RESOLUTION NO. 1237
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF ARCADIA GRANTING A CONDITIONAL USE P~RMIT (C.U.P.
83-9) FOR THE EXPANSION OF A PRESCHOOL AT 141 WEST
LAS TUNAS DRIVE.

WHEREAS, on April 4, 1983 an applicrtion was filed by Victoria
Zahody to allow preschool enrollment to ~ncrease to forty-eight child-
ren and business hours to change to 7:00 a,m. to 6:00 p.m. Monday
through Friday inclusive, Planning Department Case Nc. C.U.P. 83-9, on
the property commonly known as 141 West Las Tunas Drive, more particu-
larly described as follows:
Lot 30, Tract 13540, in the City of Arcadia, County of
Los Angeles, State of California, as per map recorded
in Book 277, Pages 11 and 12 of Maps, in the Office of
said County Recorder,
WHEREAS, a public hearing was held on April 26, 1983, at which
time,all interested persons were given full opportunity to be heard
and present evidence;
NOW, THEREFORE, THE PLANNING COMMISS:ON OF rHE CITY OF ARCADIA
HEREBY RESOLVES AS FOLLOWS:
Section 1.
That the factual data submitted by the Planning
Department in the attached staff report is true and correct.
Section 2. This Commission finds that:
1. The granting of a conditional use permit as hereinafter
provided will not be detrimental to the public health or welfare or
injurious to the property or improvements in such zone or vicinity.
2. The use applied for at the location indicated is properly
one for which a conditional use permit is authorized.
3. The site for the proposed use is adequate in size and shape
to accommodate said use, and all yards, walls, parking, loading, land-
scaping and other features required to adjust said use with the land
uses in the neighborhood.
4. The site abuts streets and highways adequate in width and
pavement type to carry the kind of traffic generated by the proposed
use.

5. The granting of such conditional use permit will not adver-

sely affect the General Plan.
6. The use applied for will not have a substantial adverse
impact on the environment.
Section 3. That for the foregoing reasons this Commission
grants a conditional use permit for the expansion of a preschool upon
the following conditions:
1. That the property shall be improved and maintained in accor-
dance with the plans on file in the subject case No. C.U.P. 83-9.
2. Approval shall be obtained from the Department of Social
Services for the proposed increase to 48 children.
3. That the preschool enrollment be limited to 48 children
per session.
4. The hours of operation shall be limited to 7:00 a.m. to
6:00 p.m., Monday through Friday, inclusive.
5. That the existing landscaped area be permanently irrigated
and maintained.

6. No structures or play equipment in excess of five feet in
height shall be located within three feet of the solid masonry wall
enclosing the outdoor play area.
7. That C.U.P. 83-9 shall not take effect until the owner and
applicant have executed a form available at the Planning Department
indicating awareness and acceptance of the conditions of approval.
Section 4. The Secretary shall certify to the adoption of this
Resolution and shall cause a copy to be forwarded to the City Council
of the City of Arcadia.
I HEREBY CERTIFY that the foregoing resolution was adopted at
a regular meeting of the Planning Commission held on the 10fuday of

On October 14, 1975 the Planning commission adopted Resolution No, 913
permitting the existing preschool at the subject site. The applicant
proposes to expand the preschool to allow forty-eight children per
session instead of thirty, and to expand the hours of operation to
7:00 a.m. to 6:00 p.m. from 8:45 a.m, to 3:30 p,m, Monday through Friday.

The preschool will exceed the required seventy-five square feet of
outdoor play area and thirty-five square feet of indoor play area
for each child. The outdoor play area is enclosed by a six foot high
masonry wall.
The required minimum of one off-street parking space shall be provided
for each employee regularly employed upon the premises. The number of
employees (5) will not increase.
The circular driveway has been enlarged to accommodate two lanes of
auto~obiles to facilitate the loading and unloading of childre~.
The expansion of the preschool is permitted with an approved conditional
use permit. The school complies with all the special zoning regulations
found in Arcadia Municipal Code Sections 9275.3.3. through 9275.3.9.
Find attached a site plan, floor plan and elevations of the proposal,
Pursuant to the prov~sions of the California Environmental QLality
Act, the Planning Department has prepared an initial study for tt&
proposed project. Said initial study did not disclose any substan-
tial or potentially substantial adverse change in any of the physical
conditions within the area affected by the project including land,
air, water, minerals, flora, fauna, ambient noise, and objects of
historical or aesthetic significance. Therefore, a Negative Declara-
tion has been prepared for this project.
Before the Planning Ccommission takes action on tbis project, the
COllmission should "move to approve and file the Negative Declaration
and find that the project will not have a significant effect on the
environment",
RECOMMENDA TI ON
The Planning Department recommends approval of C,U.P. 83-9 subject to
the following conditio~s:
1. That the property shall be improved and maintained in accordance
