PLANNING COMMISSION RESOLUTION NO. 1249
A RESOLUTION DENYING ZONE VARIANCE V-83-3 TO ALLOW
THE DEMOLITION OF A MAIN DWELLING UNIT IN ORDER TO
CONSTRUCT A NEW RESIDENCE WHILE RETAINING A SECOND
DWELLING UNIT ON AN R-1 ZONED LOT.
WHEREAS, on September 6, 1983 Mr. Denis Gallonio filed an application
requesting a zone variance to permit the demolition of a main dwelling unit in
order to construct a new two-story residence while retaining a second dwelling
unit, Planning Department Case No., V-83-3, on property commonly known as 470
Naomi Avenue, more particularly described as follows:
Lot 43 of Tract No. 6509, in the City of Arcadia, County of Los
Angeles, State of California, as per Map recorded in Book 70,
Page 10 of Maps in the Office of said County Recorder.
WHEREAS, a public hearing was held on September 27, 1983, at which time
all interested persons were given full opportunity to be heard and to present
evidence;
NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY
RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning Department
in the attached report is true and correct.
Section 2. This Commission finds:
1. That there are no exceptional or extraordinary circumstances or
conditions applicable to the property involved, or to the intended use of the
property, that do not apply generally to the property or class of use in the
same zone or viCinity in that there is no evidence of any unique circumstance,
or condition applicable' to the SUbject propertry, its configuration, size,
condition or any other characteristic.
2. That such variance is not necessary for the preservation and
enjoyment of a substantial property right of the applicant possessed by other
property in the same zone and vicinity in that property owners in the R-1 zone
possess a substantial property right to develop and utilize their property as a
single-family residence and the applicants can continue to utilize both
dwellings for resident uses without making the proposed development.

3. That the granting of such variance coul d adversely affect the

comprehensive General Plan in that the granting of this variance encourages the

reterition of a nonconforming R-2 type use in an area designated for single-
I
familyuse,by.both the General Plan and the Zoning Ordinance, which would be
tantamount to spot zoning the property R-2 in conflict with the General Plan.
, Section 3. That for the foregoing reasons this Commission hereby
denies the application for Zone Variance V-83-3 to allow the demolition of a
main dwelling unit in order to construct a new residence while retaining a
second dwelling unit thus providing for the permanent retention of
nonconforming uses.
Section 4. The decision, findings and conditions contained in this
Resolution reflect the Commission's action of September 27, 1983, and the
foll owi ng vote:
AYES: Commissioners Dixon, Fee, Hedlund, Sargis, Jahnke
NOES: Commissioners Harbicht, Wells
ABSENT: None
Section 5. The Secretary shall certify to the adoption of this
Resolution and shall cause a copy to be forwarded to the City Council of the
City of Arcadia.

SPECIAL I~FORMATION
According to the records on file in the building Department, the main dwelling
was constructed in 1935, and the rear dwelling was established by a remodel of
a "chicken house" in 1940. '
Prior to July 7, 1959, the R-l second one-family zone permitted one additional
dwelling for each 7,500 square feet, but no more than three single-family
dwellings were permitted on anyone lot.

However, since the subject property contains two dwellings, the uses are
considered nonconforming to today's codes which limit no more than one
single-family dwelling on anyone lot or parcel of land in the'R-1 zone.
REQUIRED FINDINGS
The Planning Commission should examine the information and make findings which
are relevant to the prerequisite conditions below:
Section 9291.1.2 of the Arcadia Municipal Code states:
"Prerequisite Conditions. Before a variance may be granted, it shall be
shown:
A. That there are exceptional or extraordinary circumstances of
conditions applicable to the property involved, or to the intended use
of the property, that do not apply generally to the property or class of
use in the same zone or vicinity.
B. That the granting of such variance will not be materially
detrimental to the public health or welfare or injurious to the property
or improvements in such zone or viCinity in which the property is
located.
C. That such variance is necessary for the preservation and enjoyment
of a substantial property right of the applicant possessed by other
property in the same zone and vicinity.
D. That the granting of such variance will not adversely affect the
comprehensive General Plan." .
Attached for your consideration are those pages of the application in which
the applicant has stated his case regarding the aforementioned prerequisite
condi tions.
PROPOSAL/ANALYSIS
The !applicant proposes to demolish the main dwell ing in order to construct a
new'two-story residence while retaining the second dwelling.

Staff was informed by the applicant that .the rationale for proposing the
complete removal of the main dwelling is based upon the advice of the
contractor, Mr. Frank Chila, and the architect, Mr. Don Crenshaw, that it
would not be practical to renovate the existing structure in order to support
a second-story addition because it is not structurally sound due to excessive
termi te damage.
The:proposed two-story residence would comply with all building setbacks,
height and lot coverage requirements (see attached site plan and building
elevationl.

It is staff's opinion that although the proposal provides for a new residence
which may be more aesthetically appealing and functional than the existing
main dwelling, it also provides for the permanent retention of nonconforming
uses. In addition, staff does not feel that evidence has been presented which
supports all of the required requisite findings for granting a zone variance.
Pursuant to the provisions of the California Environmental Quality Act, the
Planning Department has prepared an initial study for the proposed project.
Said initial study did not disclose any substantial or potentially substantial
adverse change in any of the physical conditions within the area affected by
the project including land, air, water, minerals, flora, fauna, ambient noise,
and objects of historical or aesthetic significance. Therefore, a Negative
Declaration has been prepared for this project.
RECOMMENDATION
The Planning Department recommends denial of Zone Variance V-83-3
FINDIINGS AND MOTION
Approval
If ,the Planning Commission intends to take action to approve this project, the
Commission should move to approve and file the Negative Declaration and find
that the project will not have a significant effect on the environment and
direct staff to prepare the appropriate.resolution incorporating the specific
findings and conditions of approval set forth in the staff report (or as
modified by the Commission.
Denial
If the Planning Commission intends to take action to deny this project, the
Commission should move to deny and direct staff to prepare an appropriate
resolution incorporating the Commission's decision and findings in support of
that decision.
Attached for your consideration are copies of the proposed site plan, floor
plans and a front building elevation.
