PLANNING COMMISSION RESOLUTION NO. 1264
A RESOLUTION DENYING CONDITIONAL USE PERMIT 84-12 TO
CONSTRUCT AND OPERATE A 103-UNIT RETIREMENT HOTEL AT 601
SUNSET BOULEVARD.
WHEREAS, on May 25, 1984 an application was filed by Berger-Socoloske to
construct and operate a 103-unit retirement hotel, Planning Department Case No.
C.U.P. 84-12, on property commonly known as 601 Sunset Boulevard, more
particularly described as follows:
Portion of Lot 3, Tract 14846 in the City of Arcadia, County
of Los Angeles, State of California, as recorded in Map Book
314, Pages 8-9 of Maps in the Office of the County Recorder
of said County.
WHEREAS, a public hearing was held on July 10, 1984 at which time all
interested persons were given full opportunity to be heard and to present
evidence; and
WHEREAS, pursuant to review of the record including staff reports and
testimony, the Planning Commission directed preparation of this Resolution to
. reflect their decision and findings;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY
RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning Department in
the attached report is true and correct.
Section 2. This Commission finds:
1. That the proposed project is too intense for the subject site;
2. That the 28 off-site parking spaces are located too far from
the subject site and that all parking should be accommodated on the subject
property; and
3. That the site for the proposed use is not adequate in size and
shape to accommodate said use, and all yards, spaces, walls, fences, parking,
loading, landscaping and other features required to adjust said use with the land
and uses in the neighborhood.
Section 3. That for the foregoing reasons, this Commission denies the
application for Conditional Use Permit 84-12.

Section 4. The decision, findings and conditions contained in this
Resolution reflect the Commission's action of July 10, 1984 and the following
vote thereon:

The applicant is proposing to demolish the existing service station and
construct a 47,000 sq. ft. building. The existing 8,000 sq. ft. May Company
TBA building will be converted into a dining room, lounge and kitchen. The
total building area will be 55,000 sq. ft.

There will be 103 units which average 325 sq. ft. in area. Five of the
units are designed for the handicapped; all of the units will have hardware
in the bathrooms designed to assist the elderly.
The building will be three stories with an average height of 33 feet and a
maximum height of 38' to the top of the dormers.
The first floor will be comprised of 25 living units, offices, craft room,
lounge, dining room and kitchen. The second and third floors will each have
39 living units, lounge and laundry rooms.
There will be five exit passages; the main entrance/exit will be on
Michi11inda Avenue and there will be one exit onto Sunset Boulevard, one
exit into the parking area which fronts along Sunset Boulevard and two exits
at the intersection of Sunset Boulevard and Michil1inda Avenue. One
elevator is being provided in each wing of the building (two total).
The building will have a 9' to 15' setback along Michi11inda Avenue and a 7'
to 12' setback along Sunset Boulevard.
There will be a 4900+ sq. ft. landscaped interior courtyard which will have
a swimming pool and Jacuzzi.
PARKING AND LANDSCAPING

Parking
The applicant is proposing a total of 42 parking spaces; 14 of these spaces
will be on-site parking spaces (including one handicapped space) and 28
spaces will be located off-site on the upper level of the May Company
parki ng deck.
Four of the on-site parking spaces (including the handicapped space) will be
located along Michillinda Avenue and ten spaces will be located along Sunset
Boulevard.
The plans do not show a separate drop-off area.
Based upon the code requirements for a hotel, 124 parking spaces are
required (1.2 parking spaces per guest room). This parking requirement is
excessive for a "retirement" facility. The Arcadia Retirement Hotel on
Duarte Road has a parking ratio of one space for each 2.5 rooms and the
Arcadia Gardens Retirement Hotel on Camino Real has a parking ratio of one
space for each 1.84 rooms.
The on-site parking ratio for this complex would be one space for each 7.35
guest rooms.

The applicant has indicated that they will be leasing 28 parking spaces
located at the northeast corner of the upper deck of the May Company parking
structure. These spaces are located a minimum of 520 feet from the subject
site. The applicant in his letter dated June 25th has indicated that these
spaces will be used for all staff parking and, if needed resident parking.
It is noted that they will have a limousine service (which will utilize one
of the on-site parking spaces) and that it will be used to transport

residents to shopping, medical and grooming locations and will .also, if
necessary, be used to transport residents to and from the parklng spaces in
the May Company parking structure.
Landscaping
The perimeter of the property adjacent to Sunset Boulevard and Michillinda
Avenue will be landscaped as well as a portion of the interior courtyard
area.

MISCELLANEOUS INFORMATION
The applicant has indicated there will be approximately 13 to 22 employees and
that the minimum age for,a resident will be 55 years.
No trash enclosure is shown on the site.

The subject site is located in the Alquist Priolo Specials Study Zone. A
geologic study was conducted on the subject site and after reviewing this
study the City's geologist concludes that "based on the geotechnical report
and review of the trench logs, we recommend that the subject report be
approved from a fault rupture standpoint".

A retirement hotel is a permitted use in the C-2 zone with an approved

The C-2 zone would allow a three story, 40 foot high commercial building to be
constructed adjacent to the Sunset Boulevard and Michillinda Avenue property
lines. The noise and traffic generated by a retirement hotel is minimal and
it is staff's opinion that this use is less intensive than most other
commercial uses which would be permitted in the C-2 zone.
Staff's major concern with this proposal is the lack of on-site parking.
Although this type of facility has a minimum amount of residents that drive,
based on the other facilities within the City, approximately 16~ of their
residents have automobiles. Also, there will be 13 to 22 employees during the
peak hours. Based upon these requirements which do not take into .
consideration visitors to the site, staff does not feel that there 1S adequate
on-site parking and that the off-site parking located at the May Company is
not within convenient walking distance to the property.
Section 9269.6 of the Arcadia Municipal Code states that "parking shall be
located on the same lot or site or on a lot or site contiguous thereto or
within 495' of the building". As previously noted, the parking at the May
Company is a minimum distance of 520' from the subject site. Staff is
concerned that the distance from the site will discourage employees and/or
residents from parking in this area and that they will park on nearby streets;
i.e., California which has available on-street parking and has a stop light
which enables easy access to the site and/or Balboa which is immediately
across Sunset Boulevard where there is an existing sidewalk.
It is staff's opinion that 42 parking spaces are adequate for this proposed
retirement hotel, however, all the parking spaces should be located on-site.
AttaChed for the Commission's review are the June 25th letter from Land-
Development-Management clarifying the parking requirements for the facility
and including a survey of seven similar facilities, and a survey conducted by
the City staff of similar facilities including the two located in the city and
three in adjacent cities.

Pursuant to the provisions of the California Environmental Quality Act, the
Planning Department has prepared an initial study for the proposed project.
Said initial study did not disclose any substantial or potentially substantial
adverse change in any of the physical conditions within the area affected by
the project including land, air, water, minerals, flora, fauna, ambient noise,
and objects of historical or aesthetic significance. Therefore, a Negative
Declaration has been prepared for this project.
RECOMMENDATION
Based upon the insufficient amount of on-site parking, the Planning Department
recommends denial of C.U.P. 84-12.

If the Planning Commission determines that this is an appropriate use and
moves to approve this conditional use permit, the Planning Department would
recommend the following conditions of approval:
1. That the conditions as outlined in the attached report from the
Department of Public Works shall be complied with to the satisfaction of
the Director of Public Works.

That fire safety shall be provided to the satisfaction of the Fire
Chief.
That a trash enclosure shall be provided as per Section 9263.6.6 of the
Arcadia Municipal Code.
That a modification shall be granted for 42 parking spaces in lieu of
124 parking spaces required.
That a covenant in a form and content to be approved by the City
Attorney shall be filed guaranteeing that the 28 off-site parking spaces
will be maintained for the use of the retirement hotel as long as said
building or land use is maintained.
6. That the minimum age for residency in this facility shall be 55 years
and that a covenant in a form and content to be approved by the City
Attorney shall be filed guaranteeing that the minimum age of residents
shall be 55 years.
7. That C.U.P. 84-12 shall not take effect until owner and applicant have
executed a form available at the Planning Department indicating
awareness and acceptance of the conditions of approval.
FINDINGS AND MOTIONS
Approval
If the Planning Commission intends to take action to approve this
project, the Commission should move to approve and file the Negative
Declaration and find that the project will not have a significant effect
on the environment and direct staff to prepare the appropriate resolution
incorporating the specific findings and conditions of approval set forth
in the staff report (or as modified by the Commission).
Denial

the Commission should move to deny and direct staff to prepare an
appropriate resolution incorporating the Commission's decision and
findings in support of that decision.

This department's review of the subject CUP resulted in the following
requirements:
1. Close existing driveways not to be used and construct new P.C.C. driveway
aprons that conform to City Standard Drawing S-ll.
2. Submit a grading and drainage plan prepared by a registered civil
engineer.
3. Arrange for utility service and dedicate easements to utility companies.
4. Verify the location of the 6-inch sanitary sewer connection to the main in
Sunset Boulevard to the satisfaction of the Director of Public Works or
install a 6-inch lateral to the main according to City of Arcadia
Standards.
The subject property is served by the Los Angeles County Sanitat ion
District. Therefore, a CSD and a City permit will be required.
5. The parkway widths at the site are eight (8) feet and twelve (12) feet on
Michillinda Avenue and Sunset Boulevard, respectively.
At present, street trees and plants are adequate. Th i s department will
reserve further comment on the landscaping until more definitive plans have
been prepared and submitted. Future plants, such as those planned at points
of ingress and egress, could create site restrictions.

As per your request, we wish to clarify the resident
parking requirements for the above hotel.

The proposed hotel will have on-site 14 parking spaces
foi~residents, or guests, plus one handicap parking
spa~e, plus one loading space. One of the 14 spaces
will be used for the hotel 1imosine that will be used
to transport residents to shopping, medical, and groom-
ing locations. It will also, if necessary, transport
the residents to and from the parking spaces in the
May Co. parking structure (see attached drawing>. These
spaces, 28 additional, will be used for all staff park-
ing and resident parking. We presently have a lease
agreement with May Co. for these 28 spaces and should
the requirement for additional spaces be needed, we can
lease more spaces, at a considerable additional cost.
Based~n all of our research, we feel that these 28,
plus ~, spaces are more than will be needed.

area which were contacted by the City staff to ascertain their parking
requirements for this type of facility.
NAME: Arcadi a Gardens Reti rement Hotel
LOCATION: Arcadia
This facility contains 105 units. They presently have
approximately 100 residents, 17 of which drive cars. A
limousine is available to take residents to appointments, etc.
Their peaK shift is from 8:00 a.m. to 4:30 p.m. with 20 to 25
persons on said shift.
NAME: Arcadi a Retirement Hotel
LOCATION: Arcadia
This facility contains 60 units and presently has 65 residents.
Less than 10 of the residents drive. Their peak shift is 7:00
a.m. to 3:00 p.m. with approximately 14 employees.
NAME: California Christian Homes
LOCATION: Rosemead
This facility contains 60 rooms and is fully occupied.
Approximately 6 of the residents drive. This site also contains
78 independent living apartments so they could not estimate how
many employees they have for the resident facility only.
NAME: Santa Anita Retirement Center
LOCATION: Temple City
They have 95 units with 96 residents; none of the residents
drive. The maximum number of residents they have had driving at
anyone time has been four. During the peaK shift they have a
maximum of seven employees.

They have 25 rooms and 36 residents. Only one resident drives at
this time. During their peaK shift they have a maximum of five

lA, Band G. The subject site is located in the Alquist Priolo Special
Studies zone and is subject to said regulations. A geologic study which
was prepared for the applicant indicates that the subject site has ex-
perienced several periods of movement during the past few thousand
years. The applicant is proposing structural designs to accommodate
said findings.
7. Light and Glare. The proposal may result in new light and glare.
However, this light and glare should not be significant as to impact
the adjoining properties.
8. Land Use. This proposal will result in a significant change in the land
use from retail to high density residential. However, a hotel is a
permitted use in the C-2 zone with an approved Conditional Use Permit.

of this proposal, because of the nature of this development, it
anticipated that the noise level will be significant.

13. Effects on existing parking facilities or demand for new parking? 15
on-site parking spaces are proposed. The applicant is proposing to
utilize the parking at the May Company to off-set needed on-site parking.
It is the applicant's contention that th~s type of use has limited
parking needs because of the age of the persons living on the site.
14. Fire Protection. Because of the age of the persons occupying the pre-
mises there may be a greater need for paramedic services to the site.
This will not, however, result in a need for an increase in the Fire
Department personnel.

ADDITIONAL INFORMATION
3. During construction, an increase in noise, vibration, dust,
dirt, fumes, odors, etc., is to be expected. Once completed,
however, the Senior Citizen Hotel will not generate a lot of
noise and by the nature of the project, traffic will be
minimal. This proposed use will be less intensive than the
gas station and tire/hattery shoo that previously existed on
the site.
5. Once again, an increase in energy consumotion is to be
expected during the construction period. Once complete,
there will be adequate sewer facilities and electricity to
serve the site.
