A RESOLUTION GRANTING CONDITIONAL USE PERMIT 84-23 FOR THE
EXPANSION OF AN EXISTING PRESQ-IOOL OPERATION AT 103 WEST LAS
TUNAS ffi I VE.
~. WHEREAS, on October 17, 1984 an appl ication was fi led by Susan M. and Lee
R, Searing to expand an existing preschool operation by constructing a 240 square
foot addition, permitting 40 children, Planning Department Case No. C.U.P. 84-23,
on property commonly known as 103 West Las Tunas Drive, more particularly
descr i bed as fo' lows:
Lot 35, Tract 13540, in the City of Arcadia, County of Los
Angeles, State of Cali fornia, as per Map recorded in Book
277, Pages 11 and 122 of Maps in the Office of said County
Recorder.
WHEREAS, a pub I ic heari ng was hel d on November 13, 1984, at wh ich time all
interested persons were given ful I opportunity to be heard and to present
evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY
RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning Department in
the attached report is true and correct.
Section 2. This Commission finds:
1. That the grant i ng of such Cond i t ion a I Use Permi t wi II not be
detrimental to the public health or welfare, or injurious to the property or
improvements in such zone or vicinity.
2. That the use applied for at the location indicated is properly one
for otlich a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate sa id use, and all yards, spaces, wall s, fences, parki ng, loadi ng,
landscaping and other features required to adjust said use with the land and uses
in the neighborhood.
4. That the site abuts streets and highways adequate in width and
pavement type to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit wi I I not adversely
affect the comprehensive General Plan.

6. That the use applied for will not have a substantial adverse impact
on the environment.
Section 3. That for the foregoing reasons this Commission grants a
Conditional Use Permit for the expansion of the preschool upon. the fol lowing
cond i t ions:
1. That a trash enclosure be constructed of Iohich three sides shall
consist of six foot high sol id masonry walls and a sol id oooden or rretal gate.
The location of said trash enclosure shall be subject to the approval of the
Planning Departrrent.
2. That ingress be situated on the easterly drive
egress be situated on the wester I y dr ive of the property.

3. That all signs shall comply with Code Section 9275.3.9, Iohich states
that no more than one unl ighted sign containing a maximum of four square feet in

4. That the existing landscaping be permanently irrigated and maintained
(C.U.P. 77-i9).
5. The hours of operation shall be 6:30 a.m. to 6:00 p.m., weekdays only
(Monday through Fr i day) .
6. The preschooi shal I be limited to a maximum of 40 children upon the
property at anyone time.
7. No play equipment in excess of 5 feet in height shal I be located
withi n 3 feet of any masonry wall along the property lines.
8. The preschool shall comply with all requirements of the Fire
Department.
9. The preschool shall be maintained as per the plans on fi Ie in the
Planning Department. Play equipment may be added or moved on the site as long as
Condition Number 7 is complied with.
10. That C.U.P. 84-23 shall not take effect unti I owner and appl icant have
executed a form avai lable at the Planning Departrrent indicating aloBreness and
acceptance of the conditions of approval.
Section 4. The decision, findings and conditions contained in this
Resolution reflect the Commission's action of November 13, 1984 and the fol lowing

In September 1977 CU.P. 77-19 was approved pennitting the operation of a
preschool at 103 West Las Tunas Drive. The applicant is proposing a 240 square
foot addition onto the preschool to allow an additional six chil dren, for a total
enrollment of forty children.

The preschool will continue as a daily operation, excluding weekends, from
6;JO a.m. to 6:00 p.m. Surrounding the outdoor recreational area is a o'-b' to
6'-U" high solid block wall. The 5'-6" high block wall along the easterly
property line was approved by C U.P. 77-19.

The zoning ordinance pennits a preschool in any zone with an approved conditional
use pennit. If enrollment is increased the preschool will comply with the
requirements for 75 square feet of outdoor play area (approxlmately 12U square
feet provided) and 35 square feet of indoor play area (39 square feet provided).
As required the preschool has a circular driveway for loading and unloading of
children. There are four parking spaces on the site, which will accommodate the
requirement for one parking space for each employee regularly employed upon the
premises. The applicant has noted that the preschool will still be below the
State requirements of one adult for every twelve children.
A site inspection by staff found a refuse bin unscreened from public view. The
C~O zone requires an enclosure of which three sides consist of six foot high
decorative masonry walls. Refuse shall be completely screened from public view.
Find attached the site plan, floor plan and elevations.
pursuant to th~ provisions of the California Environmental Quality Act, the
Planning Department has prepared an initial study for the proposed project.
Said initial stUdy did not di sclose any substantial or potentially substantial
adverse change in any of the physical conditions within the area affected by the
project including land, air, water, minerals, flora, fauna, ambient noise, and
objects of historical or aesthetic significance. Therefore, a Negative
Declaration has been prepared for this project,
RECOMMENDATION
The Planning Department recommends approval of C.U.P. H4-23 subject to the
following conditions:
1.
That a trash enclosure be constructed of which three sides shall
consist of six foot high solid masonry walls and a solid wooden or
metal gate. The location of said trash enclosure shall be subject to
the approval of the Planning Department.
That ingress be situated on the easterly drive of the property and
egress be situated on the westerly drive of the property. Directional
signs and the words "IN" and "OUT" shall be painted on the driveway
for proper ingress and egress (C.U.P. 77-19).

FINDINGS AND MOTIONS
. Approval
If the Planning Commission intends to take action to approve this project, the
Commission should move to approve and file the Negative Declaration and find
that the project will not have a significant effect on the environment and
direct staff to prepare the appropriate resolution incorporating the specific
findings and conditions of approval set forth in the staff report (or as
modified by the Commission).
