'&J 1;eY-? o a I v I rJI'\L-- ----- PLANNING COMMISSION RESOLUTION 1284 A RESOLUTION GRANTING CONDITIONAL USE PERMIT 85-4 TO EXPAND THE EXISTING AUTOMOBILE DEALERSHIP AT 333-421 EAST HUNTINGTON DRIVE BY CONSTRUCTING A NEW SHOWROOM WHEREAS, on March 4, 1985, an application was filed by Arcadia AMC/Jeep/Renault Dealership to expand the exi sting automobile dealership by constructing a new showroom, Planning Department Case No. C.U.P. 85-4, on property commonly known as 333-421 East Huntington Drive, more particularly described in attached Exhibit "A". WHEREAS, a public hearing was held on March 26,1985 at which time all interested persons were given full opportunity to be heard and to present evi de nce: NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS; Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds; 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not ~ave a substantial adverse impact on the environment. . . . Sect ion 3. That for the foregoi ng reasons this Commission grants a Conditional Use Permit for the expansion of the existing automobile dealership by constructing a new showroom upon the following conditions: 1. That the following conditions as set forth by the Public Works Division shall be complied with to the satisfaction of the Director of Public Works: a. Provide all necessary easements and install all utilities unde rground. b. The parkway width on Huntington Drive is fifteen (15) feet. c. The subject property is served by a sewer line that is tributary to a deficient City trunk sewer line. However, based on past charges paid by the property owner and considering the future chrages that will be paid, in time these payments will provide the property's share of the costs necessary for taking care of downstream sewer line deficiencies. 2. That the applicant provide a 5'-0" wide landscape buffer extending from the westerly end of the existi ng planters easterly to the Los Angeles County Flood Control right-of-way. Said landscape buffer may be located either on the applicant's property or on the public right-of-way immediately adjacent to the applicant's property, if such location and installation is approved by Cal Trans. If the landscape buffer is to be located in the public right-of-way, all of the existing asphalt sidewalk areas located between the landscape buffer and the curb shall be replaced with cement sidewalks, to the satisfaction of the Director of Public Works. Also, if the landscape buffer is located in the public right-of- way, the applicant: (1) shall have no vested right to the use of said right-of- way; (2) shall provide insurance to the satisfaction of the City Attorney; (3) shall maintain such landscape buffer to the satisfaction of the Director of Planning; (4) that such landscape buffer improvements shall not be considered as adding to the value of the adjacent private property in the event of acquisition by the City of Arcadia or Arcadia Redevelopment Agency, and there shall be no compensation paid for such improvements. (This condition is per the City Council's amendment of 5/7/85) 3. That the Planning Commission recommends that the City Council grant a modification for the interior landscaping to be less than the 10% required by code. -2- 1284 . . . 4. That an irrigation and landscape plan indicating the plant species, quantities, location, sizes, etc. shall be submitted to the Planning Department for its review and approval prior to issuance of the building permit. Said plan shall include: (1) the seven (7) potted plants to be located in the existing canopy area, (2) the 5'-0" landscape buffer along the easterly portion of the property adjacent to Huntington Drive and (3) the planter area around the pole sign as required in M-84-76. 5. That these landscaped areas shall be canpleted prior to occupancy of the showroom and shall be maintained as long as the dealership is in operation. 6. That all new signs shall comply with code. 7. That the planter wall adjacent to Huntington Drive shall be repaired. 8. That C.U.P. 85-4 and P.P.R. 85-1 shall not take effect until owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the condi tions of approval. Sect ion 4. BUTLER ASSOCIATE PLANNER GENERAL INFORMATION APPLI CANT: LOCATION: REQUEST: LOT AREA: FRONTAGE: EXISTING LAND USE & ZONING: SURROUNDING LAND USE & ZONING: GENERAL PLAN DESIGNATION: Arcadia AMC/Jeep/Renault Dealership (Robert and Bruce Low) 333-421 East Huntington Drive Conditional use permit and precise plan review to expand the existing automobile dealership by constructing a new showroom. 175,151 square feet (4.02 acres) 582' on Huntington Drive The subject site is developed with the Arcadia Datsun, AMC, Jeep and Renault dealership; zoned CPD-l North: South: East: Vacant; zoned CPD-l Mixed commercial and office uses; zoned CPD-l Santa Anita Wash and recreational vehicle storage area; zoned CPD-l Automobile body shop and mixed residential uses; zoned CPD-l West: Planned Development Area 1 PROPOSAL AND ANALYSIS The applicant is proposing to construct a 2,332 sq. ft. showroom incorporating part of the existing office building located on the easterly portion of the site. The building will be constructed of slump block with tinted glass windows and will have a spanish tile roof. An open wood trellis will be located along the front of the building. . . . (' ( The structure will be approximately 19'-0" in height. Landscaping is proposed around the east, west and north perimeter of the building. The building elevation on Sheet "3" notes "dealership identification sign". The CPD-1 zone allows wall signs not to exceed two square feet per linear foot of building front. Based upon the code requirements, this building would be allowed 100 sq. ft. of signing. The area allocated for the dealership identification sign as illustrated on Sheet "3" is approximately 236.5 sq. ft. The CPD-1 zone requires a minimum of 10% of the site to be landscaped with a minimum of 3% of the required landscaping to be located in the parking area. The code also requi res that there shall be street side setbacks of 10' and that the "required street side setbacks shall be landscaped except those areas util ized for driveways and wal kways". The City Counci 1 may. by majority vote grant modifications to the CPD-1 requirements. In 1976 the Planning Commission and City Council approved C.U.P. 76-17 to expand the existing automobile dealership. One of the conditions of approval of this conditional use pennit was that "landscape planters or pots shall be provided along the Huntington Drive frontage where planters do not exist. Said planters or pots shall be subject to the approval of the Planning Department and shall be installed within three months. If this condition is not complied with, the conditional use pennit shall be tenninated." The applicant did place pots with planting adjacent to Huntington Drive where the existing canopy area is located. Currently there is only one pot with a tree and this is located under the canopy. The canopy area is approximately 130' long. A minimum of one pot for every 20' should be located within this area (7 pots) adjacent to the Huntington Drive property line. A landscape planter is located midway on the property adjacent to the Huntington Drive property line. A portion of the planter wall is in need of repair. The remaining easterly portion of the site has no buffer between the parking area and the street. As noted previously, the CPD-1 zone requires a minimum 10'-0" landscape buffer along the property line. Staff would recommend that a 5'-0" landscape buffer be provided adjacent to Huntington Drive. A 5'-0" landscape buffer would not interfere with the parking area and the 6" curb which is required around the planting area could be used as a wheel stop which would allow cars to part ially overhang in this area and at the same time provide adequate space to plant shrubs. The Downtown Revitalization Plan which is currently being reviewed by the City recommends that "Except for driveways, parking lots should be enclosed and screened. On major streets, buffers incorporating planting and landscaping shall be maintained. Screening elements should not be less than 3' or greater than 4' in height." However, because of the unique nature of this business, lower landscaping could be provided similar to that at Foulger Ford. CUP 85-4 AND PPR 85-1 March 26", 1985 rage 2 . . . ( ( Providing the 5'-0" landscape buffer would be a step towards complying with the goals set forth in the Downtown Revitalization Plan and would provide minimum screening and landscaping. On June 25, 1984, a modification was granted allowing sign on the site (this is the AMC/Jeep/Renault sign). allowing this sign was that a planter a minimum of 2' built around the pole sign. This property is within the redevelopment area and design review by the Agency will be necessary. an additional free standing A condition of approval in to 3' in height was to be PRECISE PLAN REVIEW As per the CPD-1 Ordinance, this zone is "intended to promote appropriate commercial land uses and encourage the highest possible quality of design and environment, to coordinate developments on adjacent parcels of property, in order to achieve a functionally and visually integrated development." The design of this building is consistent with the design of the Embassy Suites hotel which has a Spanish-Mediterranean treatment. Staff has reviewed the plans and elevations and believes that the proposed project complies with the architectural considerations set forth in the precise plan review procedure. The findings of the Planning Commission will be forwarded to the City Council. The Council is required to hold a noticed hearing and will consider the Commission's findings and any public testimony before acting on the Precise Plan. The proposed plans have been reviewed by the Redevelopment Agency staff and their comments are attached. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATION The Planning Department recommends approval of C.U.P. 85-4 and 'PPR 85-1 subject to the following conditions: 1. Conditions as outlined in the attached report from the Department of Public Works shall be complied with to the satisfaction of the Director of Public Works. FINDINGS AND MOTIONS Approval If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the envi ronment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report (or as modified by the Commission). Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and findings in support of that decision.
