PLANNING COMMISSION RESOLUTION NO. 1241
A RESOLUTION GRANTING A CONDITIONAL USE PERMIT (C.U.P,
83-12) FOR THE EXPANSION OF AN EXISTING AUTOMOTIVE
GARAGE AT 42 WEST LIVE OAK AVENUE.
.
WHEREAS, on May 24, 1983 an application was filed by William Skib-
sted to expand an existing automotive garage, Planning Department Case
No. C.U.P. 83-12, on property commonly known as 42 West Live Oak Avenue,
more particularly described as follows:
Lot 1, Block A, Tract 10898, in the City of Arcadia,
County of Los Angeles, State of California, as per Map
recorded in Book 189, Pages 42 and 43 of Maps. in the
Office of said County Recorder.
WHEREAS, a public hearing was held on June 14,
all ~nterested persons were given full opportunity
pres~nt evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA
HEREBY RESOLVES AS FOLLOWS:
Section 1, That the factual data submitted by the Planning DE-
partment in the attached report is true and correct.
Section 2. This Commission finds that:
1. The granting of a Conditional Use Permit as hereinafter pro-
vided will not be detrimental to the public health or welfare or injur-
ious to the property or improvements in such zone or vicinity.
2. The use applied for at the location indicated is properly one
for which a Conditional Use Permit is authorized.

3. The site for the proposed use is adequate in size and shape
to accommodate said use, including all yards, parking loading, land-
scaping and other features required to adjust said use with the land
and uses in the neighborhood.
4. The site abuts streets and highways adequate in width and pave-
ment type to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not
adversely affect the comprehensive General Plan.
6. The use applied for will not have a substantial adverse impact
on the environment.

Section 3. That for the foregoing reasons this Commission grants
a Conditional Use Permit for the expansion of an automotive garage

upon the following conditions: '
1. That the following conditions,. set forth from the Department
of Public Works be completed to the satisfaction of the Director of
Public Works:
A. Construct curb, gutter, sidewalk and driveway aprons per City
Standards on WeIland Avenue.
B. Construct ramp for handicapped per city Standard at the south-
east corner of Live Oak Avenue and WeIland Avenue.
C. Submit grading and drainage plan for approval of the Director
of Public Worsk.
D. If gates are installed at driveway entrances, they shall not
open over the parkway.
2. That a modification shall be granted for 25 parking spaces in
lieu of 32 spaces required. This approval shall not constitute an
approval for any change in use that would require more than 2 parking
spaces per 1,001 square feet of gross floor area for the 6,067.62
square foot automotive garage approved by C.U.P. 83-12. That any
modification granted for parking shall only be for the use approved
by C.U.P. 83-12. Final parking plan shall be subject to Planning De-
partment review and approval.
3. That one hundred square feet of additional landscaping be
provided. Landscaped areas shall have a complete irrigation system;
shall be maintained in perpetuity; and shall be reviewable annually.
Final landscape (size and type of plants) and irrigation plan shall be
subject to Planning Department review and approval.
4. A modification shall be granted for one hundred square feet of
landscaping in lieu of three hundred square feet required within the
interior of the parking area.
5. A modification shall be granted for a 5 '_0" wide landscape
buffer in lieu of 5'-3" in width required between parking lot and
WeIland Avenue,

in this Resolution reflects the Commission's action of June 14, 1983
and the following vote:

Consideration of a Conditional Use Permit

The staff report was presented; the public hearing was opened.
Mr, William Skibsted, 42 West Live Oak
present and spoke for his application.

Commissioner Jahnke suggested moving the trash container to the back of the property,

There were no others to speak to the application.
MOTION
It was moved by Commissioner Jahnke, seconded by Commissioner Harbicht, to
close the public hearing; the motion passed by voice vote with none dissenting.
Commission Dixon favored the application, with the suggested move of the trash enclo-
sure to the back of the property, and felt that the 5' strip of landscaped buffer waS
adequate,
Commissioner Jahnke pointed out that by continuing the landscaping down the east
side of the property at least 100 square feet of landscaping would be gained, and
suggested that perhaps instead of 300' the Commission might require 100 square feet
additional landscaping.
Commissioner Harbicht also did not consider the additional 300 square feet of land-
scaping of primary importance and he would be in favor of the project; moving the
trash enclosure to the back of the property was a good revision, he thought.

MOTION
'It was moved by Commissioner Jahnke, seconded by Commission Dixon, to approve
C.U.P. 83-12 based on the staff's recommendation with the following modifica-
tions to that staff recommendation;
Item I, modified to grant 24 parking spaces in lieu of 21;
Item 3, modified so that 100 square feet instead 300 square feet of landscaped
area shall be provided, also a 5' in lieu of a 5'-3" wide landscaped
buffer;
all other modifications up to and including No. 9 as is. Further moved to
approve and file the Negative Declaration and find that the project will not
have a significant effect on the environment, and direct staff to prepare the
appropriate resolution incorporating the specific findings and conditions of
approval as modified by the Commission,
Commissioner ,Jahnke explained that the reason he left the 100 additional feet of
landscaping in the conditions is so that the applicant will continue the east side
parking strip back to the building; by so doing he gains 140 square feet.
Commissioner Jahnke wished to add a point to the Motion: to remove the trash
enclosure from the location now indicated into the proposed one-story body shop,
~ Commissioner Dixon accepted the addition to the motion.
Mr, Wong pointed out that the number of parking spaced granted in the motion should
be 26 spaces, not 24.
There was a discussion regarding the placing of the trash container inside the shop
building; the consensus of the Commission was not in favor, principally oecause of
fire danger.
Commissioner Dixon wichdrew his second to the motion; Commissioner Jahnke withdrew
his motion.
MOTION
It was moved by Commissioner Jahnke, seconded by Commissioner Harbicht, to
approve C.U,P, 83-12 in accordance with staff recommendations, with changes
1) 25 parking spaces be required, 2) that 100 square feet of additional
landscaping be provided in lieu of 300 square feet, 3) that a 5'-0" wide
landscaped buffer be provided in lieu of 5'-3" along Weiland Avenue.

PROPOSAL AND ANALYSIS
The applicant proposes to expand an existing automotive garage by con..
struc:ing a 4,195.62 square foot addition. Twenty-three parking spaces
are planned for the site. A 5'-0" landscape buffer will be along
WeIland Avenue and a 5'-3" buffer along the rear property line. Also.
a 6'-0" high wrought iron fence with a concrete block base and columns
will be constructed along WeIland Avenue and a 6'-0" high solid masonry
wall along the rear property line. A 16' x 25' trash enclosure is
proposed north of the existing garage.
An alternate plan for a 4,583.18 square feet of additional building
area is proposed if the modification for a 5'-3" rear yard setback is
denied. The alternate Plan will have a 20'-0" rear yard setback with
the trash enclosure moved within said rear yard, Then a second
addition of 819 square feet (Z&' x 29,25') would be built north of the
existing garage (original location of trash enclosure).
The Planning Department feels that a 5'-3'. rear yard setback would
allow for an appropriate improvement. One mitigating factor would be
the driveway adjacent to the rear property line. Also. the proposed
construction will be single story, sixteen feet in height with a
six foot high solid masonry wall along the rear property line to
bloc~ any view into the adjacent. apartment complex.
It is the Planning Department's opinion that this part of the City is
in need of upgrading. Therefore, whenever possible landscaping should
be provided as required by Code. Even though two parking spaces may
be lost, staff recommends that three hundred square feet of additional
landscaping be provided. Also, the landscape buffer between the
parking lot and \.felland avenue should be 5' -3" in width, It is also
recommended that shrubs or trees be planted within said landscape
buffer along WeIland Avenue to provide for screening, as long as low
level landscaping is used within visibility areas designated by the
Planning Department.
Presently. the site has only four striped parking spaces. The C-M
zone parking requirements state that parking facilities shall be
provided in accordance with the standards for Commercial zones. If

the Commercial parking standard is used, thirty-two parking spaces
would be required. If the garage were to be considered unde; the
industrial parking standard (M-l or M-2 zone), fourteen park~ng spaces
would be required. Following is a breakdown of these parking require-

The reques t for a 6' -0" high fence in I ieu of a maximum height of 3' -0" :
as per the City's visibility standards, has been consistently approved
for commercial, industrial and residential properties if the fence
consisted of open work 3'-0" above grade. The proposed fence
with landscaping will be an attractive addition along WeIland Avenue.
The proposed use and development of the site are consistent with the
General Plan and zoning of the area.
Pursuant to the provisions of the California Environmental Quality
Act, the Planning Department has prepared an initial study for the
proposed project. Said initial study did not disclose any substan-
tial or potentially substantial adverse change in any of the physical
conditions within the area affected by the project including land,
air, water, minerals, flora, fauna, ambient noise, and objects of

... historical or aesthetic significance. Therefore, a Negative Declara-
tion oas been prepa~ed for this project.
If the Planning Commission intends to take action to approve this proj-
ect, the Commission should move to approve and file the Negative Dec-
laration and find that the project will not have a significant effect
on the environment and direct staff to prepare the appropriate resolu-
tion, incorporating the specific findings and conditions of approval
set forth in the staff report (or as modified by the Commission).
If the Planning Commission intends to take action to deny this project,
the Commission should move to deny and direct staff to prepare an appco-
priate resolution incorporating the Commission's decision and findings
in support of that decision.
RECOMt~ENDA T I ON
The Planning Department recommends approval of C.D.P. 83-12 su~ject
to the follo~ing conditions:
1. That the conditions set forth in the attached memorandum from
the Departmenc of Public Works be completed to the satisfaction of
the Director of Public Works.

2. That a modification shall be granted for 21 parking spaces in lieu
of 32 or 34 spaces required if necessary to comply with the landscaping
requirements see forth in condition number 3. This approval shall not
constitute an approval for any change in use that would require more
than 2 parking spaces per 1,001 square feet of gross floor area for the
6,067.62 square foot automotive garage approved by C.D,P, 83-12. That
any modification granted for parktng shall only be for the use approved
by C.D.P. 83-12.. Final parking plan shall be subject to the Planning
Department's review and ap?roval.
