot high wall be located along the northerly portion of the westerly property line. -2- l025 .-., 8. That final building plans be submitted to the Planning ... Commission for its review and approval. 9. That dense landscaping shall be provided along the westerly property line subject to the approval of the Planning Department. 10. A grading and drainage plan shall be submitted for approval of the Director of Public Works. ll. Curb, gutter, and five-foot wide sidewalk shall be constructed. 12. An additional right-of-way to create a uniform l2-foot wide parkway shall be dedicated. 13. All work done within Colorado Place shall be in accordance with permits to be obtained by the applicant from the . California Department of Transportation. SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. Exterior Elevations: The applicant is proposing a wood exterior wi th corrugated metal roof. PARKING: Required: 93 spaces Proposed: 116 spaces Access will be from two driveways on Colorado Place. Egress from the easterly driveway should be restricted to "right turn only" because of the raised median strip in Colorado Place. LANDSCAPING: There is a 9'3" wide landscape planter and 6' high wall proposed along the northerly property line. Cars will overhang into this landscape strip 3' 3". An 8'6" wide landscape berm is proposed along Colorado Place between the parking area and the street. Cars will overhang into this landscape strip 3'3". Over 7% of the parking area is landscaped. Code requires a minimum of 3%. MISCELLN~EOUS INFORMATION The proposed hours of operation are as follows: Cocktails: Daily 11:00 a.m. - 1:30 a.m. Dinner: Daily 5:00 p.m. - 11:00 p.m. Lunch: Monday - Saturday 11:00 a.m. - 3:00 p.m. Brunch: Sunday 10:00 a.m. - 3:00 p.m. ~ .~; C.U.P. 77-22 3 . The applicant has indicated a maximum of 20 employees per shift. The trash enclosure and service area are located at the rear of the building. The applicant is proposing a single-face freestanding monument sign containing 51 square feet. A 250 square foot freestanding sign would be allowed. A 56 square foot sign is proposed on the south side of the building (facing Colorado Place). . Lighting is not shown on the plans. However, all light standards would have to ~omply with Code. ANALYSIS . A restaurant is a permitted use in a C-2 zone with an approved conditional use. permit. Parking and landscaping exceed Code requirements. One concern might be the hours of operation, however, other restaurants adjacent to residential properties (with conditional use permits) have the following hours: jojo's: Sunday-Thursday: Friday-Saturday: (Hours restricted 6:30 a.m. ~o 11:00 p.m. 6:30 a.m. to 1:00 a.m. by conditional use permit) Reuben's: Lunch: 11:30 to 4:00 p.m. Dinner: 4:00 p.m. to 11:00 p.m. 4:00 p.m. to 12:00 a.m. Friday and Saturday Cocktails: 11:30 a.m. to 1:30 a.m. Daily Sambo's: (un der construc- ti on ) Sunday-Thursday: Friday-Saturday: (Hours restricted 6:00 a.m. to 11:00 p.m. 6:00 a.m. to 1:00 a.m. by conditional use permit) The Plan~ing Department does not believe the hours of operation are excessive. Staff would recommend that dense landscaping be provided along the northea~terly property line (between the parking area and the single-family dwellings). , . Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has pr~pared an initial ~tudy for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project >- ~ C.U.P. 77-22 4 . including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. 'Before the Planning Commission takes action on this project, the Commission should "move to approve and file the Negative Declaration and find that the project will not have a signifi- cant effect on the environment." RECOMl-IENDAT I ON The Planning Department recommends approval of C.U.P. 77-22 subject to the following conditions: 1. Conditions as outlined in the attached report from the Department of Public Works shall be complied with to the satisfaction of the Director of Public Works. 2. That the building be designed with materials that comply with the BuilJing and Fire regulations or a variance to the Building Code be granted bv the City Council. .).
