HomeMy WebLinkAbout1257 . . . ...< PLANNING COMMISSION RESOLUTION 1257 A RESOLUTION GRANTING CONDITIONAL USE PERMIT 84-5 TO ALLOW A GARAGE TO BE BUILT FOR THE CHURCH AT 23 WEST FOOTHILL BOULEVARD WHEREAS, on March 30, 1984, an application was filed by the Emmanual Assembly of God Church to construct a two-car garage for use by the church, Planning Department Case No. C.U.P. 84-5, on property commonly known as 23 West Foothil I Boulevard, more particularly described as follows: Parcel 2 of Parcel Map 10960, in the City of Arcadia, County of Los Angeles, State of California, as per map recorded in Book 114, Page 39 of Parcel Maps, in the Office of said County Recorder. \~EREAS, a public hearing was held on April 24, 1984 at which time al! interested persons were given ful I opportunity to be heard and to present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section I. That the factual data submitted by the Planning Is true and correct. Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit for the construction of a two-car garage for use I by the church upon the fol lowing conditions: I. That a modification be granted for a 5'-0" easterly side yard setback I n Ii eu of 10' -0" requ i red for the proposed garage. 2. That the 250'-0" long by 5'-0" wide landscape buffer located along the northerly property line shal I be planted and maintained as long as the church is in operation. 3. A landscape plan shal I be submitted to the Planning Department prior to issuance of any building permits and said planting shal I be completed prior to final inspection by the Building Department. 4. The garage shall be single-story and shall not exceed 16'-0" in height. 5. The site shal I be maintained as per the plans on file in the Planning Department. . 6. AI I the conditions of approval shal I be compiled with prior to C.U.P. 81-5 becoming effective. 7. That C.U.P. 84-5 shal I not take effect until the owner and applicant have executed a document available in the Planning Department which indicates awareness and acceptance of the conditions of approval. Section 4. Present lot configuration of the church propoerty. PROPOSAL AND ANALYSIS The applicant proposes to construct a 20' x 24' garage to house their church van. The garage wi II have a 5'-011 rear yard setback and a 5'-011 easterly side yard setback. Existing landscaping and a 6'-011 high block wal I separate the church parking lot from the adjacent single-family zoned lots to the north. A modification Is required to permit the 51-011 easterly side yard setback due to the lot beIng zoned R-O, which requires a 101-011 side yard setback. A mitigating factor would be that this side property line is also the rear property line of the abutting lot at 1125 Santa Anita Avenue (see Land Use Map). An accessory buildIng could be built 31-011 from the rear property line at 1125 Santa Anita Avenue. The construction of the garage wi I I eliminate one parking space; but the remaining spaces wil I exceed the 32 parking spaces required by C.U.P. 74-19 permitting a two-story addition to the church. In 1978 (L-78-19) the church's lot was enlarged by 29,889 sqwuare feet and 51 additional parking spaces were provided. There wil I be 82 parking spaces on the site not Including the garage. The 2501-011 long by 51-011 wide landscaped buffer along the north property line has not been properly maintained. Thls'area should be planted and maintained as long as the church is in operation. C.U.P. 84-5 4/24/84 Page 2 . . . Continued use of this property as a church would be consistent with both the General Plan and zoning with an approved conditional use permIt. Staff feels the addition of a garage for church purposes would be an appropriate addition to the site. Pursuant to the provisions of the California Envlromental Quality Act, the,Plannlng Department has prepared an InitIal study for the proposed project. Said Ihltial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditIons within the area affected by the project including land, air, water, mInerals, flora, fauna, ambl.ent noise, and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATI )N The Planning Department recommends approval of C.U.P. 84-5 subject to the fol lowing conditions: I.
