PLANNING COMMISSION RESOLUTION 1279 A RESOLUTION GRANTING CONDITIONAL USE PERMIT 84-25 FOR THE OPERATION OF A RESTAURANT AT 1121-1123 WEST HUNTINGTON DRIVE WHEREAS, on December 24, 1984, an application was filed by Dah-Weih Lee to operate a restaurant, Planning Department Case No. C.U.P. 84-25, on property comnnnly known as 1121-1123 West Huntington Drive, more particularly described as follows: Lot 3, Tract No. 14846, in the City of Arcadi a, County of Los Angeles, State of California, as per map recorded in Book 314, Pages 8 and 9 of Maps, in the office of said County Recorder. WHEREAS. a public hearing was held on January 15, 1985, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granti ng of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. " 'tt . . .. 6. That for the Conditional Use Permit for the impact fo regoi ng operation reasons this Commission grants a of a restaurant upon the following condi t ions: L That a modification is granted for 1,620 parking spaces in lieu of 1.639 spaces. 2. The restaurant shall comply with all relevant Fire and Building Code regulations. 3. That the restaurant shall be maintained as per the plans on file in the Planning Department. 4. That C.U.P. 84-25 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of January 15, 1985 and the following vote: AYES: NOES: ABSENT: Section 5. and shall cause a Arcadi a. Proposal requires a modification for 1,620 parking spaces in lieu of 1,639 spaces. 541,450 square feet (12.43 acres) This includes May Company and E1 Rancho Shopping Center The site is deve10ped with the E1 Rancho Market, mixed retail and office uses. a bank and the May Company Department Store. North: Single-family dwellings; zoned R-l & D West: Offices and sing1e-fami1y dwellings; zoned C-O and R-1 South: Multiple-family dwellings; zoned R-3 East: Single-family dwellings, multiple family dwellings and offices; zoned R-1 and C-O. Comme rci a 1 1,620 parking spaces are provided on the site; 1,350 within the parking structure and 27D spaces around the El Rancho Shopping Center. . PROPOSAL/ANALYSIS The applicant is proposing to convert 4,968 square feet of retail space into a restaurant. In 1981 the E1 Rancho Shopping Center was completely remodeled. A restaurant is a permitted use in the C-2 zone with a conditional use permit. It is staff's opinion that the restaurant would be an appropriate use for the site and that the parking deficiency of 1.2% (19 spaces) is insignificant. C.U.P. 84-25 1/15/85 page 2 . . . Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse ,change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. REC()IMENDATION The Planning Department recommends approval of C.U.P. 84-25 subject to the fo 11 ow; ng condi t ions: 1. That a modification is granted for 1,620 parking spaces in lieu of 1,639 spaces. 2. The restaurant shall comply with all relevant Fire and Building Code regulat ions. 3. That the restaurant shall be maintained as per the plans on file in the Planning Department. 4. That C.U.P. 84-25 shall not take effect until the owner and appl icant have executed a farm available at the Planning Department indicati ng awareness and acceptance of the conditions of approval. FINDINGS AND MOTIONS Approva 1 If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the envi ronment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report (or as modified by the Commission). Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and findings in support of that decision.
