PLANNING COMMISSION RESOLUTION 1269
A RESOLUTION GRANTING CONDITIONAL USE PERMIT 84-15 FOR THE
EXPANSION OF AN EXISTING RESTAURANT AT 1440 SOUTH BALDWIN
AVENUE.
WHEREAS, on July 19, 1984 an application was filed by Big Boy Restaurants of
America to expand their existing restaurant, Planning Department Case No. C.U.P.
84-15. on property commonly known as 1440 South Baldwin Avenue, more particularly
described in Exhibit "A".
WHEREAS, a public hearing was held on August 14, 1984, at which time all
interested persons were given full opportunity to be heard and to present
evi dence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY
RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning Department in
the attached report is true and correct.
Section 2. This Commission finds:
1. That the granting of such Conditional Use Permit will not be
detrimental to the public health or welfare, or injurious to the property or
. improvements in such zone or vicinity.
2. That the use applied for at the location indicated is properly one
for Which a Conditional Use Pernrit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use, and all yards, spaces, walls, fences, parking, loading,
landscaping and other features required to adjust said use with the land and uses
in the neighborhood.
4. That the site abuts streets and highways adequate in width and
pavement type to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not adversely
affect the comprehensive General Plan.
6. That the use applied for will not have a substantial adverse impact
on the environment.
Section 3. That for the foregoing reasons this Commission grants a
Conditional Use Permit for the expansion of the restaurant upon the following

1. That a modification be granted for a 46'~ setback from the center line
of Camino Real Avenue in lieu of 60' required.
2. That the maximum occupancy for the new addition shall not exceed 22
people as per the Fire Department's requirement
3. That additional landscaping be provided in the easterly planter area
and that a lanscaped plan for this area shall be submitted to the Planning
Department for its review and approval prior to issuance of a Building Permit.
4. That C.U.P. 84-15 shall not take effect until owner and applicant have
executed a form ava il abl e at the Planni ng Department i ndicati ng awareness and
acceptance of the conditions of approval.
Section 4. The decision, findings and conditions contained in this
Resolution reflect the Commission's action of August 14, 1984 and the following
vote:

Section 5. The Secretary shall certify to the adoption of this Resolution
and shall cause a copy to be forwarded to the Ci ty Council of the Ci ty of

Lot 5 of Tract No. 5907, in the City of Arcadia, County of
Los Angeles, State of California, as per Map recorded in Book
Page 67 of Maps, in the Office of the County Recorder of said
County.
Except the easterly 120 feet thereof.
Also except those portions described as follows:
The westerly 20 feet, measured at right angles to the
westerly lot line, and beginning at a point in the southerly
line of Lot 3, Distant 20.04 feet east of the westerly line of
said Lot 3, thence northerly along a line parallel with the
westerly line of said Lot 3, 16.00 feet to a point of tangency
to a curve concave to the northeast having a radius of 15 feet

In September, 1971, the Planning Commission adopted Resolution 751 granting
conditional use permit 71-15 for a Bob's Big Boy Restaurant on the subject
site.
PROPOSAL
The applicant is proposing to add a 279 sq. ft. addition to the existing 5,500
sq. ft. Bob's Big Boy Restaurant (total area will be 5,779 sq. ft.).This
propos.ed addition will be located along Baldwin Avenue.

There currently is seating for 135 persons. Four seats will be removed with
the new construction and 22 new seats will be added for a net total of 153
seats.
The exterior design of the new addition will be consistent with the existing
building.
There are 66 on-site parking spaces. Based on the parking requirements for a
restaurant, 58 parking spaces are required.
The landscaping in the easterly planter area is sparse and the area should be
fill ed in wi th some ground cover or other type of pl anti ng materi al .
There is a special setback along Camino Real of 60' from the center line of
the street (30' from the property 1 ine). The proposed addition will be set
back 16+' from this property line. This is consistent with the setback of the
exi sti ng buil di ng.
ANAL YSIS
It is staff's OplnlOn that this expansion would not be detrimental to the site
or the surrounding properties and that there is adequate on-site parking to
accommodate said expansion.
Staff does not have a problem with the encroachment into the special setback
along Camino Real Avenue since the new addition will maintain the same setback
as the existing building.
Pursuant to the provisions of the California Environmental Quality Act, the
Planning Department has prepared an initial study for the proposed project.
Said initial study did not disclose any substantial or potentially substantial
adverse change in any of the physical conditions within the area affected by
the project including land, air, water, minerals, flora, fauna, ambient noise,
and objects of historical or aesthetic significance. Therefore, a Negative
Declaration has been prepared for this document.
RECOMMENDATION
The Planning Department recommends approval of C.U.P. 84-15 subject to the
following conditions of approval:

awareness and acceptance of the conditions of approval.
FINDINGS AND MOTIONS
Approval
If the Planning Commission intends to take action to approve this project, the
Commission should move to approve and file the Negative Declaration and find
that the project will not have a significant effect on the environment and
direct staff to prepare the appropriate resolution incorporating the specific
findings and conditions of approval set forth in the staff report (or as
modified by the Commission).
Denial
If the Planning Commission intends to take action to deny this project, the
Commission should move to deny and direct staff to prepare an appropriate
resolution incorporating the Commission's decision and findings in support of
that decision.
