PLANNING COMMISSION RESOLUTION NO. 1329
A RESOLUTION GRANTING CONDITIONAL USE PERMIT 86-17 TO
EXPAND THE AUTOMOTIVE GARAGE AT 333 NORTH FIRST AVENUE.
WHEREAS, on November 3, 1986 an application was filed by Robert A. Ruiz
to expand an existing automotive garage, Planning Department Case No. C.U.P. 86-
17, on property commonly known as 333 North First Avenue, more particulary
described as follows:
See Exhibit "A"
WHEREAS, a public hearing was held on January 13, 1987, at which time all
interested persons were given full opportunity to be heard and to present
evi dence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY
RESOLVES AS FOLLOWS:
Section I. That the factual data submitted by the Planning Department in
the attached report is true and correct.
Section 2. This Commission finds:
1. That the granting of such Conditional Use Permit will not be
detrimental to the pUblic health or welfare, or injurious to the property or
improvements in such zone or vicinity.
2. That the use applied for at the location indicated is properly one
for which a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use, and all yards, spaces, walls. fences, parking. loading,
landscaping and other features required to adjust said use with the land and uses
in the neighborhood.
4. That the site abuts streets and highways adequate in width and
pavement type to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Pennit will not adversely
affect the comprehensive General Plan.
6. That the use applied for will not have a substantial adverse impact
on the environment.

Section 3. That for the foregoing reasons this Commission grants a
Conditional Use Permit to expand the automotive garage upon the following
condi tions:
1. That conditions listed below from the Department of Public Works
shall be complied with to the satisfaction of the Director of Public Works.
A. Plant parkway trees at locations determined by the Director of
Public Works per City of Arcadia Standard S-13.
B. Construct P.C.C. sidewalk, as per City Standard.
C. Gravity drainage outlets, and driveway aprons shall be
constructed to conform to Drawing S-11.
D. All survey monuments, centerline ties and survey reference
points shall be protected in place or re-established where
disturbed. This work will be the responsiblity of the premittee
and shall be at the permittee's expense.
2. Fire protection shall be provided to the satisfaction of the Fire
Department which i ncl udes the fo 11 owi ng:
A. Forced ceiling ventilation in battery repair or charging room
with ventilation system interlocked with any charging system.
Motor of ventilation system shall be for hazardous locations.
B. Electrical equipment in charging room shall be explosion proof
and comply with electrical code for Class I Division 1
hazardous locations.
C. Electrical lamps shall be totally enclosed by suitable guards to
.prevent physical damage and prevent falling of hot particles
within the charging room or within 20 feet of the room if not
separated by a partition.
3. Any change in water service shall be installed by the Arcadia Water
Department at the developer's expense.
4. Approval of C.U.P. 86-17 shall be subject to Design Review before
th Arcadia Redevelopment Agency.
5. The following modifications shall be granted:
A. Zero front yard setback in lieu of 10'-0. for existing building
(9266.2.2) .
B. Reduction of a portion of the required landscaping between the
parking lot and La Porte Street (9269.13.B).

6. All work for the automotive garage shall be done inside the

No vehicles may be parked on the premises which are offered for
sale; lease or rent.
g. The gate along La Porte Street shall remain open during business
hours to permit access into the park~ng lot.
10. The site shall be maintained as per the plans on file in the
Planning Department.
11. That C.U.P. 86-17 shall not take effect until the owner and
applicant have executed a form available at the Planning Department indicat~ng
awareness and acceptance of the cond~tions of approval.
12. Noncompliance with the provisions and condit~ons of this
Conditional Use Permit shall constitute grounds for the immedi ate suspension or
revocation of said Permit.
Section 4. The decision, find~ngs and cond~tions contained in this
Resolution reflect the Commission's action of January 13, 1987 and the following
vote:

PROPOSAL AID> ANALYSIS
Building permits show that originally a store building and a dwelling were
built in 1958 on the subject site. Since 1978 a garage (Howard's Tire and
Battery) has been in business in the front half of the building and a dwelling
was located in the rear half.
The applicant proposes to expand the garage into the area which the
dwelling occupied, eliminating a nonconforming use. No additional square
footage will be added to the building. A portion of the roof will be raised
from 9'-0" to 14'-0" to make servicing vehicles easier.
The site has been cleared of debris and some remodeling has already been
done. Presently, there is no landscaping, striped parking lot or trash
enclosure. Remodeling will include paving the City parkway, planting street
trees and on-site landscaping to buffer the parking lot, relocating a
telephone pole guy wire to allow for a new driveway, paving and striping
the parking lot, bUilding a block wall with wrought iron fencing along La
. Porte Street, providing for a trash enclosure and adding a new mansard roof.
Staff feels that both modifications being requested are minor. The zero front
yard setback in lieu of 10'-0" is existing and is consistent with many of the
other buildings along First Avenue. Portions of the 5'-3" wide landscape
buffer along La Porte Street will either be at 3'-7" or deleted (see plot plan).
The 3'-7" landscape strip will provide buffering and allow through access
within the lot. One area that will be void of landscaping will be screened by
the 6'-0" high block wall/wrought iron fence and the other area, next to the
handicap parking space, is being deleted so that the existing driveway will
not have to be altered.
It is the Planning Department's opinion that the development can be
accommodated on the lot as long as the business does not include painting of
vehicles and auto body work. These activities require vehicles to be stored
on the premises for longer periOdS of time, which would eliminate on-site
parking spaces for employees and patrons. Staff has no objection to the
dispensing of tires, batteries, oil and accessories; tuning of motors, wheel and
brake adjustment and other minor repairs and services.

Since this proposal is also within the jurisdiction of the Redevelopment
Agency, approval of C.U.P. 86-17 should be subject to Design Review by the
Arcadia Redevelopment Agency.
An automotive g'arage is a permitted use in the M -1 zone with an approved
conditional use permit. Approval of this conditional use permit would
remove a nonconforming residential use and allow for a substantial
upgrading of the property. Also, the proposal would be consistent with the
zoning and general plan for the area.
Pursuant to the provisions of the California Environmental Quality Act, the
Plannin@ Department has prepared an initial study for the proposed project.
Said initial study did not disclose any substantial or potentially substantial
adverse change in any of the physical conditions within the area affected by
the project including land, air, water, minerals, flora, fauna, ambient noise
and objects of historical or aesthetic significance. Therefore, a Negative
Declaration has been prepared for this project.
RECOMMENDA lI.QR.

The Planning Department recommends approval of C.U.P. 86-17 subject to
the folloWing conditions:
1.
Conditions as outlined in the attached report from the
Department of Public Works shall be complied with to the
satisfaction of the Director of Public Works.
2, Fire protection shall be provided to the satisfaction of the Fire
'Department which includes the following:
A. Forced ceiling ventilation in battery repair or charging
