PLANNING COMMISSION RESOLUTION 1243 A RESOLUTION GRANTING CONDITIONAL USE PERMIT 83-15 TO OPERATE AN EATING ESTABLISHMENT AT SPACE 324B, 400 SOUTH BALDWIN AVENUE (SANTA ANITA FASHION PARK) WHEREAS, on July-18, 1983, an appl ication was filed by Robert Reyes to operate an eating establishment, Planning Department Case No. C.U.P. B3-15, on the property commonly known as Space 324B, 400 South Baldwin Avenue, more particularly described as follows: Parcell, Parcel Map 4626 in the City of Arcadia County of Los Angeles, State of California as per Map filed in Parcel Map Book 51-50 WHEREAS, a public hearing was held on August 9, 1983 at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached staff report is true and correct. Section 2. This Commission finds that: 1. The granting of a conditional use permit as hereinafter provided will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2. The use applied for at the location indicated is properly one for which a conditional use permit is authorized. 3. The site for the proposed use is adequate in size and shape to accommodate said use, and all yards, walls, parking, loading, landscaping and other features required to adjust said use with the land uses in the ne i ghborhood. 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the General Plan. 1 1243 . . . 6, The use applied for will not have a substantial adverse impact on the'environment- . Section 3. That for the foregoing conditional use permit for the operation following conditions: 1, That no tables or chairs shall be located in the mall area unless the City Council has granted approval to Santa Anita Fashion Park to allow tables and chairs in the mall areas. 2. The location of tables and chairs within the mall area, if permitted by City Council, shall be subject to the review and approval of the Fire Department prior to installation. 3, That C.U.P. 83-15 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. Section 4. North & East: Developed with the Santa Anita Race Track; Zoned R-1 & S-l South: Developed with a Savings & Loan and multiple family dwell ings; zoned CoO & R-3 respectively. West: Developed with a service station and multiple-family dwellings; zoned CoO and R-1 respectively. Commercial The proposed eating establishment will be located on the lower level near the northeast entrance and located between Republic Federal Savings and the San Francisco Boulangerie. Floor area: Seating: Approximately 500 square feet The proposed pla~ shows seating for 15 persons (six seats are proposed inside ,the eating establishment, and four tables with nine seats are proposed in a railed-off portion of the mall). Pagel ~ . . ~ On July 14 the Planning Department received a letter from Topper Smith, General Manager of Santa Anita Fashion Park, indicating that they have received the required approval from the major' department stores for the concept of seating for the ~ating establishments in the six mall entry a~tade areas. They are preparing plans to present to the City Council for review and approval pursuant to Council Resolution No. 4185. If the Commission acts to approve this Conditional Use Permit the placement of tables and chairs in this area, as proposed in this appl ication, shoul d be conditioned upon the Council's approval of the concept of such placement for the entire mall. ANALYSIS An eating establishment is a permitted use in the C-2 D&H zone with an approved conditional use permit. Pursuant to the provisions of the California Environmental Quality Act and State Guidelines, an initial study has been prepared for the proposed project. The initial study did not disclose any substantial or potentially substantial adverse effect on the environment, hence a Negative Declaration has been filed. Said documents are on file with the Planning Department. RECOMMENDATION The Planning Department recommends approval of C.U.P. 83-15 G7 subject to the foll owi ng condi tions~ ~4 p /], ~ P I 1.
