A RESOLUTION GRANTING CONDITIONAL USE PERMIT 83-13
TO OPERATE AN EATING ESTABLISHMENT AT 651 WEST
DUARTE ROAD
WHEREAS, on July 6, 1983, Kenneth and Jean Burgess filed an application
to operate an eating establishment (delicatessen with tables and chairsl,
Planning Department Case No. C.U.P. 83-13, on property commonly known as 651
West Duarte Road, more particularly described as follows:
A portion of Lot 40, Tract No. 3430, in the City
of Arcadia, . County of Los Angeles, State of
California, as per Map recorded in Book 42, Page
32 of Maps in the Office of said County Recorder.
WHEREAS, a public hearing was held on July 26, 1983 at which time all
interested persons were given full opportunity to be heard and present
evidence;
; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY
RESOLVES AS FOLLOWS:
, Section 1. That the factual data submitted by the Planning Department
in t~e attached report is true and correct.
Section 2. This Commission finds that:
1. The granting of this Conditional Use Permit will not be
detrimental to the public health or welfare or injurious to the
property or improvements in such zone or vicinity.
2. The use applied for at the location indicated is properly one for
which a conditional use permit is authorized.
3. The site for the proposed use is adequate in size and shape to
accommodate said use, and all yards, walls, parking, loading,
landscaping and other features required to adjust said use with
the land and uses in the neighborhood.
4. The site abuts streets and highways adequate in width and pavement
type to carry the kind of traffic generated by the proposed use.

5. The granting of such conditional use permit will not adversely
affect the comprehensive General Plan.
6. The use applied for will not have a substantial adverse impact on
the environment.
Section 3. That for the foregoing reasons this Commission grants a
conditional use permit to operate an eating establishment upon the following
condi,ti ons:
1.
That the seating area (square footage) shall not be
enlarged beyond the area shown on the floor plan on file in
the Planning Department. Any change in design shall be
subject to the review and approval of the Planning
Department. 2'/
That there shall be a maximum of (16) 3ixteell chairs - (/3~ "ffeel ro C,c)
seating not to exceed si~teeR persons
That this approval shall not,constitute an approval for a
general reduction in parking for the total site. That any
modification granted for parking shall only be for the use
approved by C.U.P. 83-13. That a modification is granted
allowing 23 parking spaces in lieu of 61 spaces required
(9269.5.).

Fire protection shall be provided, to the satisfaction of the
Fire Department.
A modification is granted allowing partial deletion of
commercial landscaping requirements: 3$ of parking area to be
landscaped and one tree for every ten parking spaces or
fraction thereof (9269.13.)
A modification is granted permitting existing parking spaces
to be deficient in stall length and aisle width
(9269.7.1. ).
That C.U.P. 83-13 shall not take effect until applicant
and/or owner have executed a document available in the
Planning Department which indicates awareness and
acceptance of the conditions of approval,

GENTLEMEN:
On August 15, 1983 the applicants, Jean and Kenneth Burgess, appealed
Condition Number 2 of Planning Commission Resolution 1242, which state~ th~t
'there shall be a maximum of sixteen (16) chairs (seating not to exceed sixteen
persons), for an eating establishment at 651 West Duarte Road. The applicants
wish~to have seating to accommodate 24 people.
The Fire Department has reviewed the seating plan drawn at 1/4" scale, whf~h
shows how the applicants plan to seat 24 persons. The Fire Department states
in their memo that based on aisle width, exiting and seatin9 arrangement, 18
is the seating capacity of thfs occupancy, subject to ffeld inspections by the
Fire Department.

The seating plan calls out a dinin9 area Of 386 square feet, which is ,.
incorrect since it includes the required aisle for exiting. Note that square
footage of the dining area fs just one of the criteria used by the Fire
Department to detenni nemaximum occupancy.
The Planning Department had originally recommended approval for only 12
chai rs.
Whether this appeal is approved or denfed, the 'maximum seating for ,the eating
establi shment shall be subject to the review and approval of the Fire
Department. Field inspections will be made to insure that adequate aisle
widths and exiting aisle are maintained.
Attached for your consideration are the letter of appeal, the proposed seatfng
plan, Planning Commission Resoloution 1242, Minutes from the Commission's July
26, 1983 meeting, a justification for seating 24 patrons submitted 'by the
applicants to the Commission at its July 26, 1983 meeting, and the staff
report for Conditional Use' Pennit 83-13.

Consideration of a conditional use permit
to allow an eating establishment.
The staff report was presented; the public hearing was opened. The applicant was
present, he had no statement to make,
Jeff Zucker, 130 West LeRoy, who is associated ~ith the business, presented the Com-
mission with a written statement, which he read, aloud, stating that they expect most
of their business to be walk-in, they do,not an'ticipate limited parking to be a
problem. He also quoted the names of some businesses the Commission has approved
recently which have similar circumstances.

MOTI ON
It was moved by Commissioner Sargis, seconded by Commissioner Dixon, to close
the public hearing; the motion passed by voice vote with none dissenting,
Commissioner Sargis asked how the seating would be arranged, and the dimensions of
the area which would contain the tables.

Ken Burgess, 130 West LeRoy was called forward to answer this question. General
discussion followed, concerning the seating capacity, of the building; staff noted
that seating for 12 was recommended with the feeling that it represented a good cutoff
point for eating places for which seating was incidental to the take-out portion of
the business. It was pointed out by Commissioner Jahnke that the two cases quoted by
Mr, Zucker as comparisons were Council appeal decisions, and that the parking situation
in those two and in C.U,P, 83-13 differed in all three cases, Commissioner Sargis
also said he felt the use could accommodate 16 seats comfortably and he would have
no problem in approving 16 seats; he 'did feel that 24 seats were too much,
Mr. Zucker indicated the applicant wo~ld compromise on 16 seats,
MOTION
It was moved by Commissioner Sargis, seconded by Commissioner Dixon, to' file
the Negative Declaration and find the project will not have a significant
effect on the environment, and further move for approval of C.U.P.83-l3 sub-
ject to the recommendations of the Planning Department, but increasing the
maximum number of seats to 16.

PROPOSAL/ANALYSIS
The 8,809 square foot commercial building was built in 1959 and
is divided into the following uses:
Cloister Needlecraft Shoppe, The Family Pizza House, Irwin
Jewelry, Jarry's TV Shanty, Santa Anita Travel, R&ymar Hair
Center, and three vacant sections.
The delicatessen is proposing to occupy a vacant portion of the
building which contains 943 square feet.
The applicant is requesting the conditional use permit to place
tables, which would accommodate 24 chairs, in the delicatessen.
This would allow customers to eat on the premises. The addition
of tables and chairs changes the use from a retail activity to an
eating establishment, which requires a conditional use permit.
A total of 47 parking spaces would be required based on the
existing uses and all vacant portions of the building being
utilized for retail activities. The addition of tables to the
delicatessen increases the parking requirements to 61 spaces: 30
spaces for retail uses, 7 spaces for the pizza house, ~ spaces
for the office use, and 19 spaces for the delicatessen with
tables (eating establishments require 20 parking spaces per 1,001
square feet of gross floor area). There are currently 23 parking
spaces on the property.
In this case, staff feels that the parking spaces should not be
restriped to comply with code. The parking layout is a
continuation of the adjacent parking lot which has one-way
driveways and angled parking spaces (see aerial). In 1949 a
covenant was recorded which required ~ccess for vehicle parking
to be kept open and unobstructed for the subject site and the
adjacent lot to the east (see Land Use & Zoning Map).
Also, requiring full compliance with the commercial landscaping
standards would make a minimal impact upon the parking lot. 100
square feet of landscaping and three trees would be required, but
at least one parking space would be lost and several other spaces
would be interfered with.
It ~s staff's opinion that seating for 24 persons is excessive.
Sta~f would recommend that seating be limited to a maximum of 12
per~ons. This would be consistent with conditional use permits
whiSh have been recently granted for similar establishments by
the Planning Commission.
It is staff's opinion that allowing limited seating in take-out
food establishments would not be detrimental to the site or
surrounding properties, but would be an incidental use to a
delicatessen and will serve as a convenience for patrons.

Pursuant to the provisions of the California Environmental
Quality Act, the Planning Department has prepared an initial
study for the proposed project. Said initial study did not
disclose any substantial or potentially substantial adverse
cha~ge in any of the physical conditions within the area affected
by the project including land, air, water, minerals, flora,
fau~a, ambient noise, and objects of historical or aesthetic
significance. Therefore, a Negative Declaration has been
prepared for this project.
RECOMMENDATION
The Planning Department recommends approval of C.U.P. 83-13
subject to the following conditions:
1. That the seating area (square footage) shall not be enlarged
beyond the area shown on the floor plan on file in the
Planning Department, Any change in design shall be subject
to the review and approval of the Planning Department.

JUSTIFICATION FOR SEATING TWENTY-FOUR (24)
PATRONS AT JEAN'S DELI.
There are 117 non-food related businesses in the West Arcadia shopping
vicinity which are within walking distance to the future site of Jean's
Deli. Estimated at five (5) daytime employees per business, this is
a potential for 585 walk-in customers at said deli. (The largest being
Hinshaws which currently employs 250 day time persons).
In addition, there are also 175 doctor and other professional offices
within the same vicinity. Each office employs an estimate of four(4)
persons equalling another 700 potential walk-in customers. In light
of easy access to deli, parking is not essential; however, to maximize
our servicability seating for twenty-four (24) patrons is essitial.
The site for Jean's Deli is located in the rear of the shopping center
and is not subject to drive-by traffic. The majority of the deli's
business will not be generated from drive-by customers but from local
businesses within walking distance.
It appears that recent decisions by the Arcadia City Council in similiar
cases lend support to our position. Both the following cases were decided
by the city council on April 19, 1983. Arcadia Donut Shop located at
1002 S. Baldwin Avenue was allowed five (5) tables with twenty (20) chairs.
Le Krakeling Bakery located on 11 E. Foothill Blvd. was allowed twelve
(12) tables with twenty-four (24) chairs.
In conclusion your careful consideration on the above matter is appreciated.
