HomeMy WebLinkAbout1248 ,;' . .' .\ " PLANNING COMMISSION RESOLutION 1248 A RESOLUTION GRANTING CONDITIONAL USE 'PERMIT 83-19 FOR AN AUTOMOTIVE GARAGE AT 11725 GOLDRING ROAD WHEREAS, On September 1, 1983 an application was filed by John Kitterman to operate an automotive garage, Planning Deparetment Case No. C.U.P. 83-19, on property commonly known as 11725 Goldring Road, more particularly described as follows: Lots 1601 through 1605 inclusive, Chicago Park Tract, in the City of Arcadia, County of Los Angeles, State of California, as per Map recorded in Book 30, Page 100 of Miscellaneous Records, in the Office of said County Recorder. WHEREAS, a public hearing was held on September 27, 1983 at which time all interested persons were given full opportunity to be heard and present evi deilce; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY , RESOLVES' AS FOLLOWS: , Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds that: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare or injuriOUS to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequte in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive general plan. 6. The use applied for will not have a substantial adverse impact on the environment. WONG ASSISTANT PLANNER John Kitterman (Kitterman's Automotive) 11725 Goldring Road Conditional use permit to operate an automotive garage. 16,050 square feet (.37 acre) 125 feet along Goldring Road Site is developed with two industrial buildings totalling 7,455 square feet; zoned Ml and D. North:lndustrial buildings; zoned M-1&D West: Vacant; zoned M-1&D East: Vacant and industrial buildings; zoned M-l&D South Vacant; zoned M-1&D Industri al The applicant proposes to operate a 2,000 square foot automotive garage within a 4,811 square foot industrial building that is under construction. The site is also developed with a second building containing 2,644 square feet. The development complies with all zoning requirements including landscaping. parking, height, lot coverage and loading. The only modification granted was for zero side yard setbacks (M-82-114). . . . . The applicant notes that all work will be by appointment only and will be performed inside the working bays. Also, no cars will be left outside overnight. He presently has two employees. The proposed use of the site is consistent with the General Plan and zoning of the area. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical er aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATION The Planning Department recommends approval of C.U.P. 83-19 subject to the following conditions: 1. All work for the automotive garage shall be done inside the buil di ng. The automotive garage shall contain a maximum of 2,000 square feet of gross floor area. No expansion of approved uses or services shall be permitted unless a conditional use permit is filed and approved for the proposed expansion. 3, The site shall be maintained as per the plans on file in the Planning Department. 2. 4. All conditions of approval shall be complied with prior to CUP 83-19 becoming effective 5. That C.U.P. 83-19 shall not take effect until owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. FINDINGS AND MOTIONS Approval If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report (or as modified by the Commission).
