'. -c\-' , > PLANNING COMMISSION RESOLUTION 1282 A RESOLUTION GRANTING CONDITIONAL USE PERMIT 85-2 TO OPERATE A RESTAURANT AND DELICATESSEN AT 1212-1216 SOUTH BALDWIN AVENUE WHEREAS, on February I, 1985, an application was filed by Richard Morreale on behalf of Anthony's Italian Gourmet to operate a restaurant and a delicatessen, Planning Department Case No. C.U.P. 85-2, on property commonly known as 1212-1214 South Baldwin Avenue, more particularly described as follows: Lot 2, Tract 5659 in the City of Arcadia, County of Los Angeles, State of California as per Map recorded in Map Book 115, Page 100 in the County Office. WHEREAS, public hearings were held on February 26 and March 12, 1985, at which time all interested persons Were given full opportunity to be heard and to present evide nce; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Pennit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. _:,That the grantin9 of such Conditional Use Pennit will not adversely affect the'~omprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment. " . ~ . . " Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit for the operation of a restaurant and delicatessen upon the followi ng condi tions: 1. That the parking area adjacent to the building shall be striped as per Section 9269.8 of the A.M.C. Said plan shall be submitted to the Planning Department for its review and approval prior to restriping. The restriping shall be completed 30 days after approval of this Conditional Use Permit. 2. That the mechanical equipment on the new addition shall be screened from public view to the satisfaction of the Planning Department. Said screening shall be completed within 30 days ,after approval of this Conditional Use Permit. 3. That the seating for the delicatessen shall be limited to 35 persons and the seating for the restaurant shall be limited to 54 persons. 4. That C.U.P. 85-2 shall not take effect until the owner and applicant have executed a fonn available at the Planning Department indicating awareness and acceptance of the conditions of approval. Section 4. GENERAL PLAN Comme rci a 1 DESIGNATION HISTORY The delicatessen has been operating at this location since August, 1973. On January 21, 1975, a Conditional Use Permit 74-25 was granted to operate a delicatessen and outdoor eating establi stment. with limited amount of indoor seati ng. In August, 1977, Conditional Use Pennit 77-15 (filed by Anthony Rogers) was granted to Anthony's Delicatessen to enclose the outdoor patio area and construct customer restroans. Construction was never begun and the application expired. - . . The business was subsequently sold to Richard Morreale who filed for C.U.P. 82-11 to enclose the outdoor eating area and to provide customer restroOOls. This conditional Use Permit was granted in July, 1982. The total seating was for 35 people. It was noted in the Planning Department's report that enclosing the outdoor eating area would not substantially increase the number of customers patrionizing the delicatessen. On June 14,1983, the Planning COOlmission granted a six month time extension to January 20, 1984. No improvements were made by the January 20th date and this application expired. In September, 1984, a building permit was issued to enclose the patio area for a "retail addition at the rear of the building" This addition was fina1ed on February 13, 1985. During a visit to the site on January 22, 1985, staff noted that a separate restaurant use was in operation as well as the delicatessen. On said date a letter was sent to Anthony's Italian Gourmet advising them that the restaurant use was in violation of the conditional use permit to operate the delicatessen and that the restaurant use must be terminated and several other violations were to be corrected. As of this date, the restaurant is still in operation. REQUEST The applicant is requesting a conditional use permit to operate a restaurant with a seating capacity for 54 persons, a delicatessen with a seating capacity for 35 persons and a retail estab1ishnient The building contains approximately 5,376 sq. ft. The restaurant dining area occupies approximately 1,110 sq. ft., the delicatessen eating area occupies approximately 1,010 sq. ft. and the retail, kitchen area, storage areas and res troOOlS occu py the rema i ni ng po rt i on of the buil di ng. Both the restaurant and delicatessen are open for lunch and dinner. PARKING There are 6 parking spaces located directly behind the building. However, these spaces need to be restriped. Anthony's and the other businesses along the east side of Baldwin Avenue between Duarte Road and Naomi Avenue are served by a parking area containing 191 spaces located to the rear of said businesses. Anthony's Gourmet Delicatessen is allocated, by lease agreement, 12 parking spaces for customers in this parking area. This would provide a total of 18 parking spaces designated for the use of the del icatessen/restaurant. If parking is based upon the parking requirements for a restaurant use (not including the kitchen area, restrooms, storage, etc.), delicatessen use (eating establishment) and the retail area, 49 parking spaces would be required. There is a parking deficiency of 31 spaces (63%). C.U.P. 85-2 February 26, 1985 Page 2 -- . . ANAL YSIS A restaurant and an eating establistment are pennitted uses in the C-2 zone with an approved conditional use permit. The addition of the restaurant is a substantial change in the use of the site from what was approved in 1982 (the expansion of the delicatessen). It is our experience that an eating establistment has a fast turn-over of customers. Persons patron,izi ng a restaurant generally stay longer and therefore there is a slower turnover of customers. It is the Planning Department's opinion that the combination of the two uses at this locatipn will create a greater need for parki ng spaces. The parking lot servicing the businesses in this area is heavily trafficked during the lunch hours. Staff has visited the site several times during the peak business hours (lunch time) and on these visits the parking lot has been approximately 80% occupi ed. The applicant has stated in his application that 75% of their patrons walk to 1 unch from surroundi ng busi nesses and offices, or pick up "take-out" 1 unches for ot hers. However, it is our experience that if a restaurant is a quality restaurant, business will be generated not only from the immediate area but from other locations within and outside of the City. An increase in traffic to this site during the lunch hours could greatly impact this parking area. It is staff's belief that to approve the operation of the restaurant as well as the delicatessen during the lunch hours may adversely effect the other businesses who share this parking area. Staff woul d recoollnend approval of the cont i nued operat i on of the deli catessen during the lunch and evening hours and recommend, that the hours of operation of the restaurant be limited to the evening hours only (after 5:00 p.m.) , during the week. ' Pursuant to the provisions of the California Envirormental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora; fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. R ECOMME NDA TI ON The Planning Department recommends approval of C.U.P. 85-2 subject to the following conditions: C.U.P. 85-2 February 26, 1985 Page 3 - . . 1. That restaurant shall not open until 5:00 p.m. on weekdays. On weekends the restaurant may be open to serve lunches. 2. That the parki ng area adjacent to the buildi ng shall be striped as per Section 9269.8 of the A.M.C. Said plan shall be submitted to the Planning Department for its review and approval prior to restriping. The restriping shall be completed 30 days after approval of this Conditional Use Permit. 3. FINDINGS AND MOTIONS Approval If the Planning Commission intends to take action to approve this project. the Canmission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the envi ronment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report (or as modified by the Canmission).
