A RESOLUTION GRANTING CONDITIONAL USE PERMIT 83-18
FOR THE CHANGE IN USE OF A TAKE-OUT FOOD
ESTABLISHMENT TO AN EATING ESTABLISHMENT AT 160 EAST
DUARTE ROAD.
WHEREAS, on August 29, 1983 Sin Sok Lam filed an application to operate
an eating establishment, Planning Department Case No. C.U.P. 83-18, on property
commonly known as 160 East Duarte Road, more particularly described as follows:
Lots 1, 2, and 3 of Parcel Map No. 2114, in the City of
Arcadia, County of Los Angeles, State of California, as per Map
recorded in Book 32, Page 81 of Parcel Maps, in the Office of
said County Recorder.
WHEREAS, a pUblic hearing was held, on September 27, 1983 at which time
all i:nterested persons were given full opportuni ty to be heard and present

evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY
RESO~VES AS'FOLLOWS:
Section 1. That the factual data submitted by the Planning Department
in the attached report is true and correct.

Section 2. This Commission finds .that:
1. That the granti ng of such Conditional Use Permit will not be
detrimental to the public health or welfare or injurious to the property or
improvements in such zone or vicinity.
2. That the use applied for at the location indicated is properly
one for which a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequte in size and shape
to accommodate said use, and all yards, spaces, walls, fences, parking,
loading, landscaping and other features required to adjust said use with the
land and uses in the neighborhood.

4. That the site abuts streets and highways adequate in width and
pavement type to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not
adversely affect the comprehensive general plan.
6. The use applied for will not have a substantial adverse impact on
the environment.
Section 3. That for the foregoing reasons this Commission grants a
conditional use permit to operate an eating establishment upon the following
conditions:
1. That the seating area (square footage) shall not be enlarged
beyond the area shown on the floor plan on file in the Planning Department.
Any change in design shall be subject to the review and approval of the
Planning Department.
2. That there shall be a maximum of twelve (12) chairs - seating not
to exceed 12 persons. Maximum seating shall be subject to the review and
approval of the Fire Department.
3. That this approval shall not constitute an approval for a general
reduction in parking for the total site. That any modification granted for
parking shall only be for the use approved by C.U.P. 83-18. That a
modification is granted allowing 109 parking spaces in lieu of 112 spaces
(Resolution No. 3726) or 186 spaces required (9269.5).
4. Fire Protection shall be provided to the satisfaction of the Fire
Department.
5. That C.U.P. 83-18 shall not take effect until applicant and/or
owner have executed a document available in the Planning Department which
indicates awareness and acceptance of the conditions of approval.
Section 4. The decision, findings and conditions contained in this
Resolution reflect the Commission's action of September 27, 1983, and the

The applicant is requesting the conditional use permit to place three tables,
which would accommodate 12 chairs, within his donut shop. This would allow
customers to eat on the premises. The addition of tables and chairs changes
the use from a retail activity to an eating establishment, which requires a
conditional use permit.

. The 32,760 square foot commercial retail building was built in 1966 and is
divided into the following uses:
Alpha Beta Market, Liquor Mart, Boulevard Cleaners, Speedwash,
Material Pleasures, Tereyaki House, OJ's Deli, Hair Lines,
Aileen's Gifts and Gallery and Lucky's Donuts.
The site provides for 109 parking spaces, loading facilities and adequate
landscaping. The Donut shop contains 825 square feet of gross floor area.
Under current zoning regulations, the shopping center would need 174 parking
spaces. With the proposed change in use 186 parking spaces would be required.
The 660 square foot Tereyaki House was granted a conditional use permit for
three tables (C.U.P. 82-10). Following is a breakdown of the parking
requirements for the shopping center:
Lucky's Donuts and Tereyaki House
@20 parking spaces per 1,001 sq:ft.

All other retail uses
@5 parking spaces per 1,001 sq.ft.

Prior to the construction of the shopping center, a design overlay (Resolution
No. 3726) was adopted for the site which requires only 112 parking spaces for
the shopping center. One reason for the discrepancy between the existing 109
parking spaces and the 112 spaces required by the design overlay would be the
restriping to accommodate parking for the handicapped.
C.U.P. 82-10 for the Tereyaki House granted a modification allowing 109
parking spaces in lieu of 112 spaces (Resolution No. 3726) or 174 spaces
required (9269.51.
Staff has consistently recommended that seating for 12 persons should be the
maximum permitted for take-out food establishments. Itis staff's opinion
that allowing limited seating in food establishments would not be detrimental
to the site or surrounding properties, but would be an incidental use serving
as a convenience for patrons.

Since 1982 there have been eight conditional use permits granted, for similar
establishments. There has never been oppositrion to these requests, nor has
there been any complaints pertaining to the business after their conditional
use permit was approved. The Planning Commission may wish to direct staff to
initiate a text amendment that would permit take-out food establishments to
provide seating for 12 persons sUbject to the review and approval of the Fire
and Planning Departments. Any food establishment providing seating for more
than 12 persons would require a conditional use permit.

Pursuant to the provisions of the California Environmental Quality Act, the
Planning Department has prepared an initial study for the proposed project.
Said initial study did not disclose any substantial or potentially substantial
adverse change in any of the physical conditions within the area affected by
the project including land, air, water, minerals, flora, fauna, ambient noise,
and objects of historical or aesthetic significance. Therefore, a Negative
Declaration has been prepared for this project.
RECOMMENDATION
The Planning Department recommends approval of C.U.P. 83-18 subject to the
following conditions:
1. That the seating area (square footage) shall not be
enlarged beyond the area shown on the floor plan on file in the
Planning Department. Any change in design shall be subject to the
review and approval of the Planning Department.
2. That there shall be a maximum of twelve (12) chairs -
seating not to exceed 12 persons. Maximum seating shall be
subjeCt to the review and approval of the Fire Department.

That this approval shall not constitute an approval for a general

FINDINGS AND MOTIONS
Approval
If the Planning Commission intends to take action to approve this project, the
Commission should move to approve and file the Negative Declaration and find
that the project will not have a significant effect on the environment and
direct staff to prepare the appropriate resolution incorporating the specific
findings and conditions of approval set forth in the staff report (or as
modified by the Commission).
