HomeMy WebLinkAbout1240 , . ~ PLANNING COMMISSION RESOLUTION NO. 1240 A RESOLUTION GRANTING CONDITIONAL USE PERMIT 83-11 TO ALLOW THE OPERATION OF AN AUTOMOTIVE GARAGE AT 132 WEST LAS TUNAS DRIVE. WHEREAS, on May 23, 1983 an application was filed by Luis Buonsanti, dba C & L Auto Body, to operate an automotive garage. Planning Depart- ment Case No. C.U.P, 83-11, on property commonly known as 132 West Las Tunas Drive, more particularly described as follows: Part of Lot 68, Santa Anita Colony Tract, in the City of Arcadia, County of Los Angeles. State of California, as per Map recorded in Book 42, Page 87 of Miscellaneous Records, in the Office of said County Recorder. WHEREAS, a public hearing was held on June" 14, 1983, at which time all interested persons were given rull opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning De- partment in the attached report is true and correct. Section 2. This Commission finds that: 1. The granting of a Conditional Use Permit as hereinafter pro- vided will not be detrimental to the public health or welfare or in- jurious to the property or improvements in such zone or vicinity. 2. The use applied for at the location indicated is properly oneifor which a Conditional Use Permit is authorized. I :3. The site for the proposed use is adequate in size and shape to accommodate said use, including all yards, parking, loading, land- scaping and other features required to adjust said use with the land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. - 1 - 1240 . . . 5. That the granting of such Conditional Use Permit will not ad- versely affect the comprehensive General Plan. ,6. The use applied for will not have a substantial adverse impact on the environment. Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit for the operation of an automotive garage upon the following conditions: 1, That a modification shall. be granted tor 35 parking spaces in lieu of 63 spaces required if necessary to comply with the land- scaping requirements set forth in Condition Number 2. This approval shall not constitute an approval for any change in use that would require more than 2 parking spaces per 1,001 square feet of gross floor area for the 4,100 square foot building approved by C.U.P. 83-11. That any modification granted for parking shall only be for the use approved by C,U.P. 83-11, Final parking plan shall be subject to Planning De- partment review and approval. 2. That five hundred square feet of additional landscaping be provided with at least seven fifteen-gallon trees. Landscaped areas shall have a complete irrigation system; shall be well maintained in perpetuity; and shall be reviewable annually. Final landscape and irrigation plan shall be subject to Planning Department review and approval. 3. That the existing on-site parking along Las Tunas Drive be re- striped to comply with Code. This shall be subject to Planning Depart- ment review and approval. 4. Before issuance of a business license all signs and any alter- ations or additions to the building shall be removed or brought into conformance with City standards. All work shall comply with the standards set forth by the Building Department. 5. That a modification shall be granted for three free-standing signs in lie~ of a maximum of two signs. One proposed free-standing sign to be approximately one hundred thirty-eight feet from the existing fre~-standing sign in lieu of two hundred feet. i 6. . That a modification shall be granted fbr a total area of two hundred and two square feet of sign area in lieu of one hundred fifty square feet permitted for all free-standing signs. - 2 - 1240 . 7. That the Kare Youth League shall vacate the site before C.U.P, 83-11 shall become effective. All parking spaces shall be available for patrons of the subject site. 8. Compliance with the following conditions from the Director of ,Public Works: A. Construct concrete sidewalks and driveways on Las Tunas Drive in accordance with City Standards. 8, Submit a grading and drainage plan for approval of the Dir- ector of Public Works. 9. All work for the automotive garage shall be done inside the building. 10. That all the conditions of approval shall be complied with prior to C.D.P. 83-11 becoming effective. 11. That the site shall be maintained as per the plans on file in the Planning Department, 12. That the I'existing empty warehouse" of 2,800 square feet, as . shown on the site/floor plan on file in the Planning Department, shall be used only for warehousing and storage purposes. That any other use permitted in the C-M zone shall require a modification before the Planning Commission. 13. That C.U.P. 83~11 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval; . ~ ~"./ "..../ ~/~~ ~~/ //'~ - 3- 1240 . . . Proposal will require the following modifications: A. 40 parking spaces in lieu of 63 spaces required -- 11 existing parking spaces plus 29 new spaces (9269.5.). B. Deletion of requirement for 3% of the interior of parking area to be landscaped and a minimum of one tree for every ten parking spaces (9269.13.) C. Three free-standing signs in lieu of a maximum of two signs (one existing plus two proposed). One pro- posed free-standing sign to be 138 feet from an exis- ting free-standing sign in lieu of 200'-0" (9262.4.6.C.1.). D. A total area of 20.2 square feet of sign area in lieu of 150 square feet permitted for all free-standing signs (9262.4.6.D.) Approximately 34,580 square feet (.79 acre) 147.71 feet along Las Tunas Drive and 85.56 feet along Live Oak Avenue' 8,900 square foot retail building and 900 square foot eating establishment; zoned C-M. SURROUNDING LAND USE & ZONING: North: Nursery School and single-family dwellings; zoned C-O West: Arcadia Wash and retail center; zoned C-l East: Automobile Garage and Mixed Commercial; zoned,C-M South: Convalescent Hospital; zoned R-4 Multiple- family (Temple City) GENERAL PLAN: Commercial . PROPOSAL ANALYSIS The applicant proposes to convert 4,100 square feet of existing retail space into an automotive garage. This proposal calls for the striping of twenty-nine new parking spaces', a 5'-0" wide landscape strip along Live Oak Avenue, an 8' x 20' trash enclosure and two 5' x 8' free- standing signs. Presently, the site has only eleven striped parking spaces. The C-M zone parking requirements state that parking facilities shall be pro- vided in accordance with the standards for commercial zones. If the commercial parking standard is used, sixty-three parking spaces would be required. If the garage were to be considered under the industrial parking standard (M-l or M-2 zone), fifty-one parking spaces would be required. Following is a breakdown of these parking requirements: COMMERCIAL STANDARD 900 sq. it. eating es tablishment (,20 spaces per 1,001 sq. ft.) = 17.9,8 . . . The Planning Department recommends that the existing on-site parking along Las Tunas Drive be restriped to conply with Code. This would eliminate two parking spaces, thus bringing the total number of spaces to thirty-eight. The ~lanning Department feels that t~is part of th~ City is in need ?f upgrading. Therefore, whenever posslble, landscaplng should be provlded as required by Code. Even though or three parking spaces may be lost, staff recommends that five hundred square feet of additional landscaping .be provided with at least seven fifteen-gallon trees. Square footage modifications for free-standing signs have been approved for through lots having two street frontages. If both Las Tunas Drive and Live Oak Avenue are considered, one hundred fifty square feet of sign area would be permitted along each street for a total of three hundred square feet. If the two new free-standing signs are approved, the signage along Las Tunas Drive would be one hundred twenty-two square feet and eighty square feet along Live Oak Avenue for a total of two hundred and two square feet. The sign along Las Tunas. Drive will be approximately one hundred thirty-eight feet from an existing free-standing sign in lieu of two hundred feet. The applicant has occupied the building without approval from City Departments. During this time signs have been posted and building additions or alterations have been made without permits. Before issuance of a,business license or this Conditional Use Permit becoming effective, all signs and prior work done should be removed or brought into conformance with City standards. The Kare Youth League is currently occupying the parking lot facing Live Oak Avenue. Before this Conditional Use Permit becomes effective, the Kare Yo~th League should v?cate the premises so that all parking spaces will become available to patrons, of the site. The proposed use and development of ~he site are consistent with the General Plan and Zoning of the area. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substan- tial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declara- tion has been prepared for this project. If the Planning Commission intends to take action to approve this pro- ect, the Commission should move ,to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report (or as modified by the Commission). C.U.P. 83-11 6/14/83 Page 3 . . . If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appro- priate resolution incorporating the, Commission's decision and findings in support of, that decision. RECOMMENDATION The Planning Department recommends approval of C.U.P. 83-11 subject to the following conditions: 1. That a modification shall be granted for 35 parking spaces in lieu of 63 spaces required if necessary to comply with the landscaping requirements set forth in Condition Number 2. This approval shall not constitute an approval for any change in use that would require more than 2 parking spaces per 1,001 square feet of gross floor area for the 4,100 square foot building approved by C.U.P. 83-11. That any modifi- cation granted for parking shall only be for the use approved by C.U.P. 83-11. Final parking plan shall be subject to Planning Depart- ments review and approval. 2.
