HomeMy WebLinkAbout1286 . - . ~ 10 PLANNING COMMISSION RESOLUTION 1286 A RESOLUTION GRANTING CONDITIONAL USE PERMIT 85-5 TO OPERATE A RESTAURANT AT 100 NORTH SANTA ANITA AVENUE WHEREAS, on March 18, 1985, an application was filed by Davis Daugherty, Inc. to operate a restaurant, Planning Department Case No. C.U.P. 85-5, on property coolloonly known as 100 North Santa Anita Avenue, more particularly described as follows: Parcell of Parcel Map No. 2415, in the City of Arcadia, County of Los Angeles, State of California, as per Map recorded in Map Book 34, Page 64 of the County Records. WHEREAS, a publiC hearing was held on April 23, 1985, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is ad'equate in size and shape to accOOlmodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping and other features requi red to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in widt~ and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Pennit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment. . It . Sect ion 3. That for the foregoi ng reasons this Commission grants a Conditional Use Permit for the operation of a restaurant upon the following conditions: 1. That a second exit from the mezzanine area be provided as per the Fire Department's requirements within six months of the opening of the restaurant. 2. That parking facilities on the Towne Centre site shall be available for the use of the restaurant and that no parki ng withi n the Towne Centre site shall be specifically reserved or designated for anyone particular use. 3. That the landscaped area shall be maintained in a neat and orderly manner. 4. That C.U.P. 85-5 shall not take effect until owner and applicant have executed a fonn available at the Planning Department indicating awareness and acceptance of the conditions of approval. Section 5. (.18 acre) 83.75 on Santa Anita Avenue 95.50' on Wheeler Avenue The subject site is developed with a vacant restaurant; zoned C -2 & H Nort h: South: East: Developed with the Towne Centre building; zoned C-2 & H Developed with parking and a restaurant; zoned C-2 & H Developed with parking and mixed commercial uses; zoned C-2 & H Developed with mixed commercial uses; zoned C-2 West: Comme rci al In April, 1971 the Planning Commission ratified Resolution 723 granting a conditional use permit for a restaurant at 100 North Santa Anita Avenue. A condition of approval of this conditional use permit was that "All parking facilities on the Towne Centre site shall be available for the use of the proposed restaurant". . . . The Great Scot opened in 1972. Since that time the restaurant has changed ownership twice. The most recent restaurant, the "Pirates of Monte Carlo", closed on January 9, 1983. According to the Arcadia Municipal Code, a conditional use permit becomes void if a business is abandoned or discontinued for more than one year. PROPOSAL AND ANALYSIS The appl icants are propos i ng to reopen the 7,650 sq. ft. restaurant for lunch and dinner. The lunch hours will be from 11:00 a.m. to 3:00 p.m. and dinners will be served from 4:00 p.m. to 12:00 a.m. On Sundays the restaurant will be open for brunch at 10:00 a.m. The lounge area will be open from 11:00 a.m. to 2:00 a.m. Presently seating for 183 persons is allowed. The Fire Department has reviewed the requested conditional use permit and has recomlrended that a second exit be provided in the mezzanine area and that said exit should be constructed within six months from the opening. When the second exit is provided, the total seating for the restaurant may be increased approximately 20 seats. No major changes are proposed to the buildi ng. Pa rki ng There are 194 parki ng spaces on the Towne Centre site. As noted above, a requirelrent of the previous conditional use permit for this restaurant was that all parking on the Towne Centre site shall be available for the use of the proposed restaurant. In 1972, a modification was granted for 197 parking spaces in lieu of 304 required (198 spaces were provided). In July. 1980, the Fire Department required that four of the parking spaces be painted over to allow for emergency access, providing a net parking count of 194 spaces. The Towne Centre building and the restaurant pay into the parking district and based upon said paYlrent they are allocated a total of 50.7 spaces (43.1 for the Towne Centre building and 7.6 for the restaurant). Attached is a memo from Pete Kinnahan, Assistant City Manager for Economic Development regarding the reopening of the restaurant. Mr. Kinnahan has noted in his memo that their primary concern is the inadequate amount of day time parking on the site, particularly during the lunch hours. He further notes that this "problem could be somewhat mitigated by having the restaurant utilize the area to the south, across Wheeler Avenue (fonnerly the American Savings & Loan site). This concern has been discussed with the applicant. C.U.P. 85-5 Apri 1 9, 1985 Page 2 . . . One of the previous restaurant owners attempted to designate specific parking spaces for exclusive use of the restaurant, however when the restaurant operator was notified the signing was discontinued. The Towne Center's parking spaces are not intended to be reserved or designated for anyone particular use, but are for general use by persons visiting the site. The Planning Department is aware that during certain hours of the day the parking lot is heavily used. The previous restaurant operated during the lunch hours. It was recognized when the original conditional use permit was granted that there might be an inconvenience to restaurant customers during the lunch hours because they might not be able to park immediately adjacent to the restaurant. However, staff believes that there is adequate parking within the downtown area to accommodate lunch hour traffic to the restaurant. It is staff's opinion that the reopening of the restaurant will be of benefit to the area. Pursuant to the provlslons of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land. air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDAT ION The Planning Department recommends approval of C.U.P. 85-5 subject to the following conditions: 1. That a second exit from the mezzanine area be provided as per the Fire Department's requirements within six months of opening of the restaurant. 2. That parking facilities on the Towne Centre site shall be available for the use of the restaurant and that no parking within the Towne Centre site shall be speCifically reserved or designated for anyone particular use. 3. That the landscaped area shall be maintained in a neat and orderly manner. 4. That C.U.P. 85-5 shall not take effect until owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. I have contacted both Mr, Dan Dougherty, the proposed restaurant operator and Mr. Milton Weiner, owner of the parking lot to the south, providing them with infor- mation regarding their respective interests. Our other concerns relate to the appearance of the structure. We do not wish to see an increase in signage area and wili want ~o review any changes which may be proposed.
