NG LAND USE & ZONING: SURROUNDING LAND USE & ZONING: GENERAL PLAN DESIGNATION: HISTORY 30th Street Architects, Inc. on behalf of Grace Restaurant Company 59 Las Tunas Drive Conditional use permit to expand the existing Coco's Restaurant 35,945.9 square feet 208.15' on Las Tunas Drive The subject site is developed with Coco's Restaurant; zoned C-2 NORTH: Developed with single-family dwellings; zoned R-l SOUTH: The property is vacant (to be developed with a commer- cial compl ex); zoned C-M EAST: Developed with a neighborhood shopping center; zoned C-2 WEST: Developed with offices; zoned C-O Comme rci al On February 27, 1973, the Planning Commission adopted Resolution 805, granting Conditional Use Permit 73-1 for jojo's Restaurant at 59 West Las Tunas Drive. A condition of approval was that the hours of operation including delivery of supplies and maintenance shall be between the hours of 6:30 a.m. and 11:00 p.m. with the exception that the hours on Friday and Saturday evening be extended to 1:00 a.m. . . . , , In 1983 jojo's changed to Coco's restaurant. PROPOSAL The applicant is proposing to add a 637 sq. ft. greenhouse dining area to the existi ng 4,783 sq. ft. restaurant for a total floor area of 5,420 square feet. The addition will be located at the front of the building adjacent to the Las Tunas Drive property line and will maintain the same architectural design as the existing building. Presently there is seating for 125 persons. The proposed addition will have seating for 36 persons, providing a total of 161 seats. Fifty-five (55) parking spaces are located on the site. Based upon the total square footage of 5,420 sq. ft., 55 parki ng spaces are requi red by code. MISCELLANEOUS INFORMATION The Fire Department has reviewed the proposed plans and has noted that domestic fire sprinklers will be required in the new dining area. A central station alarm system will be requi red for the entire occupancy. ANALYSIS A restaurant is a permitted use in the C-2 zone with an approved conditional use permit. The proposed expansion will not signficantly increase the seating in the restaurant and the parki ng compl i es with the code requi rements. It is staff's opinion that the expansion of this restaurant will be an appropriate addition to the site and staff would recommend approval of this conditional use permit. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATION The Planning Department recommends approval of C.U.P. 85-7 subject to the following conditions: 1. That fire protection shall be provided to the satisfaction of the Fire Depa rtment. C.U.P. 85-7 Apri 1 23, 1985 Page 2 . 2. That the hours of operation including the delivery of supplies and mai ntenance of the property shall be between the hours of 6 :30 a.m. and 11:00 p.m. with the exception that the hours on Friday and Saturday evening be extended to 1:00 a.m. 3. That C.U.P. 85-7 shall not take effect until owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. FINDINGS AND MOTIONS Approval If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the envi roranent and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report (or as modified by the Commission). Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and findings in support of that decision. . .
