RESOLUTION NO. 1023 A RESOLUTION OF l'HE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A ZONE VARIANCE TO PERMIT AN ADDITION TO AN EXISTING EATING ESTABLISHMENT IN A PR-l ZONE AT 245 EAST FOOTHILL BLVD. WHEREAS, on October 21, 1977, Sterling Foods on behalf of Shakey's Pizza Parlor filed an application for an addition to an existing eating establishment in a PR-l zone"Planning Department Case No. V-77-6, on property commonly known as 245 East Foothill Blvd., more particularly described as follows: r Lot 5, Tract 12834 in the City of Arcadia, County of Los Angeles, as per Map Book 262, page 24, as recorded in the office of the Recorder of said County. WHEREAS, a public hearing was held on said matter on . November 22,1977, at which time all interested persons were given full opportunity to be heard and to present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Planning Department in the attached staff report is true and correct. SECTION 2. This Commission finds that: l. There are exceptional or extraordinary circumstances or conditions applicable to the property involved, or to the intended use of the property, that do not apply generally to the property or class of use in the same zone or vioinity. 2. The granting of such variance will not be materially ... detrimental to the public health or welfare or injurious to the -1- 1023 . . . r> .- . property or improvements in such zone or vicinity in which the property is located. 3. That such variance is necessary for the preservation and enjoyment of a substantial property right of the applicant possessed by other property in the same zone and vicinity. 4. That the granting of such variance will not adversely affect the comprehensive general plan. SECTION 3. That for the foregoing reasons, subject to approval of the City Council, this commission grants a zone variance for an addition to an existing eating establishment in aPR-l zone upon the following conditions: 1. The property shall be improved as per plans on file in the subject Case No. V-77-6. 2. That a 6-foothigh wall be constructed along the easterly property line to replace. the existing fence. 3. That all.mechanical equipment.be screened from view. 4. That all permanent and temporary storage of wares, merchandise, crates, bottles and similar items shall be within a building. 5. That the plants in the landscape planter adjacent to the sidewalk be trimmed and maintained. 6. That deliveries shall be between the hours of 7:00 a.m. and 10:00 p.m. 7. That the Commission grant a modification for 45 parking spaces in lieu of 106 required. 8. That all signing shall comply with Code. -2- 1023 . . . f' SECTION 4. LOCATION: REQUEST: EXISTING LAND USE AND ZONING: SI ZE: FRONTAGE: SURROUNDING LAND USE AND ZONING: Sterling Foods on .behalf of Shakey' s Pizza Parlor 245 East Foothill Blvd. A zone variance to add to the existing Shakey's Pizza Parlor which is located in Zone PR-l. The subject site is developed with a Shakey's eating establishment and zoned C-2 and PR-l. 27,950 square feet 100 feet on Foothill Blvd. North: developed with single-family dwellings; zoned R-l South: mixed commercial uses; zoned C- 2 East: mixed commercial uses; zoned C-2 and PR-l West: Ralph's shopping center; zoned C-2 D & PR-l GENERAL PLAN: Commercial MODIFICATION REQUESTED: The applicant is requesting a modification for 45 parking spaces in lieu of 106 required. ,,~, V-77-6 z . HISTORY The eating establishment was constructed in 1964, prior to the requirement for conditional use permits for eating establishments. Modification M-64-l44 was granted allowing the building to be located within the PR-lzoned portion of the property in line with the buildings at Ralph's shopping center. SPECIAL INFORMAT10N Building Information: Size: The existing buitding contains 4,800 square feet of floor area. The applicant is proposing to add approximately 488 square feet for a total area of 5,288 square feet. This addition will be used for storage (308 sq. ftJ.and a foyer (180 sq. ft.) Height: The front facade will be remodeled and will be approximately 19 feet in height. Seating Capacity: The seating capacity will be 150 people. . Parking: 106 parking spaces are required. modification for 45 spaces. All will be hairpin striped. The applicant is requesting a spaces will be 9' by 20' and Access will be from two driveways. One driveway is located along the easterly property line. The other driveway, although used by Shakey's, is on a separate lot. The applicant has indicated that there is no recorded easement granting them use of this property. The site has adequate access if the use of this property for access was terminated. Landscaping: The Code requires as' 3" landscape planter and 3-foot high wall between parking areas and a public right-of-way. There is a 4-foot wide planter and 3-foot high wall in the front. A 5'3" wide planter and 6-foot high wall is located across the northerly property line. A 6-foot high chain link fence with slats is located adjacent to the PR-l property to the eas~. This fence is in poor condition and shrubs have grown through the fence into the existing parking area. . The. app Ii can t parking stalls. . . . r--- V -77 - 6 3 MISCELLANEOUS INFORMATION The existing hours of operation are 11:00 a.m. to 12:00 a.m. There are a maximum of 12 employees. A trash enclosure is proposed behind the building. Existing mechanical equipment is not screened and can be seen from the street. The existing sign is approximately 336 square feet and 33 feet in height. Code allows 150 square feet and 25 feet in height.. ANAL YS IS The proposed use is consistent with the General Plan. The expansion will not add any additional seating. There is an existing screened storage area north of the building which will be removed with the construction of the new storage are.. It is staff's o'pinion that approval. of this zone variance would not be detrimental to adjoining properties. Staff does not believe the expansion would increase the need for additional parking and feels the existing parking is adequate for said uS'e. The Planning Department would recommend that the easterly fence be replaced with a 6-foot high block wall. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and obj ects of historical or aesthetic significance. Therefore, a Negative Declaration has been pre- pared for this project. Before the Planning Commission takes action on this project, the Commission should "move to approve and file the Negative Declara- tion and find that the project will not have a significant effect on the environment." RECOMMENDATION The Planning Depa rtment recommends approval of V - 77 - 6 subject to the .following conditions: . . . ,-'. V-77-6 4 1.
