PLANNING COMMISSION RESOLUTION NO. 1285
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ARCADIA, REVOKING CONDITIONAL
USE PERMIT (CUP) NO. 75-14 (131 1/2 E.
HUNTINGTON DRIVE)
WHEREAS, CUP No. 75-14 permits a liquor related use (beer
bar) at l31 E. Huntington Drive, and
WHEREAS, pursuant to a Notice of Public Hearing to revoke
said CUP, revocation was considered at a public hearing on March
19, 1985, and
. WHEREAS , the required written notice of the hearing was
given to permittee, and
WHEREAS, the Planning Commission reviewed the charges,
exhibits, declarations, submitted reports and related evidence
all of which constitute the record of the hearing.
NOW, THEREFORE, the Planning Commission renders the decision
set forth in Section 1 below based on the Commissions findings as
set forth in Section 2.
SECTION 1. Conditional Use Permit No. 75-14 is revoked.
SECTION 2. Based on the noncontroverted evidence presented
at the hearing, the Commission finds that conditions of the
Conditional Use Permit, and regulations of supervisory agencies
including the State and City have been. violated without
justifiable excuse as set forth in the following:
A. Violation of subsection B (1) of Resolution No. 4954 and
subsection 2.1 of Resolution No. 909 by allowing, permitting and
otherwise causing operation and conduction of a use in a manner
that is detrimental to the public health, safety and welfare. is

... injurious to property and improvements in the zone and vicinity
and otherwise constitutes maintenance of a public nuisance based
on the following:
1. On April 17, 1982 a drunk in pUblic incident occurred at
sUbject location and an arrest was made for violation of Penal
Code Section 647(f) - drunk in public.
2. On May 8, 1982 a complaint of excessive band noise
caused a police response to subject premises and resulted in a
citation of a minor for being in possession of an alcoholic
beverage.
3. On May 8, 1982 a band on subject premises caused
excessive noise inconsistent with Municipal Code requirements.
Police officers at sUbject location confronted agitation.
. fighting, verbal abuse and observed under aged minors drinking
alcoholic beverages. A battery on a police officer occurred and
obstructing an officer from affecting an arrest transpired on
subject premises.
4. On August 7, 1982 police officers responded to a fight
at the rear of subject premises. Approximately fifteen (15)
persons were observed fighting, pushing and shoving each other.
Additionally, juveniles were observed drinking at subject
location.
5. On August l3, 1982, during a bar check at subject
location, police observed an individual who was drunk in public
and arrested said individual for violation 647(f) of the Penal
Code.

6. On October l2, 1982 police responded to a call involving
potential child abuse, With paramedics, they went to subject
location and observed the alleged victim who was a 15 year old
girl. The girl stated that in lieu of leaving for school, she
had been going to subject location and staying there all day and
night.
7. On November 7, 1982 police responded to a battery which
took place at subject location. The combatants were playing pool
at subject location.
8. On November 12, 1982 police observed a minor individual
leaving subject location while drinking a beer in the parking lot
area. A citation for minor in possession of an alcoholic
beverage was issued.
... 9, On November 19, 1982 police responded to a complaint of
a battery assault which took place at subject location.
lO. On November 2l, 1982 police observed an under aged
individual drinking alcoholic beverages at subject location.
Pursuant to investigation of the juvenile another individual
interfered with the peace officer involved at subject location.
11. On November 27, 1982 two (2) drunk in public incidents
occurred at subject location.
12. On December 4, 1982 a major disturbance occurred at
subject location involving fighting, a hostile acting crowd,
public intoxication, and an attack on a police officer. Several
fights occurred with injuries to various parties.
13. On January 7, 1983 a person was observed to be drunk 1n
. public in the rear alley proximate to subject location.

14. On March 10, 1983 acts of loitering, tampering with a
motor vehicle, and interfering with a police officer occurred at
subject premises.
15. On March l7, 1983 a fight occurred at subject location.
16. on May l, 1983 juveniles under the legal drinking age
were observed drinking alcoholic beverages at subject location.
17. On May 6, 1983 yelling, screaming and fighting occurred
at subject location. Also, a juvenile under the legal age for
drinking was observed consuming alcoholic beverages. As a result
of the fighting, serious injuries were incurred by a victim on
the premises.
l8. On May 31, 1983 a juvenile under the legal age for
drinking was observed consuming alcoholic beverages.
... 19. On November 13, 1983 a fight and assault with serious
injuries occurred at sUbject location. Entry of a motor vehicle
by those not the owner was also made.

20. On December 1, 1983 a juvenile under the legal age for
drinking was observed consuming alcoholic beverages at subject
location.
21. On March 2, 1984 a group of approximately 25 persons
were observed loitering in the rear parking lot of subject
location. Numerous minors were observed and one was arrested for
minor in possession of alcoholic beverages. The suspect was
belligerent and resisted the officers attempts to arrest him.
22. On March 16, 1984 officers responded to subject
location regarding a possible fight in progress. On arrival they
observed a minor in possession of an alcoholic beverage.

~ Officers were advised that the fight had been resolved prior to
their arrival and that the parties involved had gone from that
location.
23. On April 7, 1984 police observed a juvenile in the
restroom at subject location who was in possession of a can of
beer. Subject juvenile was also in violation of the curfew
section of the Arcadia Municipal Code.
24. On April 7, 1984 an individual was observed walking in
the parking lot at the rear of subject location. Was ascertained
that subject individual was l5 years old and was in violation of
the Arcadia curfew provisions.
25. On April ll, 1984 police observed several individuals
around subject location drinking beer. As police exited their
~ vehicles, the people in the"parking lot ran into subject
location. No liquor license was posted on the premises,
26. On June 5, 1984 a fight and battery occurred at subject
location.

27. On June 13, 1984 a theft of a vehicle part occurred in
the parking lot of subject location.
28. On June 15, 1984 a fight occurred at the rear of subject
location involving at least 20 to 30 on-lookers.
29. On June 27, 1984 a person was observed lying on the
ground in the parking lot adjacent to subject premises. Patrons
of the bar approached the police and advised that the subject had
been inside the bar and had been annoying females and had been in
a fight while in the bar. Subject who was observed lying in the
parking lot was arrested for being drunk in public.

30. On April 28, 1984 police were driving in the vicinity of
subject location and were flagged down by an individual who
reported a beating. The fight had occurred inside the bar at
which time the bartender at subject location was hit in the face.
An arrest for battery of the suspect occurred.
31. On June 25, 1984 two (2) individuals were observed in
the back seat of a Mustang vehicle at subject locations parking
lot. Both individuals in the vehicle were under 18 years old.
Citations for curfew violations were issued.
32. On August 9, 1984 an altercation occurred at subject
location and injuries and suit as a result of one party hitting
another party in the head with a chair. A beer bottle was also
smashed during the altercation and injuries occurred.
33. On September 8, 1984 subject was observed lying on his
back in the alley of the rear of subject location. An employee
at subject location advised that the subject had been drinking
heavily all night at subject location.
34. On September 29, 1984 a disturbance occurred at subject
location involving several customers, The disturbance continued
out in the back parking lot arising in a homicide and resulting
in the arrest of suspects for murder.
35. On October 19, 1984 two (2) juvenile individuals were
observed at the entrance to subject location in violation of the
City's curfew law relative to minors.
36. On October 19, 1984 a minor was observed at subject
location in possession of alcoholic beverages.

37. On October 19, 1984 several subjects under the age of 21
were observed loitering around two vehicles in the parking lot at
the rear of subject location. Within their vehicle was an open
twelve pack of beer and three full twelve ounce bottles of beer.
38. On October 24, 1984 an arrest was made at subject
location for being drunk in public.
39. On October 27, 1984 two individuals were observed
loitering around the rear of subject location. Both subjects
were under the age of 2l and were present at subject location
after the hour of 10:00 p.m.
40. On October 27, 1984 in the rear of subject location 4
people were seen dragging and carrying a body by its arms and
legs towards the rear parking lot, A female approximately 17
years old was passed out. Police were told that the girl was
found at the rear of subject location. The victim was
transported to Methodist Hospital were she disclosed that she had
been taking drugs called "ludes". She took the pills and drank
the beer from patrons in subject location. She stated that
everyone shares beer in subject location.
41. Numerous neighborhood problems caused by patrons of
Roxanne's including, but not limited to the above and the
following:
(a) Congregating of patrons on private parking lots to
drink and smoke
(b) Debris in the area such as broken wine and beer bottles
(c) Destruction of property and vandalism
(d) Loitering at all hours by minors

(e) Graffiti
(f) Improper and illegal parking causing disruption to
neighboring businesses
(g) Broken windows
(h) Fighting and drunkenness
B. Violation of regulations of the City and other
supervisory agencies as follows:
1. Violation of City Fire Code provisions regarding
occupancy requirements on October 27, 1984 and other similar
violations on other occasions.
2. Violation of City requirements for a Game Machine Permit
resulting in revocation of Game Machine Permit effective November
l3, 1984 as reflected by the decision of the City applicable to
... said permit attached as Item A.
3, Violation of Arcadia Municipal Code Sections prohibiting
entertainment without a permit on October 26th, 27th and 28th as
reflected in Misdemeanor Criminal Complaints filed against
permittee and attached as Item B.
4. Violation of Rules, Regulations and Statutes of the
State of California and the Department of Alcoholic Beverage
Control involving a license suspension for sale of an alcoholic
beverage to a minor made on the licensed premises, which
suspension was imposed in February of 1983 as reflected on Item C
attached.
5. Continuing acts and conduct resulting in the Alcoholic
.
Beverage Control Department of the State of California filing an
accusation to revoke Roxanne's liquor license on the grounds that

~ sUbject location has created a law enforcement problem as alleged
in Count I of said accusation attached as Item G.
6. Roxanne's is a business catering to the public for
drinking and entertainment. As such, the continued conduct of
patrons of Roxanne's, failure to control patrons, prevent
disturbances and other related problems including the expenditure
of substantial law enforcement efforts is inconsistent with
Conditional Use Permit requirements.
C. The allowance of illegal act on the premises such as
entertainment without a permit entices people to attend said
premises, helps contribute to the crowds and problems that
characterize subject premises and the immediate location as a
public nuisance, and otherwise contributes to the detrimental
. conditions that exist in relation to subject location. Likewise,
as to the allowance of alcoholic beverage use by minors,
loitering, and lack of controls as to the level of alcoholic and
drug intoxication on the sUbject premises and control over those
who are intoxicated. In additional to the aforementioned
grounds, these factors are inconsistent with and violate zoning
requirements applicable to Conditional Use Permits as follows:
(1) Arcadia Municipal Code Section 9275.1 which requires,
in part, that uses permitted by a Conditional Use Permit should
be "essential or desirable to the public convenience, or welfare,
and can be harmoniously adjusted to the surrounding uses and the
community...." Also it is provided in Section 9275.1 that
Conditional Uses require special consideration and their affect

~ on property values, health, safety and welfare on adjacent
properties in the neighborhood or in the community as a whole
must be considered,
(2) Arcadia Municipal ode Section 9210 which establishes
zoning regulations to serve the "public health, safety and
general welfare and to provide the economic and social advantages
resulting from an orderly planned use of land resources."
(3) Arcadia Municipal Code Section 9211 which provides that
the provisions of the Zoning Code establish "minimum requirements
for the promotion of the public health, safety, comfort,
convenience and general welfare."
(4) Arcadia Municipal Code Section 1201 which prescribes.
in part, that ".., any condition caused or permitted to exist in
~ violations of any of the provisions of the Code shall be deemed a
public nuisance
"
SECTION 3.
The Secretary shall certify to the adoption of
this Resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia.

THE GAME MACHINE PERMIT FOR ROXANNE'S BAR
LOCATED AT 131 1/2 EAST HUNTINGTON DRIVE.
BACKGROUND
.
On November 5. 1984 the City of Arcadia Business license
Review Board held a notlced hearing in oraer to recelve
evidence pertaining to compliance with the conditions of
approval of the Game Machlne Permit for Roxanne's Bar. In
attendance at said hearing were representatives from the
City of Arcadla Police and Fire Departments. the City
Attorney, Mr. & Mrs. Wilburn (the owners of Roxanne's Bar),
Mr. Gary Michaells. and the members of the City of Arcadia
Business License Review Board.
The pur~ose of the hearing was to recelve and conSlder
evidence of failure to comply with the conoltlons of
approval of a Game Machine Permlt for the operatIon of
arcade devices. Failure to comply fully with all of the
conditions of approval constitutes grounds for the
revocation of the Game Machine Per~lt.

Based on the findings set forth above, the City of Arcadla
Business License Revlew 80ard flnds that the condltions of
approval of the Game ,"1achine Per""t hav" not been fully
complied with. and recommends that Sdld Gd~e :~dchlne ?er~lt
be revoked pursuant to the provislons of Cond1tlon :lo. 10 oi
