HomeMy WebLinkAbout1024 ,.. '. .' ~ .. , . . RESOLUTION NO. 1024 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA DENYING CONDITIONAL USE PERMIT FOR A CHURCH AT 21 MORLAN PLACE. WHEREAS, on October 17, 1977, an application was filed by the Christian Center of Arcadia, Inc., to operate a church Planning Department Case No. C.U.P. 77-27, on property commonly known as 21 Morlan Place, more particularly described as follows: Portion of Lot 5 of Tract 13768 in the City of Arcadia, County of Los Angeles, State of California, as per map recorded in Book 273, Page 37 of Maps in the office of the County Recorder. WHEREAS, on November 22, 1977, a public hearing was held . on said matter at which time all interested persons were given full opportunity to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Planning Department in the attached staff report is true and correct. SECTION 2. The Planning Commission finds that the streets are inadequate to carry the kind of traffic that would be generated by the proposed chUrch; that there is inadequate parking; that there is poor access to the lot; that the use is too intensive for the site; an~ that the use would be detrimental to the public health and wel- fare and injurious to the property or improvements in such vicinity. .SECTION 3. For the foregoing reasons, the Planning .- Commission denies C.U.P. 77-27. -1- 1024 . . . , ., SECTION 4. Th~ Secretary shall certify to the adoption of this resolution. On November 16, 1976, . . . -. C.U.P. 77-27 2 the City Council approved C.U.P. 76-22 for a racquetball club on said site. On September 20, 1977, the City Council approved C.U.P. 77-16 for a youth center at said site. MODIFICATIONS REQUESTED 1. Request modification for 69 parking spaces in lieu of 95 required. SPECIAL INFORMATION BUILDING SIZE: Approximately 18,844 square feet PROPOSED FACILITY: The applicant is proposing to convert the existing building at 21 Morlan Place into a church. Entrance to the church will be on the north. The building will contain a sanctuary with seating for 800 per- sons, a nursery and play room, Sunday School classrooms and offices. PARKING AND ACCESS: 95 parking spaces would be required for this use based on the requirements for "Other Permitted Uses" in the commercial zone of 5 spaces per 1,001 square feet of gross floor area. The applicant is requesting a modification for 69 spaces; 49 will be on-site and 20 will be located on the property directly to the east (121-159 N. Santa Anita). The applicant has indicated that a covenant will be filed granting reciprocal parking. (See a draft of the proposed covenant which is attached.) Parking at 21 Morlan Place complies with Code in regard to size, striping and driveway aisles. However, some spaces may be difficult to use and the 35-foot driveway onto the Santa Anita property (121-159) might reduce the number of spaces on . that site. Access to the parking will be from driveways on Morlan Place and Santa Clara Street. Access from Santa Clara will be across the rear of properties at 121-159 N. Santa Anita and will be granted by covenant. Landscaping exceeds 3% of the parking area. C.U.P. 77-27 3 . MISCELLANEOUS INFORMATION The church service hours will be: Sunday: 8:15 a.m. to 12: 30 p.m. 6:00 p.m. to 9:00 p. m. Thursday: 7:30 p.m. to 10:00 p.m. Friday: 7: 30 p.m. to 10:00 p.m. The maximum occupancy according to the Unform Building Code is 1,130 persons. Mechanical equipment located on the roof of the building is not screened from view. No trash enclosure is shown on the plans. ANALYSIS A church is a permitted use In a C-l zone with an approved conditional use permit. Staff believes the parking area should be redesigned to provide easier access to the parking stalls, better circulation and more . landscaping. It does not believe the reduction from 49 to 43 parking spaces will be detrimental to the use. The proposed hours of the church services are during nonhusiness hours of operation; the Planning Department recommends approval of a modification to allow 63 parking spaces in lieu of 95 required. The mutual use of the parking at the subject site and at 121- 159 Santa Anita would be beneficial to both properties since there is not a conflict in the hours of use. This. would allow. the properties to be used to the greatest potential and aid in re- solving parking deficiencies. It is staff's. opinion that approval of this use would not be detrimental to surrounding properties. . Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been pre- pared for this project. . . . C .U . P. 7 7 - 2 7 4 Before the Planning Commission takes action on this project, the Commission should "move to approve and file the Negative Declaration and find that the project will not have asignifi- cant effect on the environment." RECOMMENDATION The Planning Department recommends approval of C.U.P. 77-27, subject to the following conditions: 1. Conditions as outlined in the attached report from the bepartment of Public Works shall be complied with to the satisfaction of the Director of Public Works. 2. That all parking, including that at 121-159 North Santa Anita, comply with the following sections: 9269.7.A, 9269.8.A, and 9269.9.A. 3. That a covenant shall be filed with the County Recorder's office guaranteeing access to Santa Clara Street across the rear of the property at 121-159 Santa Anita Avenue and insuring mutual use of the parking area; said covenant to be approved by the City Attorney. 4. That a modification be granted for a mlnlmum of 63 park- ing spaces in lieu of 95 required (including the property at l2l~159 N. Santa Anita Avenue). 5. That a parking plan and a landscape and irrigation plan identifying planting material, size, spacing and quantity be submitted to the Planning Department for its review and approval prior to installation. 6. That a trash enclosure be provided as per Section 9262.6.9 of the Arcadia Municipal Code. 7. That mechanical equipment shall be painted a color which will blend with the roof.
