HomeMy WebLinkAbout1265 ~ . ~ PLANNING COMMISSION RESOLUTION NO. 1265 A RESOLUTION GRANTING CONDITIONAL USE PERMIT 84-13 FOR AN AUTOMOTIVE GARAGE AT 74-82 WEST LAS TUNAS DRIVE. WHEREAS, on June 12, 1984 an application was filed by G. L. Kaplan Construction Company to operate an automotive garage, Planning Department Case No. C.U.P. 84-13, on property commonly known as 74-82 West Las Tunas Drive, more particularly described as follows: Part of Lot 69, Santa Anita Colony Tract, in the City of Arcadia, County of Los Angeles, State of California, as per Map recorded in Book 42, Page 87 of Miscellaneous Records, in the Office of said County Recorder. Also a portion of Parcels 1 and 2, Parcel Map 653, as per Map recorded in Book 13, Page 27 of Parcel Maps. WHEREAS, a public hearing was held on July 10, 1984, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. That the site abuts pavement type to carry the kind streets and highways of traffic generated adequate in width and by the proposed use. 4IIt 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment. Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit for an automotive garage upon the following conditions: 1. The following shall be complied with to the satisfaction of the Director of Public WorKS: a. Close existing driveways not to be used. Construct P.C.C. driveway aprons according to City of Arcadia Standard Drawing No. S-l1. b. Submit a grading and drainage plan for approval of the Director of Public WorKS. c. Removal of buildings, structures, and fences from the property shall be arranged to the satisfaction of the Director of Public WorKs. d. Provide all necessary easements and install all utilities underground. e. Plant parKway trees at locations detennined by the Director of Public WorKS. f. Si nce the area ut i1 i zed by the proposed ga rage s traddl es lot lines, the applicant should submit a parcel map for a lot split or for lot consolidation of the various properties involved. That fire safety shall be provided to the satisfaction of the Fire Chief. All vehicle repair worK shall be done inside the building. All mechanical equipment shall be completely screened from view (this may require extension of the proposed building parapet). That all conditions of approval shall be complied with prior to C.U.P. 84-13 becoming effective. A Modification shall be granted for portions of landscaped buffers along Las Tunas Drive and Live Oak Avenue to be 5'-0" in width in lieu of 5'-3" (9269.13.B.), 8. That C U.P. 84-13 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. Section 4. Kaplan Construction Co. 74 - 82 West Las Tunas Drive Conditional use permit to operate an auto repair garage. 29,955 square feet (.69 acres) Approximately 147: on Las Tunas Drive Approximately 147' on Live Oak Avenue The subject site is developed with an existing equipment rental yard and a Kentucky Fried Chicken: zoned C-M (Commercial-Manufacturing Zone) North: Developed with commercial office building; zoned C-O Developed with mixed commercial uses: zoned C-M Developed with mixed commercial uses: zoned C-M Developed with mixed commercial uses; zoned C-M South: East: West: Commercial . The applicant is proposing to remove the existing structures and to develop the site with a 10,080 square foot building to be used as an an automobile repair garage. The garage service bays will open to the east and west. . . . Twenty-one parking spaces are required for industrial uses. A total of thirty-nine on-site parking spaces are proposed to be located adjacent to the east and west property lines. The proposed landscaping exceeds the 3% code requirement, eighteen trees are proposed to buffer the proposed use from adjoining uses. A garage is a permitted use in the C-M zone with an approved conditional use permit. Pursuant to the provLsLons of the California Environmental Quality Act, the Planning Department has prepared an initial study for the pro- posed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared tor this project. RECOMMENDATION The Planning Department recommends approval of C.V.P. 84-13 subject to the following conditions: 1. That the conditions set forth in the attached memorandum from the Department of Public Works be completed to the satisfaction of the Director of Public Works. 2. That fire safety shall be provided to the satisfaction of the Fire Chief. 3. All vehicle repair work shall be done inside the building. 4. All mechanical equipment shall be completely screened from view (this may required extension of the proposed building parapet). 5. That all conditions of approval shall be complied with prior to C.V.P. 84-13 becoming effective. That the site shall be maintained as per the plans on file in the Planning Department. 6. 7 .
