PLANNING COMMISSION RESOLUTION 1254 A RESOLUTION GRANTING CONDITIONAL USE PERMIT 84-3 TO OPERATE AN AUTOMOBILE SERVICE STATION AT 66 EAST FOOTHILL BDULEVARD WHEREAS, on February 3, 1984, an application was filed by Christopher McGuire to operate an automobile service station, Planning Department Case No. C.U.P. 84-3, on property commonly known as 66 East Foothill Boulevard, more particularly described as follows: South 53.1 feet of the north 78.1 feet of Lot 1 of C.B. Cl apps 's Subdivision in the City of Arcadia, County of Los Angeles, State of California as per Map recorded in Book 31, Page 30 of Miscellaneous Records in the Office of the County Recorder of said County, except the east 10' of said lot. WHEREAS, a public hearing was held on February 28, 1984 at which time all interested persons were given full opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION DF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds that: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. I 2~ That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate i~ size and shape to accommodate said use, and all yards, spaces, ,walls, fences, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 1 1254 . . . 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive general plan. 6. The proposed use will not substantially increase vehicular traffic on any street in a residentially zoned district. 7. The proposed use will not lessen the suitability of any nearby commercially zoned property for commercial use by interfering with pedestrian traffic. 8. The proposed use will not create increased traffic hazards to pedestrians when located near a school, church, auditorium, theater or other place of assembly. Section 3. That for the conditional use permit for the upon the following conditions: 1. That the proposed facility be operated as a service station and that automobile fuel be sold at all times. 2. That all automobile repair work shall be done inside the foregoing operation reasons this Commission grants a of an automobile service station building. 3. That a trash enclosure shall be provided as per Section 9263.6.6 and that a wood or solid metal gate be installed. 4. That, if requested by the City, the applicant/operators show proof of sales of diesel fuel or gasoline on the premises. 5. Cars should not be parked in such a way as to obstruct access to the service station pumps. 6. That the applicant/operator and property owner shall sign a form indicating awareness and acceptance of all conditions of approval and that C.U.P. 84-3 shall not take effect until such form is returned to the Planning Department. I HEREBY CERTIFY that the foregoing Resolution was adopted at a regular meeting of the Planning Commission held on the 13th day of March, 1984. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of February 28, 1984, and the following vote: 2 1254 . . . BUTLER ASSOCIATE PLANNER GENERAL INFORMATIDN APPLICANT: ADDRESS: Christopher McGuire, property owner 66 East Foothill Boulevard REQUEST: Conditional Use Permit to operate a service station and automotive repair business. LOT AREA: FRONTAGE: 5,137 square feet 53.00' on First Avenue 96.75' on Foothill Boulevard EXISTING LAND USE & ZONI NG: The subject site is developed with a service station; zoned C-2 SURROUNDING LAND USE & ZONING: North: Developed with mixed commercial uses; Zoned C-2 South: Developed with an office building and residential uses; zoned C-2 and R-2 respectively. East: Developed with a small retail center; zoned C-2 West: Developed with offices; zoned C-2 GENERAL PLAN DESIGNATION: The sUbject property is designated as commercial. HISTORY In 1926 an automobile service station was constructed on this site. The original service station was removed and replaced with a new automobile service station in 1954. C.U.P. 84-3 2/28/84 Page 1 . ~ This service station was a legal nonconforming use in that it was constructed prior to the requirement for a conditional use permit. On January 18, 1983 a business license was issued to Juan Bigon and Fidel Tisera for the operation of a gasoline service station including minor auto repair. At the time of issuance of the business license it was explained to the operators Mr. Bigon and Mr. Tisera that this zoning did not permit the operation of a garage and that automobile repair was only allowed as an incidental use to the operation of a service station. In November, 1983 City staff noted during a field inspection that it appeared that the operators were not selling gasoline. After considerable investigation it was determined that gasoline was not being sold. Staff was advised on November 18 by the County Weights & Measures Division that during a normal site inspection which they conducted on July 29, 1983 they were told by the operators that they were not and would not be selling gasoline. On November 28th the City Attorney sent a letter to the operators, Messrs. Bigon and Tisera, advising them that they were in violation of the Code and that this problem would have to be remedied by December 5. On December 8th an office hearing was held with Messrs Bigon and Tisera and their attorney, Mr. Sapetto. It was again explained to them that an automobile repair garage was not a permitted use in the C-2 zone and that they could request a zone change or text amendment or operate in accordance with the Code. Messrs. Bigon and Tisera indicated they were aware of the problem, however, it was not economically feasible to operate a service station at this location. They noted that their lease expired on January 11 and that they would not renew it. On January 17, Mr. Chris McGuire, the property owner, and Messrs Bigon and Tisera met with staff. Mr. McGuire advised staff that the lease had been renewed and Mr. McGuire asked what had to be done to bring everything into code compliance. Section 9248 notes that if a nonconforming use ceases operation for a period in excess of 90 days that the use is deemed abandoned. Because the service station had not been in operation as a service station since at least July 29, 1983, the service station was considered by staff to be nonconforming. Mr. McGuire was informed by staff that in order to operate legally an application for a conditional use permit to operate an automobile service station would have to be filed and subsequently approved. Mr. McGuire stated he would file the necessary application for a diesel service station. . C.U.P. 84-3 2/28/84 Page 2 . . . PROPOSAL Mr. McGuire has filed this application to operate the service station as a diesel fuel service station with automobile repair. It is Mr. McGuire's opinion that because of the size and age of this existing service station they can only be competitive in selling diesel fuel. The operators of this facility, Messrs. Bigon and Tisera, are selling diesel fuel as well as continuing operation of their BMW service. The existing site has four pumps which are being used. The only improvement proposed for the site is a trash enclosure. ANALYSIS Section 9275.4.7.2 of the Arcadia Municipal Code states: 2. Automobile Service Stations. At an automobile service station no activities other than the following shall be conducted: dispensing gasoline, oil, grease, tires, batteries and automobile accessories directly 'to users of motor vehicles; tuning motors; wheel and brake adjustment and other minor repairs and servicing of motor vehicles only to the extent of installation of tires, batteries and automobile accessories directly to users of motor vehicles; conducting a commercial towing service by the operator of such service station, provided that wrecked or damaged vehicles shall not be towed to, nor stored upon, such service station property. All other activities are prohibited including, but not limited to upholstering work, auto glass work, painting, welding, tire recapping and auto dismantling. An automobile service station is a permitted use in the C-2 zone. It is staff's oplnlon that if this facility is operated as an automobile service station with minor automobile repair, the conditional use permit should be approved. Staff would recommend that periodic inspections be made of the site to insure that automobile fuel is sold on the premises. Also, all automobile repair work should be done inside the building. Section 9275.4.11 requires that (I) a five foot wide planter shall be located along the street side property line except for curb cut openings, (2) three foot wide raised planters shall be located along the walls of the interior property lines to a distance equal to the front of the building line, (3) that 150 square feet of raised planting area shall be located at the intersection of two property lines at a street corner, (4) that 30 square feet of raised planting area shall be located along the building facades fronting on the street, (5) that all planting areas shall be separated from adjacent asphaltic concrete paving by 6" minimum curb walls and (6) all landscaped areas shall be irrigated. C.U.P. 84-3 2/28/84 Page 3 .\ . . Because of the minimal lot size, staff does not believe it would be reasonable to impose any of the above landscaping requirements on this piece of property. Landscape buffers would interfere with the parking areas as well as the driveway areas. The trash enclosure should be a mlnlmum of six feet in height and enclosed with a wood or solid metal gate. Pursuant to the provisions of the California Environmental Quality Act. the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATlDN The Planning Department recommends approval of C.U.P. 83-4 subject to the following conditions: 1. That the proposed facility be operated as a service station and that automobile fuel be sold at all times. 2. That all automobile repair work shall be done inside the building. 3. That a trash enclosure shall be provided as per Section 9263.6.6 and that a wood or solid metal gate be installed. 4. That, if requested by the City, the applicants show proof of sales of diesel fuel or gasoline on the premises. 5.
