PLANNING COMMISSION RESOLUTION 1245
A resolution denying Conditional Use Permit Co~
for the operation of a church and church-relatea
activities at 141 West Las Tunas Drive.
WHEREAS, on July 29, 1983 an application was filed by Parkview Christian
Church to allow the operation of a church and church-related activities,
Planning Department Case No. C.U.P. 83-16, on the properety commonly known as
141 West Las Tunas Drive, more particularly described as follows:
Lot 30 of Tract No. 13540 as per map recorded in Book 277,
pages 11 and 12 of Maps in the Office of the County
Recorder of said CountyHEREAS, a public hearing was held on
September 13, 1983 at which time all interested persons were given full
opportunity to be heard and present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY
RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning Department
in the attached staff report is true and correct.
Section 2. This Commission finds that:
1. The granting of a Conditional Use Permit as hereinafter provided
will not be detrimental to the public health or welfare or injurious to the
property or improvements in such zone or vicinity.
2. The use applied for at the location indicated is properly one for
which a Conditional use Permit if authorized.
3. The site for proposed use is adequate in size and shape to
accommodate said use including all yards, spaces, walls, fences, parking,
loading, landscaping and other features required to adjust said use with the
land and uses in the neighborhood.
4. The site abuts streets and highways adequate in width and pavement
type to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not
adversely affect the comprehensive General Plan.
6. The use applied for will not have a substantial adverse impact on
the envi ronment

Section 3. Based on the foregoing findings of fact the Planning
Commission hereby denies the application for C,U.P, 83-16.
Section 4. The decision, findings and conditions contained in this
resolution reflects the Commission's action of September 13, 1983 and the
following vote:

Section 5. The Secretary shall certify to the adoption of this
Resolution and shall cause a copy to be forwarded to the City Council of the

GENTLEMEN:

The Planning Commission at its September 13, 1983 meeting voted 4 - 1 with two
members absent to adopt Resolution 1245 denying Conditional Use Permit 83-16
for a church at 141 West Las Tunas Drive. The Commission in its consideration
expressed concern that there was not adequate on-site parking space, and the
proposed off-site parking was too far from the church. It was also felt the
proposed use was too intensive for the site, and the Commission noted that the
Conditional Use Permit could be transferred to any church which might purchase
the, property. The applicant, Dr. John Gottuso, appealed the Planning
Commission's denial and the initial public hearing was conducted on October 18,
1983.
At the October 18, 1983 Council meeting, Council tentatively approved C.U.P.
83-16 subject to provision of a revised plot plan showing at least nine parking
spaces. Because of Council's concern regarding parking and the size of the
proposed use in relation to subject property, concern was also expressed
regarding the ability to limit the C.U.P. to this applicant's proposed use and
to properly police and enforce conditions. Accordingly, no final decision was
rendered and any final decision was to be only on Council's adoption of a
Resolution with findings and conditions.
At the City Council meeting of November 15, 1983 additional concerns were
expressed by the Council and a motion was passed to defer consideration of the
resolution and to reopen the public hearing, which is scheduled for tonight's
meeti ng.

In regard to parking, staff has generally treated churches as comparable to a
place :of assembly. In 1973 staff had recommended parking requirements for
"places of assembly" at a ratio of one parking space for every four fixed
seats. The Planning Department has used two methods for calculating the
parking requirements for churches: (1) the one for every four fixed seats
ratio and/or (2) the parking requirement for "other permitted uses". "Other
permitted uses" contained in Section 9269.5 of the Arcadia Municipal Code
specifies no less than 5 parking spaces per 1001 square feet of gross floor
area. Based upon the ratio of one parking space for every four fixed seats and

a maximum attendance of fifty people, a minimum of thirteen parking spaces
would be required. Based upon Section 9269.5, when applied to C.U.P. 83-16,
assuming at least 2,246 square feet of floor area (current improvements without
garage), the minimum parking would be twelve (12) spaces.
