PLANNING COMMISSION RESOLUTION NO. 1262
A RESOLUTION GRANTING CONDITIONAL USE PERMIT 84-10 TO
OPERATE AN EATING ESTABLISHMENT AT 124 EAST LIVE OAK
AVENUE.
WHEREAS, on April 30, 1984, an application was filed by Robin Shou to
operate an eating establishment, Planning Department Case No. C.U.P. 84-10, on
property commonly known as 124 East Live Oak Avenue, more particularly described
as follows:
Lot 6, Tract 13623 in the City of Arcadia, County of Los Angeles, State
of California as per Map Book 278, Page 29 in the County Recorder's
Office.
WHEREAS, a public hearing was held on May 22, 1984 at which time all
interested persons were given full opportunity to be heard and to present
evidence.
NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY
RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning Department in
the attached report is true and correct.
Section 2. This Commission finds that:
1. That the granting of such Conditional Use Permit will not be
detrimental to the public health or welfare, or injurious to the property or
improvements in such zone or vicinity.
2. That the use applied for at the location indicated is properly one
for which a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use, and all yards, spaces, walls, fences, parking, loading,
landscaping and other features required to adjust said use with the land and uses
in the neighborhood.
4. That the site abuts streets and highways adequate in width and
pavement type to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not adversely
affect the comprehensive general plan.
6. The use applied for will not have a substantial adverse impact on
the ~nvironment.

Section 3. For the foregoing reasons this Commission grants a Conditional
Use Pennit to operate an eating establishment upon the following conditions:
1. That the parking lot be restriped and said plan for
restriping be presented to the Planning Department for its
review and approval.
That a trash enclosure shall be constructed as per Section
9263.6.6 of the Arcadia Municipal Code and that said
enclosure shall have either a solid wood gate or solid metal
gate. The location and design of said enclosure shall be
subject to the review and approval of the Planning
Department.
That a modification shall be granted for 14 parking spaces in
lieu of 31 spaces required.
That a modification be granted waiving the requirements for
interior landscaping.
That the above improvements shall be completed prior to
operation of the business as an eating establishment.
That seating shall be limited to 12 persons.
That C.U.P. 84-10 shall not take effect until the owner
and/or applicant have executed a fonn available at the
Planning Department indicating their awareness and acceptance
of the conditions of the approval.
Section 4. The decision, findings and conditions contained
Resolution reflect the Commission's action of May 22, 1984, and the
thereon:

The site is developed with three uses: a take-out only eating
establishment (The House of Burger and Shiskebob), a lawnmower shop and
the Women's Bowling Association. The buildings contain a total of 3,168
square feet. The proposed eating establishment will occupy 1,056 square

feet which is presently the House of Burger and Shiskebob. This House of
Burger and Shiskebob was granted a business licesne for a "take-out" only
eating establishment. It was recently brought to staff's attention that
the proprietors have added two tables with seating for eight persons.
The applicant, Mr. Shou is proposing to operate an eating establishment
with seating for 12 persons.
No major alterations are proposed to the building.
Parking
The subject site contains 14 parking spaces. Based upon the existing and
proposed use, 31 parking spaces would be required: 21 parking spaces for
the eating establishment; five parking spaces for the lawnmower shop and
five spaces for the Women's Bowling Association.
There is no landscaping on the site and no trash enclosure.
ANALYSIS
The applicant has indicated that his business will be primarily take-out.
The parking behind the businesses fronting on Live Oak Avenue in this
area have the appearance of and are primarily used as a common parking
area. The majority of the lots are under one ownership.
An eating establishment is a permitted use in the C-2 zone with an
approved conditional use permit.
It is staff's opinion that allowing limited seating in this eating
establishment would not be detrimental to the site or surrounding
properties but wou1 d serve as a convenience to customers.
Since 1982 there have been nine conditional use permits granted for
similar types of uses and as of this date we have not had any complaints
about the operation of these eating establishments.
The Fire Department has reviewed this proposal and has no objections to
the use.
Pursuant to the provisions of the California Environmental Quality Act, the
Planning Department has prepared an initial study for the proposed project.
Sai'd initial study did not disclose any substantial or potentially substantial
adverse change in any of the physical conditions within the area affected by
the project including land, air, water, minerals, flora, fauna, ambient noise,
and objects of historical or aesthetic significance. Therefore, a Negative
Declaration has been prepared for this project.

RECOMMENDATION
The Planning Department recommends approval of C.U.P. 84-10 subject to
the following conditions:
1. That the parking lot be restriped and said plan for restriping be
presented to the Planning Department for its review and approval.

of the Arcadia Municipal Code and that said enclosure shall have

FINDINGS AND MOTIONS

on the environment and direct staff to prepare the appropriate resolution
incorporating the specific findings and conditions of approval set forth
in the staff report (or as modified by the Commission).
Denial
If the Planning Commission intends to take action to deny this project,
the Commission should move to deny and direct staff to prepare the
appropriate resolution incorporating the Commission's decision and
findings in support of that decision.
