PLANNING COMMISSION RESOLUTION NO. 1238 A RESOLUTION GRANTING CONDITIONAL USE PERMIT 83-10 TO OPERATE AN EATING ESTABLISHMENT IN SPACE #324, 400 SOUTH BALDWIN AVENUE. WHEREAS, an application was filed on April 20, 1983 by the San Francisco Boulangerie, dba La Petite Boulangerie requesting a Conditional Use Permit to operate an eating establishment, Planning Department Case No. CUP 83-10, on , property commonly known as Space No. 324, 400 South Baldwin Avenue, more particulqrly described as follows: Parcell, Parcel Map 2626, Parcel Map Book 51, Page SO WHEREAS, a public hearing was held on May 10,1983 at which time all interested persons. were given full oppor- tunity to be heard, and to present evidence, NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds that: 1. The granting of this Conditional Use Permit will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2. The use applied for at the location indicated is properly one for which a conditional use permit is authorized. 3. The site for the proposed use is adequate in size and shape to accommodate said use, and all yards, walls, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width and pavement types to carry the kind of traffic generated by the proposed use. -1- . . . 5. The granting of such conditional use permit will not adversely affect the comprehensive General Plan. 6. The use applied for will not have a substantial adverse impact on the environment. Section 3. That for the foregoing reasons, this . Commission grants a Conditional Use Permit to operate an eating establishment upon the following conditions: 1. That plans shall be in substantial compliance with plans on file in the subject case. 2. That the applicant shall comply with all conditions of City Council Resolution 4185. Section 4. The Secretary of this Resolution and shall cause a City Council of the City of Arcadia. EXISTING LAND USE & ZONING: The site is developed with Santa Anita Fashion Park, zoned C-2 D & H .SURROUNDING LAND USE & ZONING: North & East: Developed with the Santa Anita Race Track; zoned R-1 and S-l South: Developed with a Savings & Loan, and multiple-family dwellings, zoned C-O and R-3. GENERAL PLAN DESIGNATIOK: Commercial HISTORY: Seventeen conditional use permits have been granted for eating facili- ties in Santa Anita Fashion Park; fifteen eating facilities are existing (see attached sheet). . Floor area: Seating: 1,720 square feet The proposed plans show seating for 24 persons Restrooms comply with the Building Division requirements. Restrooms: ANALYSIS . An eating establishment is a permitted use in a C-2 DH zone with an approved conditional use permit. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substan- tial or potentially substantial adverse change in any of the physical conditions within the area' affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declara- tion has been prepared for this project. Before the Planning Commission takes action' on this project, the Commission should "move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment". . RECOMMENDATION The Planning Department recommends approval of C.V.P. 83-10 subject to the following condition: 1. That the applicant shall comply with all conditions of City Council Resolution 4185. If the Planning Commission desires to take action to appr~ve this project, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report (or as modified by the Commis- sion) . . .
