PLANNING COMMISSION RESOLUTION 1250
A RESOLUTION GRANTING ZONE VARIANCE V-83-4 TO ADD TO AN
EXISTING EATING ESTABLISHMENT PARTIALLY LOCATED IN A
PR-l ZONE AT 245 EAST FOOTHILL BOULEVARD.
WHEREAS, on October 13, 1983, an application was filed by Sterling
Foods,' Inc. to expand an existing eating establishment partially located in a
PR-1 Zone, Planning Department Case No. V-83-4, on property commonly known as
245 East Foothill Boulevard, more particularly described as follows:
Lot 5 of Tract 12834, located in the City of Arcadia,
County of Los Angeles, State of California as per Map
Book 262, Page 24, as recorded in the County Recorder's
. Office.
WHEREAS, a public hearing was held on November 8, 1983 at which time
all interested persons were given full opportunity to be heard and present
evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY
RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning Department
in the 'attached report is true and correct.
Section 2. This Commission finds:
1. That there are exceptional or extraordinary circumstances or

conditions applicable to the property involved, or to the intended use of the

proper~y, that do not apply generally to the property or class of use in the
same zone or vicinity.
, 2, That the granting of such variance will not be materially
detrimental to the public health or welfare or injurious to the property or
improvements in such zone or vicinity in which the property is located.

3. That such variance is necessary for the preservation and
enjoyment of a substantial property right of the applicant possessed by other
property in the same zone and vicinity,
4. That the granting of such variance will not adversely affect the
comprehensive General Plan.
Section 3. That for the foregoing reasons this Commission grants a
zone variance for the expansion of the existing eating establishment partially
located in a PR-l zone upon the following conditions:
1. The property shall be improved as per plans on file in the
subject Case No. V-83-4.
2. That Fire safety shall be provided to the satisfaction of the
Fire Department,
3. A modification shall be granted for 46 parking spaces in 1 ieu of
116 spaces required,
4. That the parking spaces shall be striped and have wheel stops as
per Sections 9269.8 and 9269.9 of the Arcadia Municipal Code.
5. That a landscape and irrigation plan shall be submitted to the
Planning Department for its review and approval prior to issuance of a Building
Permit.
6. That the landscape buffer adjacent to Foothill Boulevard be 6'-6"
in width and that the landscape strip located in the interior of the parking
area adjacent to Foothil Boulevard be 5'-5" in width.
7. That a six foot high block wall shall be constructed along the
easterly property line as per the plans on file in this case.
8. That all mechanical equipment shall be screened from view and
said screening shall be subject to the review and approval of the Planning
Department.
9. That a trash enclosure shall be installed as per Section 9263.3
of the Arcadia Municipal Code.
10. V-83-4 shall not take effect

HISTORY:
The eating establishment was constructed in 1964 prior to the requirement for a
conditional use permit for eating establishments. Modification M-64-144 was
granted allowing the building to be located within the PR-l zoned portion of
the p~operty.

In November, 1977 the Planning Commission approved Zone Variance V-77-6 to
permit an addition to the proposed eating establishment. This addition
included the construction of a foyer and storage area (488 square feet total).
The addition was never commenced and the variance expired.
SPECIAL INFORMATION
Bun ding Information:
The existing building contains 4,800 square feet of floor area. The applicant
is proposing to (1) add a 353.3 square foot s~orage area on the north side of
the building and (2) enclose the porch located on the south side of the
building which would add 640 square feet to the eating establishment. The
total floor area after the additions will be 5,793.3 square feet.
The applicant is also proposing to remodel the inside of the eating
establishment which will include enlarging the kitchen area, restrooms, game
room, etc.

The front facade will be remodeled and be approximately 19+' in height.
Parki ng
116 Parking spaces are required based on 20 parking spaces per 1,000 square
feet of gross floor area. The applicant's plans show 46 parking spaces, ten of
these spaces will be for compact cars.
Access will be from two driveways. One driveway is located along the east
property line. The second driveway, although used by Shakey's, is on a
separate lot. There is no recorded easement granting Shakey's use of this
property. However, the site has adequate access if'the use of this property
for access was terminated.
Landscaping
The code requires a 5'-3" landscape buffer between parking areas and public
rights-of~way. Presently there is a 4' wide planter and a 3' high wall in
front. The wall will be demolished and the planter area increased to 5'3".
Cars will overhang into thi s 1 andscape area 1 '-9". ,
An additional 4' wide planter is proposed in the interior of the lot; however,
cars ~ill overhang this area.
A 5'i ~ide planter area and a 6' high block wall are located across the
northerly property line.
A chain link fence with slats is located adjacent to the PR-1 zoned property to
the east. The applicant's plans indicate a 6' high block wall will be
constructed along this property line.

MISCELLANEOUS INFORMATION
The applicant has indicated there will be a seating capacity for 150 persons
which is consistent with the existing occupancy. The hours of operation are
11:00 a.m. to 12:00 midnight. There is a maximum of 12 employees.
A trash enclosure is proposed at the northeast corner of the building. The
existing roof-mounted mechanical equipment is not screened from view and is
visible from the street and adjacent properties.
The site is located within the Alquist Priolo Special Studies zone. However,
the addition does not exceed 50~ of the market value of the structure and,
therefore, a geologic study is not required.
REQUIRED FINDINGS
The Planning Commission should examine the information and make findings which
are relevant to the prerequisite conditions below:
Section 9291.1.2. of the Arcadia Municipal Code states: "Prerequisite
Conditions: Before a variance maybe granted, it shall be shown:
A.
That there are exceptional or extraordinary circumstances or conditions
applicable to the property involved, or to the intended use of the
property, tha t do not apply generally to the property or cl ass of use
in the same zone or vicinity.
B. That the granting of such variance will not be materially detrimental
to the public health or welfare or injuriOUS to the property or
improvements in such zone or vicinity in which the property is located.
C. That such variance is necessary for the preservation and enjoyment of a
substantial property right of the applicant possessed by other property
in the same zone and vicinity.
D. That the granting of such variance will not adversely affect the
comprehensive General Plan."
Attached for your consideration are those pages of the application in w~ich the
applicants have stated their case regarding the aforementioned prerequisite
condi tions.
ANALYSIS
The proposed use is consistent with the General Plan. According to the
appl icant, the expansion will not add any additional seating.
Staff does not believe this expansion would increase the need for additional
parking and feels the proposed parking layout would be adequate for said use.

In order to provide as much interior landscaping as possible in the parking
. area fronting on Foothill Boulevard, staff would recommend that the landscape
' area located a'djacent to Foothill Boulevard be increased from 5'-3" to 6'-6".
The pl anter curb coul d be used for the wheel stops and thi s woul d all ow for
additional landscaping in this area.
. Pursuant to the provisions of the California Environmental Quality Act, the
Planning Department has prepared an initial study for the proposed project.
Said initial study did not disclose any substantial or potentially substantial
adverse change in any of the physical conditions within the area affected by the
project including land, air, water, minerals, flora, fauna, ambient noise, and
objects of historical or aesthetic significance. Therefore, a Negative
Declaration has been prepared for this project.
RECOMMENDATION
The Planning Department recommends approval of V-83-4 subject to the following
conditions:
1. That Fi re safety shall be" provi ded to the sati sfaction of the Fi re
Department.
2. A modification shall be granted for 46 parking spaces in lieu of 116
spaces required.

That the parking space shall be striped and have wheel stops as per
Sections 9269,8 and 9269.9 of the Aracadia Municipal Code.
4. That, a landscape and irrigation plan shall be submitted to the Planning

If the Planning Commission intends to take action to approve this project, the
Commission should move to approve and file the Negative Declaration and find
that the project will not have a significant effect on the environment and
direct staff to prepare the appropriate resolution incorporating the specific
findings and conditions of approval set forth in the staff report (or as
modified by the Commission).
