PLANNING COMMISSION RESOLUTION NO. 1283 A RESOLUTION GRANTING CONDITIONAL USE PERMIT 85-3 FOR THE CONSTRUCTION AND OPERATION OF AN EATING ESTABLISHMENT WITH A DRIVE-THROUGH WINDOW AT 82 WEST LAS TUNAS DRIVE. \oIl-tEREAS, on February 19, 1985 an application was filed by Burger King Corporation (Eddie Harrison, Jr.) to construct and operate an eating establishment with a drive-through window, Planning Department Case No. C.U.P. BS-3, on property commonly known as 82 West Las Tunas Drive, more particularly described as follows: The westerly 145.00 feet, measured at right angles, of that portion of Lot 69 of Santa Anita Colony, in the City of Arcadia, County of Los Angeles, State of California as per Map recorded in Book 42, Page 87 of Miscellaneous Records in the Office of the County Recorder of said County described as follows: Beginning at the intersection of the westerly line of said lot with a line parallel with and 50 feet southerly, measured at right angles from the northerly line of said lot; thence easterly along said parallel li ne North 890 03' 25" East 0.01 feet to the beginni ng of a tangent curve concave southerly havi ng a radius of 450.00 feeto thence easterly along said curve through a central angle of 14 00' DO" a distance of 109.96 feet; thence tangent to said curve South 760 56'35" East 380.05 feet to the beginning of a tangent curve concave westerly having a radius of 25.00 feet; thence southerly along said curve through a central angle of 1570 01' 50" a distance of 68.52 feet to its point of tangency with a line which is para11el with and 50.00 feet norSherly of the southerly li,ne of said Lot 69; thence South 80 05' 15" West along said parallel &ine 481.45 feet to the westerly line of said lot; thence North 0 55' 35" West along said westerly line 229.32 feet to the point of beginning. WHEREAS, a public hearing was held on March 12, 1985, at which time all interested persons were given full opportunity to be heard and to present evide nce; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: .. . -. . .. .' .\" 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. and all yards, spaces, walls, fences, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the ki nd of traffic generated by the proposed use. 5. That the granting of such Conditional Use Pennit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment. 7. The proposed use will not substantially increase vehicular traffic on any street in a residentially zoned district. 8. The proposed use will not lessen the suitability of any nearby commerci ally zoned property for commerci al use by interferi ng with pedestrian traffic. 9. The proposed use will not create increased traffic hazards to pedestrians when located near a school, church, auditorium. theater or other place of assembly. Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit for the construction and operation of an eating establishment with a drive-through window upon the following conditions: 1. Conditions as outlined in' the report from the Department of Public Works dated February 26,1985 pertaining to C.U.P. 85-3 shall be complied with to the satisfaction of the Director of Public Works. 2. That the following modifications be granted: A. 51parking spaces in lieu of 55parking spaces. 8. Deletion of wheel stop for one parki ng space. C. A free-standing sign shall be permitted on each of Las Tunas Drive and Live Oak Avenue. Each of these signs shall not exceed 150 square feet of sign area. 2 1283 .' "\ . e . 3. Maximum occupancy shall not exceed Fire Department requirements. 4. Directional signing shall meet with the approval of the Public Works Depa rtment. 5. A landscape and irrigation plan shall be submitted to the Planning Department for its review and approval prior to issuance of any building permits. A benned landscaped buffer not less than 5'-3" in width and 35" in total height (measured at the top of the landscape materials) shall be provided between parking areas and property lines which are located between said parking areas and public street. The playground shall be subject to the review and approval of the Planning Department which includes but is not limited to the follawi ng: A. Height, location and materials of wall or fence. B. Type, height and location of play equipment and structures. C. Plans shall be submitted accurately delineating the playground area, equipment, structures and benches. g. Walls along the east and west property lines shall not exceed 3'-0" in height, 15'-0" back from the north and south property lines. 10. The eating establishment shall be maintained as per the plans on file in the Planning Department. 11. No vehicles may be parked on the premises and offered for sale, lease or rent. 12. That C.U.P. 85-3 shall not take effect until owner and applicant have executed a fonn available at the Planning Department indicating awareness and acceptance of the condi tions of approval. WONG ASSISTANT PLANNER On March 12, 1985 the Plannin9 Commission voted 7 to 0 to approve Conditional Use Permit 85-3, a request to construct and operate an eatin9 establishrrent with a drive-through window at 82 West Las Tunas Drive. Since the Commisison's meeting, the applicant discovered the proposal reflected old lot lines and not the actoal parcel, which is approximately 57'-0" less in width. A revised design has been submitted, the original proposal. Following is , which is basically a scaled-down version of a comparison of the two proposals: ORIGINAL REVISED A. 7D Parking spaces in lieu of 75 spaces. 51 Parking spaces in lieu of 55 spaces. B. " The building's first floor square footage of 2,551 square feet required 51 parki ng spaces. An additional 199 square feet can be found in a storage mezzanine. RECOMMENDATION The Planning Department recOOlmends that the Planning Commission approve the revised plan and amend Section 3.2.A of Resolution 1283 to read "51 parking spaces in lieu of 55 parking spaces". FINDINGS AND MOTIONS Approval If the Planning Commission intends to take action to approve the revised plan, the COOlmission should move to approve the revised plan an~ amend Section 3.2.A., of Planning Commission Resolution No. 1283 to read "51 parking spaces in lieu of 55 parking spaces". New Hea ri ng If the Planning Commission detennines that the proposed plans are a significant alteration from the original proposal, a new public hearing should be scheduled before the Planning Commission at its next meeting of April 23rd for review of the revised plan. c. u. Huntington Drive Arcadia, CA 91006 RE: PROPOSED BURGER KING SITE Live Oaks & Las Tunis Arcadia, CA Gentlemen: The proposed location site plan has been adjusted to the proper size as per the 31,000 square feet. The previous site plan was drawn from the old survey and did not reflect the new parce size. Therefore. the new layout has been adjusted accurately. e Also, the proposed site plan has been adjusted to reflect the accurate survey and parcel map. The proposed layout has been adjusted to reflect the Conditional Use Permit approval of March 12, 1985 in proportion, so that all conditions and requirements will remain the same. Therefore, in this adjustment, the building had to be reduced in size to accommodate the number of required parking stalls at 55. In proportionate to the previous plan of 75 required and granted at 70 versus 55 to 51 actual. Please review the attached plan and building and floor plans. You will find there is no change respectively to the re- quirements granted previously. Thank you for your cooperation in this matter.
