WHEREAS, on April 2, 1984 an application ~3S filed by Steve Frohl ing to extend the existing drive-through booth and enlarge the restrooms at the existing McDonald's eating establishment, Planning Department Case No. C.U.P. 84-6, on property commonly known as 143 East Foothi I I Boulevard, more particularly described as fol lows: The south 235' of the east 200' of Lot 4 in Block 90 of Santa Anita Tract, as per Map recorded In Book 34, Pages 41 and 42 of Miscellaneous Records in the Office of the County Recorder of said County, except the west 65' thereof. WHEREAS, a public hearing was held on April 14, 1984 at which time al I interested persons were given ful I opportunity to be heard and to present ev I de nce . - NOW, THEREFORE, THE PLANNING COMMISSI)N OF THE CITY OF ARCADIA HEREBY RESOLVES A: FOLLOWS: Sect on 1. That the factual data subnltted by the Planning Department in the att'ched report Is true and correct. Sect on 2. This Commission finds that: 1. The granting of such Conditional Use Permit wil I not be detrlmenta, to the public health or welfare or injurious to the property or improvements In such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a ConditIonal Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and al I yards, spaces, wal Is, fences, parki1g, loadl'ng, landscaping and other features required to adjust said use ~ith the land and uses In the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. . - i - 1258 '. 5. That the roofing and exterior buildIng materials for the proposed, ddltlons be consistent with the existing building and subject . to the review and approval of the Planning Department. 2. That the handicap restroom facilities shal I comply with Title 24 of the State of Cal ifornia Administration Code. 3. That a modification is granted for 41 parking spaces In lieu of 68 spaces required by code. 4. That C.U.P. 84-6 shal I not take effect until the applicant and/or owner have executed a document available in the Planning Department which indicates awareness and acceptance of the conditions of approval. Section 4. BUTLER ASSOCIATE PLANNER Steve Froh ling 143 East Foothil I Boulevard Conditional use permit to extend the existing drive- thru booth and enlarge the restrocms at the McDonald's eating establishment. 28,350 square feet (.65 acres) The site is developed with a McDonaldls eating estab- lishment; zoned C-2. NORTH: SOUTH: EAST: WEST: Neighborhood Shopping Center; zoned C-l & D General commercial uses: zoned C-2 Bank and parking: zoned C-I & D Neighborhood Shopping Center; zoned C-I & D Commercial On May 19, 1981, the City Council approved Conditional Use Permit 81-1 to add the drive-thru window to the McDonald's eating establishment. PROPOSAL The applicant is proposing to extend the exist ~g drive-thru booth an additional 11+ feet to the north (total area 126.50 sq. ft.'. This wll I provide for a separate cashier's window and piCk-Up window. . . . There wil I be a 122.69 square feet addition to the east side of the building which will allow for the expansion of the existing restrooms to provide handicap faci lities. Both of these additions wi II be located in the existing walkway and wi II not encroach into the parking area. The exterior bui Idlng materials wi II be consistent with the existing bui Idlng. The existing building contains a total floor area of 3,154 square feet, With the proposed additions this wil I be increased to 3,403+ square feet. Based upon the total floor area 68 parking spaces would be required. Forty-one parking spaces presently exist on the site and no changes are proposed. ANALYSIS Staff has noted on several occasions that parking on the site is not adequate for the use and that the drive-thru lane is backed up to Foothil I Boulevard. Staff does not feel, however, that the extension to the drive-thru window and the expansion of the restrooms would compound the parking and/or circulation problems. According to the appl icant, the addition of the cashierls window wi II speed up traffic through the drive-thru window which may reduce some of the problems staff has noticed 01'1 the site. Pursuant to the provIsIons of the California Environmental Qual ity Act, the Planning Department has prepared an initial study for the proposed conditional use permit. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. REC~MENDAT I ON The Planning Department recommends approval of C.U.P. 84-6 subject to the fol lowing conditions: I. That the roofing and exterior bui Iding materials for the proposed additions be consistent with the existing building and subject to the review and approval of the Planning Department. 2. That the handicap restroom faci lities shal I comply with Title 24 of the State of Cal ifornia Administration Code. C.U.P. 84-6 4/24/84 Page 2 . . . 3. FINDINGS AND MOTIONS Approval If the Planning Commission Intends to take action to approve this project, the Commission should move to approve and fl Ie the Negative Declaration and find that the project wi I I not have a significant effect on the environment and direct staff to prepare the appropriate resolution Incorporating the specific findings and conditions of approval set forth In the staff report (or as modified by the Commission). Denial If the Planning Commission intends to tak9 action to deny this project, the Commission should move to deny and direct staff to prepare the appropriate resolution Incorporating the Commission's decision and findings in support of that decision.
