I PLANNING COMMISSION RESOLUTION NO. 1266 A RESOLUTION GRANTING CONDITIONAL USE PERMIT 84-14 FOR THE EXPANSION OF AN EXISTING PRESCHOOL OPERATION TO ALLOW AN INCREASE FROM 50 STUDENTS TO 80 STUDENTS. WHEREAS, on July 3, 1984 an application was filed by Temple Shaarei Tikvah AKA Foothill Jewish Temple and Center to increase preschool enrollment from 50 students to 80 students, Planning Department Case No. C.U.P. 84-14, on property commonly known as 550 South Second Avenue, more particularly described as follows: Portion of Block 60, Santa Anita Tract, in the City of Arcadia, County of Los Angeles, State of California, as per Map recorded in Book 34, Pages 41 and 42 of Miscellaneous Records, in the Office of sa i d County Recorder. WHEREAS, a public hearing was held on July 24, 1984, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCNJIA HEREBY RESOLVES AS FOLLOWS: . Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for Which a Conditional Use Permit is authorized. 3. That the si te for the proposed use is adequate in size and shape to accanmodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. . - 1 - 1266 , 6. That the use appl ied for will not have a substantial adverse impact on the environment. Section 3. That for the foregoing reasons this Commission grants a Conditional Use Pennit for the expansion of the preschool upon the following conditions: 1. That the enrollment of the preschool be limited to 80 students. Not more than 25 students shall be pennitted after 12:15 p.m. 2. The hours of operation shall be 8:45 a.m. to 6:00 p.m.,weekdays only, (Monday through Friday) 3. Not more than 40 students shall be pennitted in the outdoor recreation area at anyone time. 4. No structure, and no play equipment in excess of 5 feet in height shall be located within 3 feet of any masonry wall along the property lines. The existing storage shed along the north property line shall cOOlply with this regulation. 5. The outdoor 15' x 108' area enclosed by the 3'-9" block wall along Second Avenue shall not be used for any recreational activities (games or . sports). Only supervi sed activities shall be penni tted, 1 ike arts and crafts, class discussions and meals. Other pennitted activities shall be subject to the review and approval of the Planning Department. 6. The preschool shall comply with all requirements of the Fire Department. Property shall confonn to Health and Safety Code, Title 19 and Title 24 of the State Fire Marshal's Office (Group E Division I). 7. Landscaping along perimeter of the outdoor recreation area shall be maintained in perpetuity (adjacent to 500 South Second Avenue and 210 El Dorado Streets) as per C.U.P. 81-7 8. The preschool shall be maintained as per the plans on file in the Planning Department. Play equipment may be added or moved on the site as long as Condition Number 4 is cOOlplied with. 9. The existing chain link fence shown on the site/floor plan provided by the appl icant shall be replaced with wrought iron fencing. Fence material shall be subject to the review and approval of the Planning Department. - . - 2 - 1266 I . . 10. That C.U.P. 84-14 shall not take effect until owner and appl icant have executed a fonn available at the Planning Department indicating awareness and acceptance of the conditions of approval. Section 4. The decision, findings and conditions contained in this Resolution reflect the Canmission's action of July 24,1984 and the following vote: AYES: Commissioners Fee, Hedlund, Jahnke, Szany, Dixon NOES: None ABSENT: Commissioners Harbicht, Wells Section 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. LOT AREA: 86,127.72 square feet (1.97 acres) FRONTAGE: 325.63 Feet along Second Avenue 136.11 Feet along Third Avenue EXISTING LAND USE & ZONING: Religious Institution, single-family dwelling and parking lot; zoned R-2 SURROUNDING LAND USE & ZONING: North: South: West: East: Single-family dwellings; zoned R-2 Si ngl e and multi pl e- family dwell i ngs; zoned R-2 Single-family dwellings; zoned R-2 Single and multiple-family dwellings; zoned R-2 GENERAL PLAN DESIGNATION: Multiple-family (7+ du/acl HISTORY/PROPOSAL In 1964 five of six single-family dwellings were demolished on the subject site and the 21,500 square foot single-story Foothill Jewish Temple-Center was constructed. The Temple-Center consists of a 4,608 square foot sanctuary, 6,180 . . . ( ( square foot gymnasium/auditorium, 4,608 square foot kitchen, meeting hall and locker room facility, and 6,104 square feet of classrooms, lounge, nursery and offices. The remaining single-family dwelling is currently being used as the recidence for the caretaker of the property. The City Council at its September 1, 1981 meeting adopted Resolution No. 4987 granting Conditional Use Permit 81-7 permitting the utilization of classrooms for the operation of a preschool and other religious school classes. Enrollment of the preschool was limited to 30 students. On July 20, 1982 the City Council modi fied the exi sting condi tional use permi t to penn; t an enrollment of 50 students. The preschool would like to expand their enrollment to 80 students. The preschool will continue as a daily operation, excluding weekends, for 2-1/2 to 5 year olds from 8:45 a.m. to 6:00 p.m. Forty will be the maximum number of children utilizing the fully fenced 7,855 square foot recreation area at anyone time. Surrounding the recreation area is a five to six foot high block wall. Unloading and loading of the children will be off-street at the rear of the building adjacent to the play area (see attached plans and aerial). ANALYSIS The Zoning Ordinance permits a preschool in any zone with an approved conditional use permit. If enrollment is increased to 80 students, the preschool will comply with the requirements for 75 square feet of outdoor play area (98 sq. ft. provided) and 35 square feet of indoor play area (36.75 sq. ft. provided, or ten students in each room) for each student. The proposed expansion calls for the util ization of three additional classrooms. The existing outdoor recreation area will not have to be enlarged to accommodate the additional students. From 12:15 p.m. to 6:00 p.m. not more than 25 students will be enrolled in the preschool. The parking lot with 94 8'-6" wide spaces can easily accommodate the preschool. Loading and unloading of children is done safely at the rear of the building. The outdoor 15'x108' area enclosed by a 3'-9" high block 'o'/all along Second Avenue shoul d not be used for any recreational activities (games and sports). Only supervised activities should be permitted like arts and crafts, class discussions and meals. The storage shed along the north property line should be moved 3'-0" from the property line. Find attached a site plan/floor plan of the preschool and an aerial showing the entire church site. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse C.U.P. 84-14 7/24/84 Page 2 . . . ( ( change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this document. RECOrlMENDA TI ON: The Planning Department recommends approval of C.U.P. 84-14 subject to the following conditions: 1. That the enrollment of the preschool be limited to 80 students. Not more than 25 students shall be permitted after 12:15 p.m. 2. The hours of operation shall be 8:45 a.m. to 6:00 p.m. ,weekdays only, (Monday through Friday) 3. FINDINGS AND MDTIONS Approval If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report (or as modified by the Commi ss ion). Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and findings in support of that decision.
