A RESOLUTION GRANTING CONDITIONAL USE PERMIT
84-22 TO CONSTRUCT AND OPERATE A HEALTH CLUB,
AND FOR A MODIFICATION TO PERMIT WINDOW
OPENINGS FACING ABUTTING RESIDENTIALLY ZONED
PROPERTY AT 301-317 EAST FOOTHILL BOULEVARD.
WHEREAS, on October 3, 1984 an application was filed by
Sam Falzone to construct and operate a health club and for a
modification to permit window openings facing abutting
residentially zoned property, Planning Department Case No.
C.U.P. 84-22, on property commonly known as 301-317 East
Foothill Boulevard, more particularly described in attached
Exhibit A.

WHEREAS, a public hearing was held on October 23, 1984
at which time all interested persons were given full
opportunity to be heard and to present evidence.
WHEREAS, pursuant to review of the record including
staff reports and testimony, the Planning Commission
directed preparation of this Resolution to reflect their
decision and findings.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:

Section 1. That the factual data submitted by the
Planning Department in the attached report is true and
correct.
Section 2. This Commission finds that:
1. The granting of such Conditional Use Permit and
modifications will not be detrimental to the public health
or welfare or injurious to the property or improvements in
such zone or vicinity.
2. That the use applied for at the location indicated
is properly one for which a Conditional Use Permit is
authorized.
3. That the site for the proposed use is adequate in
size and shape to accomodate said use, and all yards,
spaces, walls, fences, parking, loading, landscaping and
other features required to adjust said use with the land
uses in the neighborhood.
4. That the site abuts streets and highways adequate
in width and pavement type to carry the kind of traffic
generated by the proposed use.
5. That the granting of such Conditional Use Permit
will not adversely affect the comprehensive general plan.

6. The use applied for will not have a substantial
adverse impact on the environment.
Section 3. For the foregoing reasons this Commission
grants a Conditional Use Permit for a health club upon the
following conditions:
1. That the following shall be complied with to the
satisfaction of the Director of Public Works:
a. C~ose existing driveways not to be used and
construct new P.C.C. driveway apron according
to City of Arcadia Standard Drawing No. S-ll.
b. Submit a drainage and grading plan prepared
by a registered civil engineer.
c. If a lot consolidation is required, this
department may require conditions of approval
in addition to those listed above.
2. That fire protection shall be provided to the
:satisfaction of the Fire Chief.
3. That a modification is granted for window openings
facing abutting residentially zoned property.

4. That prior to any building permits being issued for
the construction of the proposed development, that a
Tentative Parcel Map, consolidating the lots, be filed for
the subject site, or a covenant (in a form and content to
meet with the approval of the City Attorney) shall be
recorded in the Office of the County Recorder, which agrees
to hold all the lots as one and agrees to provide all
necessary dedications and easements.
5. That the site shall be maintained as per the plans
on file in the Planning Department.
6. That C,U.P. 84-22 shall not take effect until the
owner and applicant have executed a form available in the
Planning Department indicating awareness and acceptance of
the conditions of approval.
Section 4. The decision, findings and conditions
contained in this Resolution reflect the Commission's action
of October 23, 1984 and the following vote:

Section 5. The Secretary shall certify to the adoption
of this Resolu~ion and shall cause a copy to be forwarded to
the City Council of the City of Arcadia.

The southerly 135 feet of the subject site is zoned C-2 and
the northerly 113.28 feet is zoned PR-l.
Three lots make up the site. A 25 foot wide road and
utility easement serves the four landlocked single-family
dwellings nortn of the site (see site plan and land use and
zoning map).

4It PROPOSAL
The applicant is proposing to clear the site and construct
two 2-story buildings approximately 27'-0" in height, with a
total of 23.659 square feet.
Building "A" (the westerly building) is proposed to contain
a 6,398 square foot health club and 4,612 square feet of
office use.
Building "B" (the easterly building) is proposed to contain
a 3,566 square foot financial institution and 9.084 square
feet of office use.
One hundred eight parking spaces are proposed for the
development, with ingress and egress from Foothill Blvd.
There is an existing six foot high masonry wall separating
the site from the adjoining residential uses.
ANALYSIS
.
Two prior modification applications (M-83-52 and M-83-1D7),
were approved by the Planning Commission granting similar
modifications for window openings onto abutting
residentia1~y zoned property. Because of the
reconfiguration of the buildings, the window openings again
need to be considered as a part of this application.
The south. east and west elevations of building "A" &
"B"comply with code since they face C-2 zoned property.
Windows and open stairways along the north elevation of
bui 1ding "A" wi 11 be approximately 107 feet from the R-1
zoned lots.
Windows and open stairways along the north elevation of
building "B" will be approximately 45 feet from the PR-l
zoned residential property north of the alley.
The proposed development has the buildings located along
Foothill Blvd., providing as much separation as possible
from the abutting residential uses.
A health club is a permitted use in a C-2 zone,with an
approved Conditional Use Permit.
Parking has been provided in compliance with code, and with
the anticipated late afternoon and evening peak hours of
operation for the health club, the Planning Department does

not forsee any significant parking problems if this
Conditional Use Permit is approved.
Pursuant to the provisions of the California Environmental
Quality Act, the Planning Department has prepared an Initial
Study for the proposed project. Said Initial Study did not
disclose any substantial or potentially substantial adverse
change in any of the physical conditions within the area
affected by the project including land, air, water,
minerals, flora, fauna, ambient noise, and objects of
historical or aesthetic significance. Therefore, a Negative
Declaration has been prepared for this project.
RECOMMENDATION
The Planning Department recommends approval of Conditional
Use Permit 84-22, subject to the following conditions:
1. Conditions as outlined in the attached report from
the Department of Public Works shall be complied
with to the satisfaction of the Director of Public
Works.
2. That a modification be granted for window openings
facing abutting residentially zoned property.
3. That prior to any building permits being issued for
the construction of the proposed development, that

staff to prepare the appropriate resolution incorporating
the specific findings and conditions of approval set forth
in the staff report (or as may be modified by the
Commission).
Denial
If the Planning Commission intends to take action to deny
this project, the Commission should move to deny and direct
staff to prepare an appropriate resolution incorporating the
Commission's decision and findings in support of that
decision.

1. The existing parkway width is twenty (20) feet on Foothill Boulevard.
2. The subject property is served by a sewer line that has the capacity to
transport sewage flows generated in accordance with land use reflected in
the City's current general plan to the CSD system.
