PLANNING COMMISSION RESOLUTION 1261 A RESOLUTION GRANTING CONDITIONAL USE PERMIT 84-9 TO EXPAND THE EXISTING SERVICE STATION BY ADDING A PUMP ISLAND SECURITY PAY BOOTH AT 102 EAST HUNTINGTON DRIVE. WHEREAS, on April 23, 1984 an application was filed by Chevron, USA to expand the existing service station by adding a pump island security pay booth, Planning Department Case No. C.U.P. 84-9, on property commonly known as 102 East Huntington Drive, more particularly described as follows: . Lots 33, 34, 35 and 36 in Block 72 of Arcadia, in the City of Arcadia, County of Los Angeles, State of California as per Map recorded in Book IS, Page 89 of Miscellaneous Records in the Office of the County Recorder of said County. Except the West 10 feet of said Lots 34, 35, and 36, also except the North 10 feet of the East 90 feet of the West 100 feet of said Lot 36. Also, the North 15 feet of the East 45 feet of said Lot 36. Also except the North 15 feet of the said Lot 33. Except the Easterly 15 feet of Lot 33 as measured along Huntington Drive. WHEREAS, a public hearing was held on May 22, 1984 at which time all interested persons were given full opportunity to be heard and to present evidence. NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds that: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and . pavement type to carry the kind of traffic generated by the proposed use. - 1 - 1261 . . . 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive general plan. 6. The use applied for will not have a substantial adverse impact on the environment. 7. The proposed use will not substantially increase vehicular traffic on any street in a residentially zoned district. 8. The proposed use will not lessen the suitability of any nearby commercially zoned property for commercial use by interfering with pedestrian traffic. g. The proposed use will not create increased traffic hazards to pedestrians when located near a school, church, auditorium, theater or other place of assembly. Section 3. For the foregoing reasons this Commission grants a Conditional Use Permit to expand the existing service station by adding a pump island security pay booth upon the following conditions: 1. That the site shall be cleared of all weeds. That all landscaped areas and parkway tree wells shall be cleared of weeds and shall be properly maintained. 2. That the parking stalls located along the easterly property line shall be restriped as per Section 9269.8.1 of the Arcadia Municipal Code and provided with wheel stops. 3. That the light standards adjacent to the easterly driveway on Huntington Drive shall be repaired or replaced. 4. The wood bumper guard adjacent to the easterly property line should be repaired or removed. 5. All the above improvements shall be done concurrent with the construction of the pay booth. 6. That C.U.P. 84-9 shall not take effect until the owner and/or applicant have executed a form available at the Planning Department indicating their awareness and acceptance of the conditions of the approval. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of May 22, 1984, and the following vote thereon: - 2 - 1261 . . . SURROUNDING LAND North: Developed with mixed commercial uses; zoned USE & ZONING: C-2 & H South: Developed with a commercial building; zoned C-2 & H East: Developed with a bank; zoned C-2 & H West: Developed with a saving and loan; zoned C-2 & H GENERAL PLAN DESIGNATION: HISTORY Commerci a1 The existing service station was constructed in 1972 (C.U.P. 71-17). PROPOSAL AND ANALYSIS The applicant is proposing to construct an 84 square feet security pay booth between the two pump islands fronting on Huntington Drive. . This service station will continue to operate both full-serve and self- serve from 6 a.m. to midnight. The proposed pay booth will provide for normal cashiering and will also include computerization of the gasoline di spensers. The booth will be steel panels painted beige with bronze tinted glass and off-white fascia. There are ten 9'x20' parking spaces on the site adjacent to the easterly property line. A wood bumper guard protects the adjoining planter area from the cars. A portion of this bumper guard has been broken. Also there is a small light standard adjacent to the easterly Huntington Drive driveway which appears to have been hit by a car. This light standard should be repaired. The planter areas adjacent to First Avenue and Huntington Drive are in need of proper maintenance. The tree wells in the parkway along Huntington Drive and First Avenue have not been maintained. Weeds are also growing in the paved area behind the service station. A service station is a permitted use in the C-2 zone with an approved conditional use permit. Section 9275.2.16 states "that no expansion of existing uses or services shall be permitted unless a Conditional Use Permit is filed and approved for the proposed expansion." . It is staff's opinion that the construction of a pay booth will not be detrimental to the area and will facilitate better service to customers utilizing this service station. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATION The Planning Department recommends approval of C.U.P. 84-9 subject to the following conditions: 1. That the site shall be cleared of all weeds. That all landscaped areas and parkway tree wells shall be cleared of weeds and shall be properly maintained. 2.
